आदेश

नई दिल्ली, 16 जनवरी, 2003

का.आ. 49 ( अ )- केन्द्रीय सरकार, आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10) की धारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उर्वरक (नियंत्रण) आदेश , 1985 का और संशोधन करने के लिए निम्नलिखित आदेश करती है , अर्थात:-

1 (1). इस आदेश का संक्षिप्त नाम उर्वरक ( नियंत्रण) संशोधन आदेश , 2003 है ।

(2) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।

2. उर्वरक (नियंत्रण ) आदेश , 1985 ( जिसे इसमें इसके पश्चात एक आदेश कहा गया है) के खंड 2 में- (0) उप खंड (ब) के पश्चात निम्नलिखित उपखंड अंतःस्थापित किया जाएगा , अर्थात:-

(ढ ढ) " अधिसूचित प्राधिकारी " से खंड 26 क के अधीन नियुक्त प्राधिकारी अभिप्रेत है । " ( ii) उपखंड (घ) में, "उपखंड 26 के अधीम" शब्दों और अंकों के पश्चात और " के अधीन नियुक्त" शब्दों के पहले " उर्वरकों के मिश्रण और उर्वरकों के विशेष मिश्रण की बाबत" शब्द अंत्तः स्थापित किए जाएंगे ।

3. उक्त आदेश के अध्याय शीर्षक " iv व्यौहारियों का रजिस्ट्रीकरण " के स्थान पर " iv व्यौहारियों का प्राधिकरण और रजिस्ट्रीकरण " अध्याय शीर्षक रखा जायेगा ।

4. उक्त आदेश के खंड 7 के स्थान पर, निम्नलिखित खंड रखा जाएगा , अर्थात:

" 7. औद्योगिक व्यौहारियों का रजिस्ट्रीकरण और अन्य रजिस्ट्रीकरण का प्राधिकार/खंड 8 के अधीन और इसके अनुसार के सिवाए कोई व्यक्ति किसी स्थान पर थोक व्यौहारी अथवा फुटकर व्यौहारी के रूप में न तो उर्वरकों की बिक्री करेगा , न बिक्री के लिए प्रस्ताव करेंगा और न ही बिक्री को कारबार करेगा:

परंतु कोई राज्य सरकार, यदि वह आवश्यक और समीचीन समझती है तो राजपत्र में अधिसूचना द्वारा किसी व्यक्ति को ऐसे क्षेत्रों के किसानों को और ऐसी शर्तों के अधीन , जो इस अधिसूचना में विनिर्दिष्ट की जाएं , इस खंड के उपबंधों से छूट दे सकेगी । "

उक्त आदेश के खंड 8 के स्थान पर निम्नलिखित खंड रखा जाएगा , अर्थात:- "8 सूचन्ग या रजिस्ट्रीकरण के लिए आवेदन

(1) ऐसा प्रत्येक व्यक्ति जिसका औद्योगिक व्यौहारी के रूप में उर्वरकों का विक्रय करने या विक्रय का प्रस्ताव करने या विक्री का कोरबार करने का आशय रखता है, प्ररूप ' क' में आवेदन करके तथा खंड 36 के अंतर्गत विहित फीस जमा करके और प्ररूपण में स्रोत का प्रमाणपत्र प्रस्तुत करके , नियंत्रक से रजिस्ट्रीकरण प्रमाण पत्र प्राप्त करेगा ।

(2) कोई व्यक्ति जिसके अंतर्गत विनिर्माता और आयातकर्ता , पूल हैण्डलिंग अभिकरण , थोक विक्रेता और कोई खुदरा व्यौहारी भी है , जो उर्वरकों का विक्रय करने या विक्रय का प्रस्ताव करने या बिक्री का कारबार करने का आशय रखता है प्रारूप क-1 में , दो प्रतियों में , सम्यक् रूप से भरकर खंड 36 में विहित फीस सहित और प्ररूपण में स्रोत के प्रमाणपत्र के साथ अधिसूचित प्राधिकारी को सूचना का ज्ञापन देगा ।

हर प्रकार से पूर्ण सूचना ज्ञापन के प्राप्त होने पर अधिसूचित प्राधिकारी प्ररूप क 2 की प्राप्ति की पावती जारी करेगा और इसे इस आदेश के प्रयोजन के लिए अनुदत प्राधिकार पत्र और संबंधित व्यक्ति को प्राधिकृत व्यौहारी माना जाएगा ।

परंतु यह कि उर्वरक ( नियंत्रण) आदेश, 2002 के प्रारंभ होने के पूर्व अनुदत किया गया रजिस्ट्रीकरण प्रमाणपत्र को इस आदेश के उपबंधों के अधीन जारी किया गया प्राधिकार पत्र माना जाएगा ;

परंतु यह और भी कि, जहां आवेदक कोई राज्य सरकार , विनिर्माता , कोई आयातकर्ता या पूल हैण्डलिंग अभिकरण है , तो इसके या उसके लिए प्ररूपण प्रस्तुत करना आवश्यक नहीं होगा । परंतु यह भी कि यथास्थिति थोक विक्री , कारबार या खुदरा डीलरशिप के लिए किसी आवेदक द्वारा पृथक सूचना ज्ञापन प्रस्तुत किया जाएगा ।

परंतुक यह और भी कि जहां बिक्री के लिए उर्वरकों को विभिन्न स्रोतों से प्राप्त किया जाता है , वहां ऐसे प्रत्येक स्रोत से स्रोत प्रमाण पत्र प्ररूपण में प्रस्तुत किया जाएगा । " भारत का राजपत्र असाधारच

6. उक्त आदेश के खंड 9 में,

(1) प्रारंभ में " रजिस्ट्रीकरण प्राधिकारी या जैसी भी स्थिति हो " शब्दों का लोप किया जाएमा, (11) खंड ( च) के परंतुक में " रजिस्ट्रीकरण का विधिमान्य प्रमाणपत्र" शब्दों के स्थान पर " प्राधिकार पत्र" शब्द रखे जाएंगे ।

7. उक्त आदेश के खंड 10 के स्थान पर, निम्नलिखित खंड रखा जाएगा अर्थात:-

" 10 रजिस्ट्रीकरण प्रमाणपत्र और प्राधिकार पत्र की विधिमान्यता की अवधि । खंड 9 के अंधीन जारी किया गया प्रत्येक रजिस्ट्रीकरण प्रमाणपत्र और खंड 8 के अधीन जारी किया गया प्रत्येक प्राधिकार पत्र , जब तक कि नवीकृत निलम्बित या स्द नहीं किया गया हो, इनके जारी होने की तारीख से तीन वर्ष की अवधि के लिए विधिमान्य होंगे ।

8. उक्त आदेश के खंड 11 के स्थान पर , निम्नलिखित खंड रखा जाएगा , अर्थात: - " 11 रजिस्ट्रीकरण प्रमाणपत्र और प्राधिकार पत्र का नवीकरण

