का.आ. 12( अ ) - जबकि, जांच आयोग अधिनियम , 1952 ( 1952 के अधिनियम सं. 60 ) की धारा 3 द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए, केन्द्र सरकार ने " ऑपरेशन वेस्ट एण्ड" के नाम से तहलका. कॉम द्वारा जारी वीडियो टेपों और प्रतिलिपियों में लगाए गए कुछ आरोपों की जांच करने के लिए का.आ. 266 ( अ ) के रूप में भारत के असाधारण राजपत्र में दिनांक मार्च 24, 2001 को प्रकाशित अधिसूचना संख्या 403/ 1 /2001- ए.वी.डी. -IVद्वारा उच्चतम न्यायालय के एक सेवानिवृत्त न्यायाधीश, न्यायमूर्ति के. वेंकटस्वामी की अध्यक्षता में एक एकल सदस्यीय जाँच-आयोग नियुक्त किया था;
और जबकि, केन्द्र सरकार ने न्यायमूर्ति के. वेंकटस्वामी जाँच- आयोग का कार्यकाल , समय - समय पर बढ़ाया और भारत के असाधारण राजपत्र में दिनांक सितम्बर 21 , 2002 को का.आ. 1021 (अ ) के रूप में प्रकाशित अधिसूचना संख्या 403/ 19/ 2001 - ए.वी.डी. -IV द्वारा उपर्युक्त आयोग का कार्यकाल पिछली बार जनवरी 31 , 2003 तक बढ़ाया;
और जबकि, उपर्युक्त जाँच आयोग के अध्यक्ष के रूप में न्यायमूर्ति के. वेंकटस्वामी ने दिनांक नवम्बर 23 , 2002 को अपना त्यागपत्र देदिया; और जबकि, केन्द्र सरकार ने न्यायमूर्ति के. वेंकटस्वामी जाँच- आयोग से न्यायमूर्ति के. वेंकटस्वामी का त्यागपत्र, नवम्बर 25, 2002 के अपराहन से स्वीकार कर लिया;
और जबकि, उपर्युक्त जाँच-आयोग से न्यायमूर्ति के. वेंकटस्वामी का त्यागपत्र स्वीकार कर लिए जाने के परिणामस्वरूप एक रिक्ति हो गई है ;
और जबकि, केन्द्र सरकार का यह मत है कि उपर्युक्त जाँच जारी रखी जाए और उपर्युक्त आयोग में हुई रिक्ति भरी जाए;
अब , इसलिए, जाँच- आयोग अधिनियम , 1952 की धारा 3 ( 3 ) द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए, केन्द्र सरकार, एतद्वारा, उपर्युक्त एकल सदस्यीय जाँच- आयोग की अध्यक्षता करने के लिए भारत के उच्चतम न्यायालय के एक सेवानिवृत्त न्यायाधीश, न्यायमूर्ति श्री एस. एन. फूकन को नियुक्तकरती है;
2. दिनांक मार्च 24 , 2001 की अधिसूचना द्वारा अधिसूचित किए गए विचारार्थ विषय ही , उपर्युक्त आयोग के विचारार्थ विषय रहेंगे और वे अपरिवर्तित रहेंगे ।

[ PART II-SEC. 3 ( ii ) ] 3. इस अधिसूचना के सरकारी राजपत्र में प्रकाशित होने की तारीख से छह मास की अवधि के भीतर उपर्युक्त आयोग को अपनी रिपोर्ट केन्द्र सरकार को प्रस्तुत करनी है ।
4. यदि उपयुक्त आयोग उपयुक्त समझे तो वह अपने विचारार्थ विषयों के अंतर्गत आने वाले किन्हीं मसलों पर उपर्युक्त तारीख से पहले केन्द्र मरकार को अंतरिम रिपोर्ट दे सकता है ।
5. उपयुक्त आयोग का मुख्यालय नई दिल्ली में होगा।

NOTIFICATION
New Delhi , the 4th January, 2003
S.O. 12( E ).-- Whereas, in exercise of the powers conferred by Section 3 of the Commissions of Inquiry Act . 1952 , (60 of 1952 ) the Central Government had appointed a Single Member Commission of Inquiry headed by Justice K. Venkataswami , a retired Judge of the Supreme Court, to inquire into certain allegations made in the videotapes and ( ranscripts released by tehelka.com under the name "Operation West End" vide Notification No. 403 /1 / 2001 -AVD- IV dated 24th March , 2001 , published in the Gazette of India , Extraordinary, as S.O. 266 ( E ) :
And whereas , the Central Government extended the term of the Justice K. Venkataswami Commission of Inquiry from time to time and vide Notification No. 403 / 19 /2001 - AVD - IV dated 21st September . 2002 published in the Gazette of India. Extraordinary ; as S.O. 1021 ( E ) , the term of the Commission was last extended up to 31st January, 2003;
And whereas. Justice K. Venkataswami tendered his resignation as Chairman of the aforesaid Commission of Inquiry on 23rd November, 2002 ;
And whereas , the Central Government accepted the resignation of Justice K. Venkataswami from the post of Justice K. Venkataswami Conmmission of Inquiry with effect from the afternoon of 25th November , 2002 :
And whereas , consequent upon acceptance of resignation of Justice K. Venkataswami from the Commission of Inquiry a vacancy has arisen,
And whereas . the Central Government is of the opinion that the aforesaid inquiry should continue and the vacancy in the Commission should be filled;
Now, therefore , in exercise of powers conferred by Section 3 ( 3 ) of the Commissions of Inquiry Act . 1952. the Central Government hereby appoints Shri Justice S.N. Phukan , a retired Judge of the Supreme Court of India . to head the Single Member Commission of Inquiry:
2. The terms of reference of the Commission shall be the same as notified vide Notification of 24th March . 2001 and remain unaltered.
3. The Commission shall submit its report to the Cenral Government within a period of six months from the date of publication of this notification in the Official Gazette .
+ The Commission may, if it deems fit. make interim reportsto Central Government before the said date on any matters covered by its terms of refcrence .
5 The headquarters of the Commission shall be at New Delhi .
