का.आ. 40(अ ).- भारतीय यूनिट ट्रस्ट (उपक्रम का हस्तांतरण एवं निरसन) अधिनियम, 2002 (' अधिनियम' ) की धारा 2 की उप- धारा (ज) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्द्वारा निम्नलिखित को अंशदाता के रूप में अधिसूचित करती है :
(क) भारतीय स्टेट बैंक, भारतीय स्टेट बैंक अधिनियम, 1955 (1955 का 23) के तहत स्थापित एक सांविधिक निगम है जिसका केंद्रीय कार्यालय स्टेट बैंक भवन, नरीमैन प्वाइंट, मुंबई-400021 में स्थित है ;
(ख) पंजाब नेशनल बैंक एक निगम है जिसका गठन बैंकिंग कंपनी (उपक्रम का अधिग्रहण तथा हस्तांतरण) अधिनियम, 1970 के तहत किया गया है जिसका मुख्य कार्यालय 7, भीकाजी कामा प्लेस , नई दिल्ली-110066 में स्थित है ;
(ग) बैंक ऑफ बढ़ौदा का गठन बैंकिंग कंपनी (उपक्रमों का अधिग्रहण तथा हस्तांतरण) अधिनियम, 1970 के तहत किया गया है जिसका मुख्य कार्यालय बैंक ऑफ बड़ौदा बिल्डिंग, मांडवी , बड़ोदरा-390006 में स्थित है ; और

(घ) भारतीय जीवन बीमा निगम एक सांविधिक निगम जिसका गठन भारतीय जीवन बीमा निगम अधिनियम, 1956 (1956 का 31 ) के तहत किया गया है तथा जिसका मुख्य कार्यालय ' योगक्षेम ' जीवन बीमा मार्ग, मुंबई-400021 में स्थित है ।

उक्त अंशदाता समान समानुपात में यूटीआई ट्रस्टी कंपनी प्राइवेट लिमिटेड नामक विनिर्दिष्ट कंपनी की शेयर पूंजी से संबद्ध हैं और यह कंपनी, कंपनी अधिनियम, 1956 के तहत संस्थापित की गई है तथा जिसका पंजीकृत कार्यालय यूटीआई म्यूचुअल फंड के ट्रस्टी बतौर अपनी क्षमता में 13, सर- विट्ठलदास ठाकरसे मार्ग , न्यू मैरीन लाइंस, मुंबई-40020 में स्थित है तथा यह कंपनी एतद्द्वारा इस अधिनियम के प्रयोजनार्थ निर्दिष्ट कंपनी के तौर पर अधिसूचित की जाती है।
इसके अलावा, भारतीय प्रतिभूति एवं विनिमय बोर्ड अधिनियम, 1992 के अधीन निर्मित भारतीय प्रतिभूति एवं विनिमय बोर्ड (म्यूचुअल फंड) विनियम, 1996 का अनुपालन सुनिश्चित करने तथा भारतीय यूनिट ट्रस्ट (उपक्रम का हस्तांतरण एवं निरसन) अधिनियम, 2002 की धारा 24 के अधीन अपनी शक्ति का प्रयोग करते हुए इन कठिनाइयों को दूर करने के लिए तां इस अधिनियम के उपबंधों को प्रभावी बनाने के लिए , एतद्वारा घोषित किया जाता है कि ट्रस्ट के अधिकारी और कर्मचारी ( इस अधिनियम की धारा 2 की उप- धारा 1 के अधीन यथापरिभाषित ) यूटीआई आस्ति प्रबंधन कंपनी लिमिटेड के कर्मचारी होंगे , जो कंपनी अंशदाताओं के ऐसे ही सैट द्वारा प्रायोजित है। यूटीआई म्यूचुअल फंड की आस्ति प्रबंधन कंपनी के रूप में अपने क्षमता पर कंपनी अधिनियम, 1956 के अन्तर्गत संस्थापित कंपनी है तथा जिसका पंजीकृत कार्यालय 13, सर- विट्ठलदास ठाकरसे मार्ग न्यू मैरीन लाइंस, मुंबई--400020 पर स्थित है । अधिनियम की धारा 6 के उपबंध उसी तरह प्रभावी होंगे जैसे कि विनिर्दिष्ट कंपनी के संदर्भों को यूटीआई आस्ति प्रबंधन कंपनी प्राइवेट लिमिटेड द्वारा प्रतिस्थापित किया गया है तथा इसके सभी अधिकार, दायित्व तथा लाभ जो अन्यथा अधिनियम की धारा 6 के अनुसार विनिर्दिष्ट कंपनी से संबद्ध होते, यूटीआई आस्ति प्रबंधन कंपनी प्राइवेट लिमिटेड को अपनी क्षमता से यूटीआई म्यूचुअल फंड की शास्ति प्रबंध कंपनी के बतौर उपलब्ध होंगे ।
ऐसी स्थिति में, जहां यूटीआई आस्ति प्रबंधन कंपनी प्राइवेट लिमिटेड़, ट्रस्ट के कर्मचारियों के किसी अधिकार तथा दायित्वों को पूरा न कर रहती हो , यूटीआई ट्रस्टी कंपनी प्राइवेट लिमिटेड उनको पूरा करने के लिए जिम्मेदार होगी ।