(1) खंड (9) के अधीन अनुदत किए गए रजिस्ट्रीकरण प्रमाणपत्र या खंड 8 के अधीन अनुदत किए गए या अनुदत हुए माने गये प्राधिकार पत्र का प्रत्येक धारक, जो ऐसे रजिस्ट्रीकरण प्रमाण पत्र या प्राधिकार पत्र, जैसी भी स्थिति हो , के अवसान की तारीख के पूर्व ऐसे प्रमाणपत्र या प्राधिकार पत्र के नवीकरण के लिए प्ररूप में में नियंत्रक को या प्ररूप क 1 में अधिसूचित अधिकारी को , दो प्रतियों में आवेदन करेंगा , जिसके साथ ही खंड 36 के अधीन ऐसे नवीकरण के लिए विहित फीस और खंड 8 में यथा अपेक्षित स्रोत का प्रमाणपत्र भी संलग्ने करेगा ।

(2) उपखंड (i) के अधीन आवेदन पत्र और उसके साथ ऐसी फीस और स्रोत का प्रमाण पत्र प्राप्त होने पर नियंत्रक रजिस्ट्रीकरण प्रमाणपत्र का नवीकरण कर सकेगा या अधिसूचित प्राधिकारी , जैसी भी स्थित्ति हो , नवीकरण की पावती रसीद प्ररूप क 2 में जारी करेगा ।

परंतु किसी रजिस्ट्रीकरण प्रमाणपत्र का नवीकरण नहीं किया जाएगा यदि उसका धारक उसकी विधिमान्यता की अवधि की समाप्ति की तारीख से ठीक एक वर्ष पहले की अवधि के भीतर उर्वरकों की बिक्री नहीं की है ।

(3) यदि रजिस्ट्रीकरण प्रमाण पत्र या प्राधिकार पत्र जैसी भी स्थिति हो , की विधिभान्यता की अवधि के अवसान से पहले नवीकरण के लिए कोई आवेदन नहीं किया जाता है , किंतु ऐसी अवधि की समाप्ति की तारीख के एक मास के भीतर आवेदन किया जाता है तो रजिस्ट्रीकरण प्रमाण पत्र या प्राधिकार पत्र , जैसी भी स्थिति हो, का निपटान नवीकरण के लिए फीस के अतिरिक्त खंड 36 के अंतर्गत विहित ऐसी अतिरिक्त फीस का संदाय करके उपखंड (2) में किए गए प्रावधान के अनुसार किया जाएगा ।

(4) जहां पंजीकरण प्रमाणपत्र के नवीकरण के लिए आवेदन , उपखंड ( 1 ) या उपखंड ( 3) में विनिर्दिष्ट समय के भीतर किया जाता है, जब तक नियंत्रक नवीकरण के आवेदन पर अपना आदेश नहीं दे देता है तब तक यह माना जायेगा कि आवेदक के पास वैध रजिस्ट्रीकरण प्रमाणपत्र विद्यमान है । THE GAZETTE OF INDIA : EXTRAORDINARY

[PART II SEC. 3 (ii )) (5) यदि विधमान्यता की उनका अवधि के अवसान की तारीख से एक मास के भीतर राजस्ट्राकरण प्रमाणपत्र या प्राधिकार पत्र के नवीकरण के लिए आवेदन नहीं किया जाता है तो इसके अवसान की तारीख से ही उसे व्यपगत माना जायेगा और उस तारीख के पश्चात किया गया कोई कारबार खंड 7 का उल्लंघन माना जाएगा । "

9. उक्त ओवश के खंड 13 के उपखंड (3) का लोप किया जाएगा ।

10. उक्त आदेश के उपखंड 15 में,-

( i) • उपखंड ( 1 ) के स्थान पर निम्नलिखित उपखंड रखा जाएगा , अर्थात:-

"( 1 ) खंड 14 के अधीन , आवेदन प्राप्त होने पर रजिस्ट्रीकरण प्राधिकारी उर्वरक के मिश्रण या उर्वरक के विशेष मिश्रण के विनिर्माण के लिए प्रमाण पत्र देगा या लिखित रूप में मना करेगा और आवेदन पत्र प्राप्त होने के पैतालिस दिन के भीतर ऐसे पारित किए गए आदेश की एक प्रति आवेदक को देगा ।

(ii) उपखंड ( 2) में

(क) " रजिस्ट्रीकरण प्राधिकारी" शब्दों के स्थान पर , " रजिस्ट्रीकरण प्राधिकारी आवेदन प्राप्त करने की तारीख से पैंतालीस दिन के भीतर" शब्द रखे जाएंगे । (ख) " ऐसा प्राधिकारी " शब्दों के स्थान पर " ऐसा प्राधिकारी आवेदन प्राप्त होने की तारीख से पैंतालीस दिन के भीतर" शब्द रखे जाएगे ।

11. उक्त आदेश के उपखंड 16 के उप उपखंड (2) में, -

(1) "तीन मास" शब्दों के स्थान पर " छह मास " शब्द रखे जाएंगे ।

(ii) परन्तुक में " छह मास" शब्दों केथान पर " बारह मास" शब्द रखे जाएंगे ।

12. उक्त आदेश के खंड 18 के उपखंड (2) , (3) और ( 4) में " रजिस्ट्रीकरण प्रमाणपत्र" शब्दों के स्थान पर जहां जहां वे आते है , " विनिर्माण प्रमाण पत्र" शब्द रखे जाएंगे ।

13. उक्त ओदश के खंड 19 की मद ( ग) की उप मद (ii) में " नकल या " शब्दों के स्थान पर " की नकल या" शब्द रखे जाएंगे ।

14. उक्त आदेश के खंड 20 के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा , अर्थात: - " 20 क. अनंतिम उर्वरक के संबंध में विनिर्देश-

इस आदेश में किसी बात के होते हुए भी , केन्द्रीय सरकार , राजपत्र में प्रकाशित आदेश के द्वारा वाणिज्यिक परीक्षण करने के लिए किसी निर्माणकारी यूनिट द्वारा विनिर्मित किए जाने वाले उर्वरकों के संबंध में तीन वर्ष से अनधिक की अवधि के लिए विधिमान्य विनिर्देश अधिसूचित करेगी । " भारत का राजपत्र असाधारण

15. उक्त आदेश के खड 21 में,-

(0) पैरा (क) के स्थान पर निम्नलिखित पैरा रखा जाएगा , अर्थात:-

"(क) प्रत्येक आधान पर जिसमें कोई उर्वरक रखा जाता है , सहजदृश्य रूप से " उर्वरक" शब्द अंकित किए जाएंगे और उस पर ऐसी केवल विशिष्टयाही होंगी जब तक कि अन्यथा किसी विधि द्वारा अपेक्षित न हों, जो समय- समय पर नियंत्रक द्वारा , इस निमित्त विनिर्दिष्ट की जाएं , इसके सिवाय कुछ नहीं होगा ; और पैरा (ख) के पश्चात निम्नलिखित पैरा अंतःस्थापित किया जाएगा . अर्थात:-

