सां.का.नि. 1 ( अ) .- अभिहित प्राधिकारी, सीमाशुल्क टैरिफ अधित्तियम 1975 1975 का 511 की पहली अनुसूची के उपशीर्ष 8455.30 के अंतर्गत आने वाले रूस, यूक्रेन और कोरिया गणराज्य (जिनको इसके पश्चात संबन देश कहा गया है) में मूलतः उदगमित या वहां से निर्यात किये गए इंडक्शनः हार्डन्ड फोर्ज्ड रोल्स जिसे फार्ज्ड रौलिंग मिल्स के नाम से भी जाना जाता है, वर्क रोल्स तथा बैक अप रोल्स समेत (300 मिमी० व्यास से ऊपर आकार) ( जिनको इसके पश्चात संबद्ध वस्तु कहा गया है) के आयात के मामले में भारत के राजपत्र असाधारण , भाग 1, खंड 1 तारीख 11 दिसम्बर, 2002 में प्रकाशित अपने प्रारंभिक निष्कर्ष अधिसूचना सं० 14/13/2002- डीजीएडी, तारीख 11 दिसम्बर 2002 में इस निर्णय पर पहुंचे हैं कि-
(क) संबद्ध देशों के मूल के अथवा वहाँ से निर्यातित संबद्ध वस्तुओं का सुभी रूप में भारत को निर्यात इसके सामान्य मूल्य से कम पर किया गया है । (ख) घरेलू उद्योग को संबद्ध वस्तुओं के कम पहुँच कीमतों द्वारा हुए कीमत हास के कारण निबल बिक्री प्राप्ति (एनएसआर) में कमी के कारण वित्तीय घाटों के रूप में भी वास्तविकं क्षति हुई है ।
(ग) घरेलू उद्योग को सबद्ध देश के मूल के अथवा वहाँ से निर्यातित संबद्ध माल के पाटन के कारण क्षति हुई है ।
और संबद्ध देशों में मूलतः उद्गमित या वहां से निर्यातित इंडक्शन हार्डन्ड फोर्ज्ड रोल्स जिसे फोर्ड रौलिंग मिल्स के नाम से भी जाना जाता है, वर्क रोल्स तथा बैक अप रौल्स समेत (300 मिमी० व्यास से ऊपर आकार) पर, अंतिम निष्कर्षों तक, अनंतिम रूप से प्रतिपाटन शुल्क लगाने की सिफारिश की है,
अतः अब, केन्द्रीय सरकार, सीमाशुल्क टैरिफ । पाटित वस्तुओं की पहचान, उस पर प्रतिपाटित शुल्क का निर्धारण और संग्रहण तथा क्षति का अवधारण। नियम, 1995 के नियम 13 और 20 के साथ पठितः उक्त सीमाशुल्क टैरिफ अधिनियम की धारा 9 क की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अभिहित प्राधिकारी के पूर्वोक्त निष्कर्षों के आधार पर , अद्योलिखित सारणी के स्तंभ (5) में वर्णित देशों में उद्गमित, उक्त सारणी के स्तंभ (7) की तत्रथानी प्रविष्टि में वर्णित, उत्पादकों द्वारा उत्पादित, भारत में आयात किए गए, ऐसें मालो पर, जो कि उक्त सारणी के स्तंभ (2) की तत्स्थानी प्रविष्टि में वर्णित उक्त सीमाशुल्क टैरिफ अधिनियम की पहली अनुसूची के उपशीर्ष के अंतर्गत आते है, जिनका विवरण उक्त सारणी के स्तंभ (3 ) की तत्स्थानी प्रविष्टि में दिया गया है, और जिनकी विशिष्टता उक्त सारणी के स्तंभ (4) की तत्रथानी प्रविष्टि दी गई है, जब उनका निर्यात उक्त सारणी के स्तंभ (6 ) की तत्स्थानी प्रविष्टि में वर्णित देशों से, उक्त सारणी के स्तंभ (8 ) की तत्स्थानी प्रविष्टि में वर्णित निर्यातकों द्वारा किया जाए , उक्त सारणी के स्तंभ (9 ) की तत्स्थानी प्रविष्टि में वर्णित राशि, जो कि उक्त