S.O.40 (E). In exercise of the powers conferred by sub-section (h) of section 2 of the Unit Trust of India (Transfer of Undertaking and Repeal ) Act , 2002 (the' Act' ) , the Central Government hereby notifies :
(a) State Bank of India, a statutory corporation established under the State Bank of India Act, 1955 (23 of 1955) having its central office at State Bank Bhavan , Nariman Point, Mumbai 400021;
(b) Punjab National Bank, a corporation constituted under the Banking Companies (Acquisition and Transfer of Undertaking) Act, 1970 having its head office at 7 , Bhikhaji Cama Place , New Delhi - 110066;
(c) Bank of Baroda , a corporation constituted under the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 having its head office at Bank of Baroda Building, Mandvi , Vadodara 390006 ; and (d) Life Insurance Corporation of India, a statutory corporation constituted under the Life Insurance Corporation of India Act , 1956 (31 of 1956) having its head office at " Yogekshema " , Jeevan Bima Marg, Mumbai 400021
as the subscribers, in equal proportion, to the share capital of the specified company, namely , UTI Trustee Company Private Limited, a company incorporated under the Companies Act, 1956 with its registered office at 13, Sir Vithaldas Thackersey Marg, New Marine Lines, Mumbai - 400020 in its capacity as trustee of the UTI Mutual Fund and this company is hereby notified as the Specified Company for the purposes of the Act.
Further, with a view to ensure compliance with Securities & Exchange Board of India (Mutual Fund) Regulations , 1996, framed under Securities & Exchange Board of India Act , 1992, and in exercise of its power under Section 24 of the Unit Trust of India ( Transfer of Undertaking & Repeal ) Act , 2002 to remove difficulties and to give effect to the provisions of the Act , it is hereby declared that [PART II-SEC. 3 (ii )] THE GAZETTE OF INDIA : EXTRAORDINARY
the officers and employees of the Trust (as defined under sub- section (k) of section 2 of the Act) , shall be the employees of the UTI Asset Management Company Private Ltd. , a company sponsored by the same set of subscribers and incorporated under the Companies Act, 1956, with its registered office at 13, Sir Vithaldas Thackersey Marg, New Marine Lines , Mumbai 400020, in its capacity as asset management company of UTI Mutual Fund . The provisions of section 6 of the Act shall have effect as if references to the specified company have been substituted by UTI Asset Management Company Private Limited and all rights , obligations and benefits that would have otherwise attached to the specified company pursuant to section 6 of the Act shall attach and be available to UTI AssetManagement Company Private Limited in its capacity as asset management company of UTI Mutual Fund .
In the event of UTI Asset Management Company Private Limited not fulfilling any of the rights and obligations of the employees of the Trust, the UTI Trustee Company Private Limited shall be liable to fulfil the same.

का.आ. 41 ( अ).- भारतीय यूनिट ट्रस्ट (उपक्रम का हस्तांतरण एवं निरसन) अधिनियम , 2002 ( 'अधिनियम' ) (2002 का 58) की धारा 4 की उप- धारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा अधिनियम के प्रावधानों के प्रयोजनार्थ 1 फरवरी , 2003 को "नियत तिथि " के रूप में अधिसूचित करती है ।

का.आ. 42 ( अ) .- भारतीय यूनिट ट्रस्ट (उपक्रम का हस्तांतरण एवं निरसन) अधिनियम, 2002 (2002 का 58) की धारा 7 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा श्री एम. दामोदरन, भा.प्र.सेवा (एम.टी .: 71 ) को केन्द्र सरकार के लिए तथा की ओर से भारतीय यूनिट ट्रस्ट के विनिर्दिष्ट उपक्रम का प्रशासन कार्यभार संभालने तथा प्रबंधन कार्य करने के प्रयोजनार्थ नियत तिथि, अर्थात, 1 फरवरी, 2003 से एक वर्ष की अवधि के लिए अथवा अगले आदेशों तक, जो भी पहले हो, भारतीय यूनिट ट्रस्ट के विनिर्दिष्ट उपक्रम के प्रशासक के रूप में नियुक्त करती है ।

In exercise of the powers conferred by sub- section (1 ) of section 7 of the Unit Trust of India (Transfer of Undertaking and Repeal ) Act, 2002 (58 of 2002) , the Central Government hereby appoints Shri M. Damodaran, IAS (MT: 71 ) as the Administrator of the specified undertaking of the Unit Trust of India, for a period of one year with effect from the appointed day , i.e. , 1st February , 2003 or until further orders, whichever is earlier, for the purposes of taking over the administration and carrying on the management of the specified undertaking of the Unit Trust of India for and on behalf of the Central Government .

का.आ. 43 ( अ ) .- भारतीय यूनिट ट्रस्ट (उपक्रम का हस्तांतरण एवं निरसन ) अधिनियम , 2002 (2002 का 58) की धारा 9 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्द्वारा भारतीय यूनिट ट्रस्ट के विनिर्दिष्ट उपक्रम का प्रबंधन कार्य करने में प्रशासक को सलाह देने एवं सहायता करने हेतु निम्नांकित व्यक्तियों को सलाहकार मण्डल में नियुक्त करती है ।
