का.आ. 20 ( अ ) .- औद्योगिक विवाद अधिनियम, 1947 ( 1947 का 14 ) की धारा 36 - ख द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रक्षा मंत्रालय के तहत रक्षा अनुसंधान तथा विकास विभाग के द्वारा जारी उन्नत प्रौद्योगिकी जलपोत कार्यक्रम से जुड़े जहाज निर्माण केन्द्र , विशाखापट्टनम के संबंध में केन्द्र सरकार संतुष्ट होकर कि उस केन्द्र में नियोजित कर्मकारों के सम्बन्धित औद्योगिक विवादों की जांच और निपटान के लिए पर्याप्त उपबन्ध हैं, एतद्वारा उक्त केन्द्र को औद्योगिक विवाद अधिनियम, 1947 के उपबंधों से मुक्त करती हैं, बशर्ते ठेका श्रमिक तथा अन्य अनियमित श्रमिकों के प्रति श्रम कानूनों , यथा -मजदूरी संदाय अधिनियम , 1936 ( 1936 का 4 ) तथा ठेका श्रम ( विनियमन तथा उत्सादन ) अधिनियम, 1970 (1970 का 37 ) की शर्तों का कड़ाई से पालन किया जाए तथा सहायक श्रमायुक्त ( केन्द्रीय ) , विशाखापट्टनम अंदरूनी शिकायत जांच/निपटान तंत्र केअनुवीक्षण हेतु केन्द्र/कार्यस्थल का समय- समय पर दौरा करें क्योंकि केन्द्र अभी प्रारम्भिक अवस्था में ही है ।

NOTIFICATION
New Delhi , the 3rd January , 2003
S.O. 20( E).- In exercise of the powers conferredby Section 36B of the Industrial Disputes Act, 1947 ( 14 of 1947) , the Central Government , on being satisfied in relation to the Ship Building Centre , Visakhapatnam , an Advance Technology Vessel Programme of the Ministry of Defence , Department of Defence Research and Development and carried on by that Department , and adequate provisions exist for the investigation and settlement of industrial disputes in respect ofworkmen employed in that Centre , hereby exempts the said Centre from the provisions of the Industrial Disputes Act , 1947, subject to the conditions that the labour laws , namely, the Payment of Wages Act, 1936 (4 of 1936) and the Contract Labour (Regulation and Abolition ) Act, 1970 (37 of 1970 ) shall be strictly complied with for contract labour and other non - regular workers and that the Assistant Labour Commissioner (Central ), Visakhapatnam shall visit the Centre/work place from time to time for monitoring the efficacy of in- built grievances investigation /settlement machinery as the Centre is still in its infancy stage .