2. इस अधिसूचना के अधीन अधिरोपित प्रतिपाटित शुल्क 30 जून, 2003 तक, जिसमें यह तारीख सम्मिलित है, प्रभावी होगा और भारतीय करेंसी में संदेय होगा ।
स्पष्टीकरणः- इस अधिसूचना के प्रयोजनों के लिए,-
(क) " अक्तरण मूल्य " से ऐसा निर्धारणीय मूल्य अभिप्रेत है, जो सीमाशुल्क अधिनियम, 1962 (1962 का 52) के अधीन निर्धारित किया गया हो और इसके अंतर्गत उक्त सीमाशुल्क टैरिफ अधिनियम की धारा 3 ,धारा उक, धारा ४ख धारा 9 और धारा 9 क के अधीन उद्गृहीत शुल्कों को छोडकर, सभी सीमाशुल्क आते हैं;
(ख) " यू एस डी" यानि अमरीकी डालर;
(ग) प्रतिपाटन शुल्क की संगणना के प्रयोजनों के लिए लागू " विनिमय दर " वह दर होगी जो सीमाशुल्क अधिनियम, 1962 (1962 का 52) की धारा 14 की उपधारा (3 ) के खंड । क। के उपखंड (i ) के अधीन शक्तियों का प्रयोग करते हुए, समय - समय पर जारी की गई भारत सरकार के वित्त और कंपनी कार्य मंत्रालय ( राजस्व विभाग) की अधिसूचना में विनिर्दिष्ट की गई है और " विनिमय दर " के अवधारण के लिए सुसंगत तारीख उक्त सीमाशुल्क अधिनियम की धारा 46 के अधीन " प्रवेश पत्र " के प्रस्तुत करने की तारीख होगी ।

G.S.R. 1 (E).- WHEREAS in the matter of import of Induction Hardened Forged Rolls also known as Forged Cold Rolling Mills Rolls including work rolls and back up rolls (sizes above 300 mm dia) (hereinafter referred to as the subject goods ), classified under sub-heading 8455.30 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975 ), originating in, or exported from , Russia, Ukraine and Korea RP (hereinafter referred to as the subject countries ) , the designated authority vide its preliminary findings notification No. 14/ 13 /2002-DGAD, dated the 11th December, 2002, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 11th December, 2002, has come to the conclusion that -
(a) the subject goods in all forms originating in or exported from the subject countries have been exported to India below its normal value ;
(b) the domestic industry has suffered material injury by way of financial losses due to depressed net sales realization on account of price depression caused by low landed prices of the dumped subject goods;
(c) the injury has been caused to the domestic industry by the dumped imports from the subject countries ; and has recommended imposition of provisional anti- dumping duty, pending final determination , on imports of Induction Hardened Forged Rolls also known as Forged Cold Rolling Mills Rolls including work rolls and back up rolls (sizes above 300 mm dia), originating in, or exported from, the subject countries ;
NOW, THEREFORE, in exercise of the powers conferred by sub - section (2) of section 9A of the said Customs Tariff Act, read with rules 13 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury ) Rules, 1995, the Central Government, on the basis of the aforesaid findings of the designated authority, hereby imposes on the goods , the description of which is specified in column (3) of the Table below, falling under sub- heading of the First Schedule to the said Customs TariffAct as specified in the corresponding entry in column (2), the specification of which is specified in column(4) of the said Table, originating in the countries as specified in the corresponding entry in column (5) , and producedby the producers as specified in the corresponding entry in column (7), when exported from the countries as specified in the corresponding entry in column (6), by the exporters as specified in the corresponding entry in column(8), and imported into India, an anti - dumping duty at a rate which is equivalent to the difference between, the amount as specified in the corresponding entry in column (9), in the currency as specified in the corresponding entry in column ( 11 ) and per unit of measurement as specified in the corresponding entry in column (10 ), of the said Table, and the landed value of such imported goods in like currency per like unit of measurement.

2 . The anti - dumping duty imposed under this notification shall be effective up to and inclusive of the 30thday of June, 2003 , and shall be payable in Indian currency .
Explanation. For the purposes of this notification, -
(a) " landed value " means the assessable value as determined under the Customs Act , 1962 ( 52 of 1962) and includes all duties of customs except duties levied under sections 3 , 3A, 8B, 9 and 9A of the said Customs TariffAct;
(b) " USD" means US Dollar;
(c) rate of exchange applicable for the purposes of calculation of such anti - dumping duty shall be the rate which is specified in the notification of the Government of India in the Ministry of Finance (Department of Revenue) , issued from time to time , in exercise of the powers conferred by sub- clause (i ) of clause ( a) of sub- section (3 ) of section 14 of the said Customs Act , and the relevant date for the determination of the rate of exchange shall be the date of presentation of the bill of entry under section 46 of the said Customs Act .