(ii)

"(ग) प्रत्येक उर्वरक थैला , जिसमें विक्रय के लिए कोई उर्वरक पैक किया जाता है , ऐसे भार और आकार का होगा जो इस निमित्त केनद्रीय सरकार द्वारा समय - समय पर विनिर्दिष्ट किया जाए ।"

16. उक्त आदेश के खंड 23 में,

(i ) उपखंड ( 1 ) में,-

(क) " कोई उर्वरक" शब्दों के स्थान पर , " कोई उर्वरक , ऐसे उर्वरक के सिवाय , जो केन्द्रीय सरकार द्वारा आयात किया गया है" शब्द अंतःस्थापित किए जाएंगे ;

(ख) " रजिस्ट्रीकरण प्राधिकारी " शब्दों के स्थान पर " अधिसूचित प्राधिकारी " शब्द रखे जाएंगे ;

( ii) जाएंगे ; उपखंड (2) में , " रजिस्ट्रीकरण प्राधिकारी " शब्दों के स्थान पर, " अधिसूचित प्राधिकारी" शब्द रखे (iii) उपखड (3) के पश्चात निम्नलिखित उपखंड अंतःस्थापित किया जाएगा, अथातः-

"(4) जहां केन्द्रीय सरकार द्वारा आयातित कोई उर्वरक गैरमानक का पाया जाता है और केन्द्रीय सरकार विनिश्चय करती है कि उर्वरक को कृषि में सीधे उपयोग के लिए अनुज्ञात नहीं किया जा सकता, तो उस मूल्य पर बेचे जाने के लिए , जिसे केन्द्रीय सरकार द्वारा नियत किया जाए, संश्लिष्ट उर्वरकों, उर्वरकों के मिश्रण या उर्वरकों के विशेष मिश्रण के विनिर्माताओं द्वारा विनिर्मित ऐसे उर्वरकों के उपयोग की अनुमति दी जा सकेगी । " :

17. उक्त आदेश के खंड 26 में , " औद्योगिक व्यौहारियों के लिए रजिस्ट्रीकरण प्रमाणपत्र दिए जाने या नवीकरण के सिवाय " शब्दों का लोप किया जाएगा ।

18. उक्त आदेश के खंड 26 के पश्चात निम्नलिखित खंड अंतःस्थापित किया जाएगा , अर्थात्ः- "26 क . अधिसूचित प्राधिकारी- राज्य सरकार राजपत्र में अधिसूचना द्वारा उतनी संख्या में व्यक्तियों को, जो वह ठीक समझे , इस आदेश के प्रयोजन के लिए अधिसूचित प्राधिकारी होने के लिए नियुक्त करेगी और ऐसी स्थानीय सीमाएं , जिनके भीतर ऐसा अधिसूचित प्राधिकारी अपनी प्राधिकारिता का प्रयोग करेगा , को परिभाषित करेगी । " 6

[PART II -SEC. 3 (ii)] 19. ( i) उक्त आदेश के विद्यमान खंड 29 को उसके उपखंड ( 1 ) के रूप में पुनः संख्यांकित किया जाएगा;

(ii) इस प्रकार पुनः संख्यांकित उपखंड ( 1 ) में " केन्द्रीय उर्वरक क्वालिटी और प्रशिक्षण संस्थान" शब्दों से पूर्व "केन्द्रीय सरकार के पूर्वानुमोदन से " शब्द अंतःस्थापित किए जाएंगे;

(iii) अर्थात्ः- इस प्रकार पुनः संख्यांकित उपखंड ( 1 ) के पश्चात् निम्नलिखित उपखंड अंतःस्थापित किया जाएगा , "(2) उपखंड ( 1 ) में निर्दिष्ट किसी प्रयोगशाला में उर्वरकों के नमूनों के सही विश्लेषण को सुनिश्चित करने के लिए ऐसे न्यूनतम उपस्कर और अन्य प्रयोगशाला प्रसुविधाएं होंगी, जो समय- समय पर , इस निमित्त नियंत्रक द्वारा विनिर्दिष्ट की जाएं । "

20. (i ) उक्त आदेश के विद्यमान खंड 29 को उसके उपखंड (1) के रूप में पुनः संख्याकित किया जाएगा;

(ii ) इस प्रकार पुनः संख्याकित उपखंड ( i ) में " प्रशिक्षण संस्थान या" और "राज्य सरकार द्वारा " शब्दों के बीच " केन्द्रीय सरकार के पूर्व अनुमोदन से " शब्द अंतःस्थापित किए जाएंगे;

इस प्रकार पुनःसंख्याकित उपखंड ( i) के पश्चात् निम्नलिखित उपखंड अंतःस्थापित किया जाएगा; अर्थात-

(2) उपखंड (i ) में निर्दिष्ट प्रत्येक प्रयोगशाला के पास उर्वरक नमूनों का सही विश्लेषण सुनिश्चित करने के लिए न्यूनतम उपस्कर और अन्य प्रयोगशाला सुविधाएं होगी जैसी कि नियंत्रक द्वारा समय समय पर विनिर्दिष्ट की जा सकेगी;

21. उक्त आदेश के खंड 29 के पश्चात् निम्नलिखितं खंड अंतःस्थापित किया जाएगा , अर्थातः- "29 ख . संदर्भित विश्लेषण के लिए प्रयोगशालाएं-

(1) खंड 29 के उपखंड ( 1 ) में निर्दिष्ट प्रत्येक प्रयोगशाला और इसकी प्रादेशिक प्रयोगशालाएं उर्वरकों के किसी नमूनों के विश्लेषण के प्रयोजन के लिए संदर्भित प्रयोगशाला के रूप में पदाभिहित की जाएगीः

परन्तु ऐसी कोई प्रयोगशाला जो उर्वरक नमूने का प्रथम विश्लेषण करती है , वह नमूने की बाबत इस प्रकार पदाभिहित नहीं की जाएगी;

परन्तु यह और कि ऐसे किसी नमूने के संबंध में जिसके विश्लेषण को चुनौती दी गई है, उन्हें उन प्रयोगशालाओं में से किसी एक में उनके सिवाय जो राज्य में अवस्थित हैं , या जहां पहले विश्लेषण किया गया है , संदर्भित विश्लेषणों के लिए भेजा जाएगा;

परन्तु यह और भी कि केन्द्रीय उर्वरक क्वालिटी नियंत्रण और प्रशिक्षण संस्थान तथा प्रादेशिक प्रयोगशालाओं को एक समूह समझा जाएगा और उनमें से किसी के द्वारा प्रथम बार विश्लेषित कोई नमूना उस समूह में किसी संदर्भित विश्लेषणों के लिए नहीं भेजा जाएगा । भारत का राजपत्र : साधारण

