विदेशी मुद्रा प्रबंध ( विदेशी प्रतिभूति का अंतरण अथवा निर्गम ) ( संशोधन ) विनियमावली, 2003
सा.का.नि. 34 (अ ).- विदेशी मुद्रा प्रबंध अधिनियम , 1999 ( 1999 का अधिनियम 42 ) की धारा 6 की उपधारा 3 के खंड ( क ) और धारा 47 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग तथा दिनांक 3 मई , 2000 की अधिसूचना सं. फेमा. 19/2000-आरबी में आंशिक संशोधन करते हुए भारतीय रिज़र्व बैंक, विदेशी मुद्रा प्रबंध ( विदेशी प्रतिभूति का अंतरण अथवा निर्गम ) विनियमावली , 2000 में निम्नलिखित संशोधन करता है, नामतः ,
1. संक्षिप्त नाम और प्रारंभ
(i ) यह विनियमावली विदेशी मुद्रा प्रबंध ( विदेशी प्रतिभूति का अंतरण अथवा निर्गम ) ( संशोधन ) विनियमावली, 2003 कहलाएगी । ( ii ) यह राजकीय राजपत्र में प्रकाशन की तारीख से लागू होगी ।
2. विनियमावली में संशोधन
विदेशी मुद्रा प्रबंध ( विदेशी प्रतिभूति का अंतरण अथवा निर्गम ) विनियमावली, 2000 के विनियम 6 के उप विनियम (2 ) में निम्नलिखित संशोधन किया जाएगा:
(क ) उपबंध के खंड ( i ) के स्थान पर निम्नलिखित उपबंध प्रतिस्थापित किया जाएगा : " बशर्ते कि म्यांमार और सार्क देशों ( नेपाल , भूटान और पाकिस्तान के सिवाय ) में संयुक्त उद्यम/पूर्ण स्वाधिकृत अनुषंगी के संबंध में किसी एक वित्तीय वर्ष में कुल वादा 150 मिलियन अमरीकी डॉलर अथवा उसके समतुल्य रकम से अधिक नहीं होगा। "
(ख) खंड ( ii ) में शब्दों और अंकों में " 350 करोड़ रुपए " के स्थान पर " 700 करोड़ रुपए " प्रतिस्थापित किया जाएगा ।

Foreign Exchange Management (Transfer or Issue of any Foreign Security) (Amendment) Regulations, 2003 G.S.R. 34 ( E ) . In exercise of the powers conferred by clause (a) of Sub-section (3 ) of Section 6 , and Sub -section (2) of Section 47 of the Foreign Exchange Management Act, 1999 (42 of 1999) , and in partial modification of its Notification No. FEMA 19/ RB - 2000 dated May 3, 2000 , the Reserve Bank of India makes the following amendments in the Forcign ExchangeManagement ( Transfer or Issue of any Foreign Security ) Regulations , 2000 , namely:---
1. Short Title and Commencement :
(1) These Regulations may be called the Foreign Exchange Management (Transfer or Issue of any Foreign Security) (Amendment ) Regulations, 2003 ,
(ii) They shall come into force on their publication in the Official Gazette.
2. Amendment of the Regulations :
Inthe Forcign Exchange Management (Transfer or Issue of any Foreign Security) Regulations, 2000, in Regulation 6, in sub - regulation (2) :
(a) inclause ( i) for the proviso , the following proviso shall be substituted, namely
"Provided that in respect of commitment in Joint Ventures/Wholly Owned Subsidiaries in Myanmar and SAARC countries (other than Nepal, Bhutan and Pakistan) the total commitment shall not exceed US$ 150 million or equivalent in any one financial year . "
(b) in clause ( ii ) , for the words and figures " Rupees 350 crores " the words and figures "Rupees 700 crores " shall be substituted .