(2) इस आदेश में किसी बात के होते हुए भी, खंड 32 के उपखंड (1 ) के पैरा (ख) या उपखंड (2) के पैरा (ख) के अधीन यथाविनिर्दिष्ट अपील प्राभिकारी, राज्य सरकार की प्रयोगशाला द्वारा विश्लेषित नमूने की दशा में , या, यथास्थिति, केन्द्रीय उर्वरक क्वालिटी नियंत्रण और प्रशिक्षण संस्थान , फरीदाबाद अथवा इसकी प्रादेशिक उर्वरक नियंत्रण प्रयोगशालाओं की दशा में, नियंत्रक, शेष दो नमूनों में से किसी एक का विनिश्चय करेगा और उपखंड (1 ) में बधाउपबंधित निर्दिष्ट विश्लेषण के लिए भेजेगा । "

22. उक्त आदेश के खंड 30 में-

जाएंगे; (1) उपखंड (2) में "60 दिन" अंकों और शब्द के स्थान, " 30 दिन " अंक और शब्द रखे जाएंगे । (ii) उपखंड (3) में " 30 दिन" अंकों और शब्द के स्थान पर , 15 दिम" अंक और शब्द रखे 23. उक्त आदेश के खंड 31 के स्थान पर , निम्नलिखित खंड रखा जाएगा , अर्थातः-

"31 निलंबन रद्दकरण अथवा वर्जन

(1 ) अधिसूचित प्राधिकरण , रजिस्ट्रीकरण प्राधिकरण , अथवा , जैसी भी स्थिति हो, नियंत्रक , किसी प्राधिकृत व्यौहारी अथवा इस आदेश के अधीन अनुदत्त रजिस्ट्रीकरण प्रमाण - पत्र अथवा विनिर्माण प्रमाण- पत्र अथवा किसी अन्य प्रमाण पत्र धारक को सुनवाई का अवसर दिए जाने के पश्चात ऐसे प्राधिकार पत्र या प्रमाण पत्र को निलंबित कर सकेगा अथवा व्यौहारी को निम्नलिखित एक या अधिक आधारों पर उर्वरक का कारबार करने से वर्जित कर सकेगा , अर्थातः-

(क) यह कि, यथास्थिति, प्राधिकार पत्र या रजिस्ट्रीकरण प्रमाण पत्र या विनिर्माण का प्रमाण पत्र स्वेच्छ्या सारवान तथ्यों को छिपाकर या सुसंगत विशिष्टियों का दुर्व्यपदेशन करके अभिप्राप्त किए गए हैं । (ख) यह कि यथास्थिति इस आदेश के किन्हीं उपबंधों अथवा सूचना ज्ञापन अथवा रजिस्ट्रीकरण प्रमाण- पत्र अथवा विनिर्माण प्रमाणपत्र के किन्हीं निबंधनों और शर्तों का उल्लंघन किया गया है अथवा पूरा नहीं किया गया हैः

परन्तु यह कि उर्वरक का कारबार करने से वर्जित करने अथवा प्रमाण पत्र को निरस्त करते समय उसके व्यौहारी अथवा प्रमाण पत्र धारक को उसके द्वारा धारित उर्वरकों के शेष स्टाक का व्ययन करने के लिए तीस दिन की अवधि अनुज्ञात की जा सकेगी ।

परन्तु यह और कि व्यौहारी के पास उक्त तीस दिनों की अवधि के अवसान के पश्चात रखा हुआ उर्वरकों के स्टॉक का अधिहरण कर लिया जाएगा । 8

[PART II-SBC. 3( (2) जहां किसी व्यक्ति द्वारा किया गया आभिकथित उल्लंघन ऐसा है कि साबित हो जाने पर उसले ऐसे व्यक्ति को उर्वरक का विक्रय करने के कारबार से वर्जित करने अथवा प्राधिकार पत्र अथवा रजिस्ट्रीकरण प्रमाण पत्र अथवा विनिर्माण का प्रमाण पत्र अथवा इस आदेश के अधीन दिए गए किसी अन्य प्रमाण पत्र को रद्द करने को न्यायोचित ठहराया जा सकेगा तो अधिसूचित प्राधिकारी अथवा रजिस्ट्रीकरण प्राधिकारी अथवा जैसी भी स्थिति हो , नियंत्रक बिना कोई सूचना दिए आंतरिक उपाय के रूप में प्रमाण पत्र , प्राधिकरण प्रमाण पत्र को निलंबित कर सकेगा ।

पंरतु यह कि रजिस्ट्रीकरण प्राधिकारी अधिसूचित प्राधिकारी अथवा जैसी भी स्थिति हो नियंत्रक , इस उल्लंघन का ब्यौरा और उसकी प्रकृति के बारे में जानकारी प्रभावित व्यक्ति को तुंरत देगा , जिसके बारे में यह अभिकथित किया गया है कि उस व्यक्ति द्वारा किया गया है और उस व्यक्ति को सुनवाई का अवसर देने के पश्चात निलबंन या वर्जन का आदेश जारी किए जाने की तारीख से पंद्रह दिन के भीतर या तो निलंबन के आदेश को प्रतिसंहृत करने वाला यो प्रमाण पत्र को रद्द करने वाला अंतिम आदेश पारित करेगा ।

पंरतु यह और भी कि जहां ऊपर विनिर्दिष्ट अवधि के भीतर कोई अंतिम ओदश पारित नहीं किया जाता है तो अंतरिम निलयंन आदेश को उस अगली कार्रवाई पर प्रतिकूल प्रभाव डाले बिना प्रतिसंहत समझा जाएगा , जो रजिस्ट्रीकरण प्राधिकारी अधिसूचित प्राधिकारी अभाव यथास्थिति नियंत्रक प्रभावित व्यक्ति के विरूद्ध उप- खंड (1 ) के अधीन कार्रवाई कर सकेगा ।

(3) जहां कहीं कोई प्राधिकार पत्र या प्रमाणपत्र निलंबित किया जाता है, रद्द किया जाता है , या किसी व्यक्ति को उर्वरक का कारबार ' करने से वर्जित किया जाता है तो , यथास्थिति , अधिसूचित प्राधिकारी, रजिस्ट्रीकरण प्राधिकारी या नियंत्रक ऐसे निलंबन , यथास्थिति , रद्दकरण या वर्जन के कारणों के संक्षिप्त कथन अभिलिखित करेंगे और उसकी प्रति उस व्यक्ति को, जिसका प्रमाणपत्र या प्राधिकार पत्र निलंबित या रद्द किया गया है या जिसका कारबार वर्जित किया गया है . प्रस्तुत की जाएगी ।

(4) जहां कहीं ऐसा व्यक्ति जिसने अभिकथित उल्लंघन किया है , कोई औद्योगिक व्यौहारी है तो , अधिसूचित प्राधिकारी ऐसे रजिस्ट्रीकरण प्रमाणपत्र के धारक के विरूद्ध उपखंड ( 1 ) और उपखंड (2) के अधीन कार्रवाई कर सकेगा;

परन्तु यह कि जहां ऐसा प्रमाणपत्र निलंबित या रद्द किया जाता है, अधिसूचित प्राधिकारी ऐसे निलंबन या रद्दकरण आदेश के जारी होने की तारीख से पन्द्रह दिन की अवधि के भीतर उसे उस व्यक्ति को, जिसका प्रमाणपत्र निलंबित किया गया है या रद्द किया गया है , भेजने के अतिरिक्त नियंत्रक को भी उल्लंघन किए जाने की प्रकृति और , यथास्थिति , ऐसे निलंबन या रद्दकरण किए जाने का संक्षिप्त विवरण के बारे में विस्तृत रिपोर्ट प्रस्तुत करेगा;

परन्तु यह और कि नियंत्रक अधिसूचित द्वारा निलंबन आदेश पारित किए जाने की दशा में विस्तृत रिपोर्ट प्राप्त होने पर और उस व्यक्ति को सुनवाई का अवसर दिए जाने के पश्चात अधिसूचित प्राधिकारी से विस्तृत रिपोर्ट प्राप्त होने की तारीख से पन्द्रह दिन की अवधि के भीतर निलंबन आदेश को अभिखंडित करते हुए या रजिस्ट्रीकरण प्रमाणपत्र को रद्द करते हुए , अंतिम आदेश पारित करेगा , जिसके न हो सकने पर अधिसूचित प्राधिकारी द्वारा पारित अंतरिम निलंबन आदेश उपखंड (1 ) के अधीन प्रमाणपत्र धारक के विरूद्ध नियंत्रक द्वारा किए जाने वाली कार्रवाई पर प्रतिकूल प्रभाव डाले बिना अभिखंडित समझा जाएगा , परन्तु यह भी कि अधिसूचित प्राधिकारी द्वारा पारित रद्दकरण आदेश उस समय तक इस प्रकार प्रभावी रहेगा मानो यह नियंत्रक द्वारा पारित किया गया हो , नियंत्रक अधिसूचित प्राधिकारी से विस्तृत रिपोर्ट प्राप्त होने पर और यदि आवश्यक हो, तो व्यक्ति को नए सिरे से सुनवाई का अवसर दिए जाने के पश्चात् रद्दकरण के आदेश को या तो अभिखंडित करते हुए या उसकी पुष्टि करते हुए आदेश पारित करेगा।

24. उक्त आदरा के खंड 32 के स्थान पर निम्नलिखित खंड रखे जाएंगे अर्थातः-

"32. केन्द्रीय सरकार के स्तर पर अपील-

(1 ) ऐसे किसी राज्य में , जहां इस आदेश के अधीन केन्द्रीय सरकार द्वारा उर्वरक या आबंटन किया गया है और यदि विनिर्माता के प्राधिकार पत्र का निलंबन या रद्दकरण और अथवा पुल संबंधी अभिकरण या कारबार का वर्जन किसी रीति में किया गया है और उसका प्रभाव उक्त आबंटन के विस्थापित करता है और केन्द्रीय सरकार कमी यह राय है कि आपूर्ति को बनाए रखने के लिए यह आश्यक और समीचीन है , संबद्ध राज्य सरकार को उल्लंघन की प्रकृति के बारे में विस्तृत रिपोर्ट और ऐसे निलंबन या रद्दकरण के लिए कारणों का संक्षिप्त कथन प्रस्तुत करने के लिए निदेश दे सकेगी तथा यदि वह अग्वश्यक समझे तो, राज्य सरकार के आदेश की पुष्टि करते हुए , उपांतरित या निराकृत करते हुए ऐसा आहे पारित कर सकेगी, जो वह ठीक समझेः

परन्तु यह कि यदि केन्द्रीय सरकार द्वारा मांगी गई रिपोर्ट राज्य सरकार से इस संसूचना के जारी होने की तारीख से पन्द्रह दिन के भीतर प्राप्त नही हुई है तो केन्द्रीयर, रिपोर्ट के बिना मामले का गुणा व गुण के आधार पर विनिश्चय कर सकेगी ।

(2) ऐसा कोई व्यक्ति जो केन्द्रीय उर्वरक क्वालिटी नियंत्रण और प्रशिक्षण संस्थान या उसकी प्रादेशिक प्रयोगशालाओ की विश्लेषण रिपोर्ट से व्यथित है तो वह विश्लेषण रिपोर्ट प्राप्त होने की तारीख से तीस दिन की अवधि के भीतर नियंत्रक को ऐसे नमूने का निर्दिष्ट विश्लेषण के लिए भेजने की अपील कर सकेगा ।

[PART II-SEC. 3 (ii)] 32 क. राज्य सरकार के स्तर पर अपील

(1) राज्य सरकार राजपत्र में अधिसूचित करके अपीली प्राधिकारी के रूप में ऐसे प्राधिकारी को विनिर्दिष्ट करेगी जिसके समक्ष औद्योगिक व्यौहारी को छोड़कर किसी भी व्यक्ति द्वारा जो निम्नलिखित में से किसी आदेश से या रजिस्ट्रीकरण प्राधिकारी या अधिसूचित प्राधिकारी की कार्यवाही द्वारा व्यथित होने पर अपील की जा सकेगी, अर्थात:

(i) उर्वरकों के मिश्रण या उर्वरकों के विशेष मिश्रण तैयार करने के लिए विनिर्माण प्रमाण पत्र देने से मना करना , या.

विनिर्माण प्रमाण पत्र निलम्बित या निरस्त करना , या (ii)

प्राधिकार पत्र निलम्बित या रद्द करना , या उर्वरक की बिक्री के कारबार पर रोक लगाना या (iii)

( iv) अनुबद्ध अवधि के भीतर विनिर्माण प्रमाण पत्र या प्राधिकार पत्र जारी नहीं करना , या

अनुबद्ध अवधि के भीतर प्राधिकार पत्र में संशोधन जारी महीं करना ।

(2) राज्य सरकार द्वारा अधिसूचित उर्वरक परीक्षण प्रयोगशालाओं की विश्लेषण रिपोर्ट से व्यथित कोई भी व्यक्ति विश्लेषण रिपोर्ट की प्राप्ति की तारीख से तीस दिनों के भीतर ऐसे नमूने के संदर्भ विश्लेषण के लिए उप खंड ( i) के अधीन नियुक्त अपील प्राधिकारी के समक्ष अपील कर सकेगा ।"

25 . उक्त आदेश के खंड (33) में--

(1) शीर्षक में " की प्रतियां " शब्दों के पश्चात " प्राधिकार पत्र या विनिर्माता प्रमाण-पत्र" शब्द अंतःस्थापित किए जाएंगे ,

(ii) " यथास्थिति दिया गया " शब्दों के पश्चात " प्राधिकार पत्र" शब्द अंतःस्थापित किए जाएंगे , (iii) "खो जाता है" शब्द के स्थान पर " खो जाता है या अधिसूचित प्राधिकार विरूपित हो जाता है " शब्द रखे जाएंगे ।

26. उक्त आदेश के खंड 34 के स्थान पर निम्नलिखित खंड रखा जाएगा , अर्थात:

"34 प्राधिकार पत्र , विनिर्माण प्रमाण- पत्र और रजिस्ट्रीकरण प्रमाण- पत्र का संशोधन

अधिसूचित प्राधिकारी , रजिस्ट्रीकरण प्राधिकारी या नियंत्रक, जैसी भी स्थिति हो, प्राधिकार पत्र, रजिस्ट्रीकरण प्रमाण-पत्र या विनिर्माण प्रमाण- पत्र के धारक द्वारा खंड 36 के अधीन प्रायोजन के लिए विहित शुल्क के साग आवेदन किये जाने पर ऐसे प्राधिकार पत्र रजिस्ट्रीकरण प्रमाण पत्र या विनिर्माण प्रमाण-पत्र , प्रविष्टि में संशोधन कर सकेगा । " जैसी हो

27. उक्त आदेश के खंड 36 के उप खंड (i ) में ,

( i) "नियंत्रक" के पूर्व " अनुमोदन से" शब्दों का लोप किया जाएगा ,

(ii ) " इस आदेश के अधीन " शब्दों के पश्चात् " प्राधिकार पत्र या शब्द अंतःस्थापित किए जाएंगे । (iii) परन्तुक का लोप किया जाएगा ।

28. जाएगा । उक्त आदेश के खंड 38 के उप खंड (4) में " या पूर्णतया सहयोजित सदस्यो" शब्दों का लोप किया 11

29. उक्त आदेश की अनुसूची । के भाग - क में " उर्वरक का विनिर्दिष्टीकरण " शीर्षक के अधीन

(i) उप शीर्षक " 1 ( घ) एन ०पी० उर्वरक" 1 (ङ) एन ० पी०के० उर्वरक " 1 ( ज) एन० के० उर्वरक" और 1 (ज) , पौटैशियम मैग्नीशियम उर्वरक" में " उर्वरक " शब्द के स्थान पर " मिश्रित उर्वरक " शब्द रखे जाएंगे । ( ii) उप-शीर्षक " 1 (क) अभंजनी से नाइट्रोजन युक्त उर्वरक" " 1 ( ख ) अभंजनी से फास्फेट युक्त उर्वरक " ( क्रम सं० 4 , मद ( vi ) को छोड़कर) , " 1 (ग) अभंजनी पोटाशयुक्त उर्वरक . " 1 (घ) एन०पी०के० उर्वरक" " 1 (ङ) एन० पी० के० उर्वरक, " 1 (च) संश्लेषित उर्वरक " " 1 (छ) एन ०के० उर्वरक " और " 1 (ज) पौटैशियम मैग्नीशियम उर्वरक" के अधीन प्रविष्टियों में " कण के आकार" शब्दों के स्थान पर , जहां कहीं भी वे आते हैं, " कण के आकार के से कम नहीं" शब्द रखे जाएंगे । (iii) उपशीर्षक " 1 (च) सूक्ष्म पोषक तत्व" , के अधीन-

(क) जिंक सल्फेट हेप्टाहाइड्रेट ( जेड एन एस ओ 4.7 एच 2 ओ ) से संबंधित क्रम संख्या-1 में मद सं. (ⅰ ) और इससे संबंधित प्रविष्टि का लोप किया जाएगा;

(ख) मैग्नीशियम सल्फेट से संबंधित क्रम सं. 11 और इससे संबंधित प्रविष्टियों के पश्चात निम्नलिखित क्रम सं . और प्रविष्टियां अंतःस्थापित की जायंगी , अर्थात ;

(V)(क) उप शीर्षक "1 (अ) पी. के. उर्वरक " का लोप किया जाएगा और (ख) मोनोपोटेशियम (0-52-34)( 100% जल में विलेय) से संबंधित क्रम सं . 1 और इससे संबंधित प्रविष्टियों के विद्यमान उप- शीर्षक " 1 (ज) एन.के उर्वरक के अधीन क्रम सं 3 के रूप में पुनः सांख्याकिंत किया जाएगा;

(vi ) (क) उप शीर्षक " 1 (ट) नाइट्रोजन कैल्शियम उर्वरक " का लोप किया जाएगा और (ख) " कैल्शियम नाइट्रेट " से संबंधित क्रम सं . 1 और इससे संबंधित प्रविष्टियों के विद्यमान उपशीर्षका (ज) न.के. उर्वरक के अधीन क्रम सं . 4 के रूप में पुनः सांख्यातित किया जाएगा;

(ग) उप शीर्षक 1 (ज) मैं क्रम सं . 4 के पश्चात और इस प्रकार पुनः सांख्याकित और इससे संबंधित प्रविष्टियों कैं पश्चात् निम्नलिखित क्रम सं. और प्रविष्टियां जोडी जायेंगी, नामतः एन.पी. के . 13:40:13 ( 100 % जल में विलेय)

(i) शीर्षक में " पौध पोषक तत्त्व" शब्दों के पश्चात " और भौतिक पैमाना" शब्ट अंतःस्थापित किए जाएंगे ;

(ii) क्रम संख्या 9 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित क्रम संख्या और प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात:-

31. उक्त आने की अनुसूची 2 में , भामक में उर्वरकों के नमूनों के लेने की प्रक्रिया शीर्षक के अंतर्गत , -

) नमूने लेने की साधारण अपेक्षाओं से संबंधित क्रम संख्या 1 में -

(क) मद (ङ) में " प्रारूप में" शब्द और अक्षर के स्थान पर " प्रारूप त" शब्द और अक्षर रखे जाएंगे ; और

(ख) मद (च) में " उर्वरक की किस्म और ब्रांड/व्यौहारी/विनिर्माता/आयातकर्ता का नाम " शब्दों के स्थान पर " और उर्वरक की किस्म" शब्द रखे जाएंगे ;

(ii ) बोरी में बंद पदार्थ से नमूने लेने से संबंधित क्रम संख्या 2 के अधीन मद ( i ) , में उप मद ( ग) और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित उप मद और प्रविष्टियां रखी जाएंगी , अर्थात्:-

"(4) संग्रहीत तीन नमूनों में से एक नमूना सील लगाकर खंड 29 के अधीन राज्य सरकार द्वारा अधिसूचित प्रयोगशाला के अथवा केन्द्रीय उर्वरक क्वालिटी नियंत्रण और प्रशिक्षण संस्थान , फरीदाबाद अथवा मुम्बई , चेन्नई या कल्याणी ( कोलकाता) स्थित प्रादेशिक उर्वरक नियंत्रण प्रयोगशालाओं के भारसाधक को विश्लेषण के लिए भेजा जाएगा । दूसरा नमूना विनिर्माता अथवा आयातकर्ता अथवा व्यौहारी या क्रेता जैसी भी स्थिति हो , को दिया जाएगा । तीसरा नमूना निरीक्षक द्वारा अपने अगले उच्च प्राधिकारी को सुरक्षित अभिरंक्षा में रखे जाने के लिए भेजा जाएगा । बाद के दोनों नमूनों में से किसी को भी निर्णायक विश्लेषण हेतु भेजा जा सकता है जैसाकि धारा 29 ख की उप- धारा (2 ) के अंतर्गत व्यवस्था की गई है । "

iv) पोतों में , वाहकों और खुले आधानों में खुले उर्वरकों से नमूने लेने से संबंधित क्रम संख्या 7 के अधीन मद (2 ) में , उप-मद आ के स्थान पर निम्नलिखित उप मद रखी जाएगी अर्थात:-

"आ . हैच से नमूना लेना -

खुले उर्वरकों की दशा में , विभिन्न गहराई और विभिन्न स्थलों से माल उत्तास्ने के प्रचालनों के दौरान प्रत्येक हैच से कम से कम 10-15 नमूने लिए जाएंगे यथास्थिति , पोत , वाहकों और खुले आधानों से लिए गए सभी नमूनों को

एक साथ मिश्रित किया जाएगा ताकि इसे हैच का सम्मिश्रित नमूना बनाया जा सके । फिर प्रत्येक हैच सम्मिश्रण के भाग को मिश्रित करके सम्मिश्रण नमूना तैयार किया जाएगा । इसके अलावा परीक्षण नमूना और संदर्भ नमूना अनुसूची 2 , के भाग क के पैरा 6 में उपदर्शित के अनुसार तैयार किए जाएंगे । "

32. उक्त आदेश की अनूसूची 2 में , उर्वरकों के विश्लेषण की पद्धति से संबंधित भाग -ख में , - (i) " प्रयोगशाला में विश्लेषण के लिए नमूना तैयार करना " से संबंधित क्रम संख्या 1 में (क) मद (ख) में 1 मिली मीटर के वृत्ताकार छेदों में से या संख्या 20 मानक छलनी" शब्दों और अंकों के स्थान पर " 1 मिलीमीटर मानक छलनी" शब्द, अंक और अक्षर रखे जाएंगे ;

(ख) मद (ग) में " सं० 40 मानक छलनी" शब्दों और अंकों के स्थान पर "0.425 मिलीमीटर मानक छलनी में से " शब्द अंक और अक्षर रखे जाएंगे ;

(ii) आर्द्रता के अवधारण से संबंधित क्रम संख्या 2 में , -

(क) " आर्द्रता का अवधारण " शीर्षक के स्थान पर " आर्द्रता का अवधारण ओवन शुष्कण पद्धति" शीर्षक रखा जाएगा ;

(ख) उप- शीर्ष " (i ) प्रक्रिया" में, मद (ग) में " 129-131 से०" अंकों और अक्षर के पश्चात् " यूरिया के लिए , 70 सी.+5 सी . पर 5 घंटे तक उष्पित करें" शब्द , अंक और अक्षर तथा चिन्ह अंतःस्थापित किए जाएंगे ;

(ग) उप शीर्ष " (ii ) अमोनियम क्लोराइड में आर्द्रता" के स्थान पर उप- शीर्ष " (ii ) अमोनियम क्लोराइड में आर्द्रता" , " निर्वात शोषित्र पद्धति ( अमोनियम क्लोराइड , सी.ए.एन. , डी.ए.पी. , सभी सम्मिश्रण और एन.पी.के. मिश्रण के लिए लागू) " रखे जाएंगे ।

क्षेत्र- यह पद्धति यूरिया , सी.ए.एन. और यूरिया आधारित सम्मिश्रणों जैसे उर्वरकों के लिए प्रयोज्य है । यह पद्धति फास्फेट एक आधारित उर्वरकों और मोनोकैल्शियम फास्फेट , कैल्शियम सल्फेट , एल्कली कार्बोनेट्स तथा बाइकार्बोनेट्स , एल्डीहाइड्स और केटोनिक समूहों आदि से अंतर्विष्ट उर्वरकों के लिए उपयुक्त नहीं है ।

(क) साधित्र

कार्ल फिशर टाइट्रेटर

(ख) अभिकर्मक

(1 ) कार्ल फिशर अभिकर्मक- कार्ल फिशर घोल ( पाइरिडाईन मुक्त) (एकल घोल)

(2) डाई सोडियम टारटारेट डाइहाइड्रेट ( एन ए2 सी4 ओ6 2 एच2 ओ) -ए.आर. ग्रेड

(3) मिथानोल- के . एफ. गेड/ स्पैकट्रम विज्ञान ग्रेड जिसमें 0.05% से कम पानी हो । (ग) प्रक्रिया

1. के.एफ. अभिकर्मक का मानकीकरण

(i ) उपकरण को लगाएं ।

(ii) ट्राइट्रेशन पात्र में मेथानोल तब तक मिश्रित करें जब तक कि इलैक्ट्राड्स डूब न जाए और कार्ल फिशर अभिकर्मक के साथ एक पूर्व निर्धारित अंतिम बिन्दु तक 30 सैकिंड के लिए टाइट्रेट करें ।

( iii ) डाइसोडियम टारटारेट डाइहाइड्रेट का 100 मिलीग्राम टाइट्रेशन पात्र में सावधानीपूर्वक मिश्रित करें और एक पूर्वनिर्धारित अंतिम बिन्दु ( अंतिम बिन्दु 30 सैकिंड तक रहना चाहिए ) तक कार्ल फिशर अभिकर्मक के साथ टाइट्रेट करें । उपयोग किए गए के .एफ . अभिकर्मक के आयतन को वी 1 एम.एल. के रूप में नोट करें ।

2. नमूने की आर्द्रता का अनधारणः-

(i) तैयार किए गए नमूने के लगभग 1 ग्राम का भार करें और सावधानीपूर्वक इसे टाइट्रेशन बर्तन में अंतरित करें और परिक्षेपित हाने तक विलोडन करें ,

(ii) उसी पूर्वोक्त पूर्व निर्धारित अंतिम बिंदु तक के एफ . अभिकर्मक के साथ टाइट्रेट करें और उपयोग किए गए के.एफ. अभिकर्मक के आयतन को बी2 एम.एल. के रूप में नोट करें । 17

34. उक्त आदेश की अनुसूची 2 में , भाग ख में " 3. नाईट्रोजन का अवधारण " उप- शीर्ष के अधीन ,

(i ) कुल नाइट्रोजन के अवधारण के लिए अभिकर्मक से संबंधित मद (ii ) में उप मद " सावधानी" में " नाइट्रेटों" शब्द के स्थान पर " नाइट्राइल्स " शाब्द रखा जाएगा ;

(ii ) साधित्र से संबंधित मद (iii ) के पैरा (ख ) में डाट लगी , शब्दों के स्थान पर "फिट की गई" शब्द रखे जाऐंगे ;

(III) " कुल नाइट्रोजन ( नाइट्रेट मुक्त नमूनों में ) " से संबंधित मद (iv ) में उप- मद " ( क) प्रक्रिया" और उससे संबंधित प्रविष्टियों के स्थान पर , निम्नलिखित उप मद और प्रविष्टियां रखी जाएंगी अर्थात:-

" ( iv) कुल नाइट्रोजन (नाइट्रेट मुक्त नमूनों में)

(क) प्रक्रिया

(1) 1 ग्राम तैयार नमूना तोलें और जेलडाहल फ्लास्क ( क्षमता 800 मि.ली. ) में रखें ।

(2) 0.7 ग्रा . कापर सल्फेट , 15 ग्रा . के2 ' एस.ओ .4 या एन्हाइड्रस एन ए2 एस.ओ .4 और 50 मि.ली. सान्द्रित एच 2 एस.ओ .4 मिलाएं ।

(3) फ्लास्क को टेकी स्थिति में रखें और झांग आने के रूकने तक हल्का गर्म करें ( यदि जरूरी हो , झाग आना कम करने के लिए पैराफीन की थोड़ी सी मात्रा मिलाएं ) ।

[PART II-SEC. 3 ( )) (4) घोल के साफ होने तक तेजी से उबालें और फिर आगे 30 मिनट के लिए पाचित्रं करना जारी रखें ।

(5 ) बर्नर से हटाएं ठंडा करें , और अंतर्वस्तु को घोलने के लिए 200 मिली लीटर जल मिलाएं और फ्लास्क को टेढ़ा करें ।

(6) पाचित्र फ्लास्क को पानी से कई बार धोते हुए 500 मि.ली. आयतन के फ्लास्क में अन्तरित करें , ठंडा करें और चिन्ह तक आयतन बनाए ।

(7) आसवन फ्लास्क में 25 मी.ली. समभाग लें , 300 मि.ली. पानी और एक चुटकी जस्ता चूर्ण मिलाएं ।

(8) प्रापक शंकवाकार फ्लास्क में 20 मि.ली. मानक एसिड घोल लें । मिथाईल लाल सूचक की 4-5 बूंदे मिलाएं और फ्लास्क को संघनित्र के निचले सिरे पर इस तरीके से रखें कि संघनित्र का निचला छोर पूर्णतया एसिड घोल में डूब जाए ।

(9) आसवन फ्लास्क में 45% एन ए ओ एच को 30 मि.ली. धीरे से मिलाएं ताकि अंतर्वस्तुएं मिश्रित न हों ।

( 10) आसवन फ्लास्क को आसवन संयोजन के साथ तत्काल जोड़े और अन्तर्वस्तु को मिश्रित करने के लिए हिलाएं । सारे अमोनिया के आसवित होने तक गर्म करें ( कम से कम 150 मि.ली. आसवन ) । यदि कोई अमोनिया अभी भी बाहर आ रहा हो तब लाल लिटमस पेपर से परीक्षण करें ।

( 11 ) प्रापक फ्लास्क को हटाएं । निकास नली को मामूली आसवित पानी से प्रापक फ्लास्क में धोएं ।

( 12) अन्तर्वस्तु को प्रापक शंकवाकार फ्लास्क में एन/10 एन.ए.ओ.एच. के साथ टाइट्रेट करें ।

( 13) प्रापक शंकवाकार फ्लास्क में मानक एसिड की उतनी ही मात्रा उपयोग करके अभिकर्मकों पर पूरा -पूरा अवधारण करें । [ भाग II- खण्ड 3 ( ii ) ]

(च) सोडियम हाइड्रोआक्साइड मानक घोल - N/ 10

(छ) क्रोमियम धातु - 100 मैश

(ज) अलूनडम उबलता पत्थर . 8-14 मैश

(झ) कापर सल्फेट पैन्टाहाइड्रेट अभिकर्मक स्तर

(ख) प्रक्रिया:

(1 ) जेलडल फ्लास्क में 1.0 ग्राम नमूना की शुद्धता (अथवा 60 ग्राम नाइट्रेट नाइट्रोजन से अनधिक की मात्रा अंतर्विष्ट) लें । इसमें 1.2 ग्रा . क्रोमियम चूर्ण और 35 मि.ली. जल मिलाएं ।

(2) इसे धीरे- धीरे हिलाते हुए 30 मिनट तक भीगने दें ताकि सभी नाइट्रेट लवण घुल जाएं । इसमें 7 मि.ली. हाइड्रोक्लोरिक ऐसिङ मिलाएं और इसे 30 मिनट तक ऐसे ही छोड़ दें । इसमें 15 ग्राम K2SO4 , 0.7 ग्राम CuSO4 5 H2O और 50 मि.ली.सान्द्र H2SO4 मिलाएं और जैसा पद्यति 3 आइवीए 3 से आगे दिया है उसी प्रकार करें ।

(संदर्भ 2.4.05 , एओएसी 1995) ।".

(vii) ऐमोनिकल नाइट्रोजन (आसवन विधि) के अवधारण से संबंधित मद ( vil ) के स्थान पर निम्नलिखित मद रखी जाएगी , अर्थात्: -

" (vii) अमोनिकल नाइट्रोजन का अवधारण

250 मि.ली. जल में 1 ग्राम तैयार नमूना घोलें । एक लिटर आसवन फ्लास्क में 25 मि.ली. अलीकोट लें और उसमें लगभग 300 मि.ली. जल मिलाएं । एसे उर्वरकों के लिए जिसमें यूरिया नहीं हो 45% NaOH का 10 मि.ली. मिलाएं ।

1 ऐसे उर्वरकों के लिए जिसमें यूरिया है , नवीन इग्नाइटेड कार्बोनेट मुक्त MgO का 2 ग्रास मिलाए ।

(1 ) आवसन फ्लास्क को आसवन तंत्र से तुरंत जोड़ें और तत्वों को मिलाने के लिए हिलाएं । जब तक अमोनिया आसवित नहीं होता अष्मित करें (कम से कम 150 मि.ली. आसवन) । लाल लिटमस पेपर से परीक्षण करें , यदि कोई अमोनिया अभी भी आ रहा है ।

(2) प्रापक फ्लास्क को हटाएं । साफ करने वाली बहिर्गामी ट्यूब को प्रापक फ्लास्क में थोड़े से आसवित जल से धोएं ।

(3) प्रापक शंकवाकार फ्लास्क में अंतर्वस्तु को N / 10 NaOH के साथ टाइट्रेट करें । (4) प्रापक शंक्वाकार फ्लास्क में मानक अम्ल की उसी क्वालिटी का प्रयोग करते हुए अभिकर्मक पर ब्लैंक अवधारण करें ।

( 1 ) कुल नाइट्रोजन से संबंधित क्रम सं . 3 की मद (v) में दिए गए अनुसार ( नाइट्रेटयुक्त नमूनों के लिए ) और कुल नाइट्रोजन ( उच्च C1 : NO3 और केवल किसी जल घुलनीय नाइट्रोजन युक्त सामग्री ) से संबंधित मद ( VI ) में दिए गए के अनुसार कुल नाइट्रोजन का अवधारण करें ।

( 2 ) केलडाल फ्लास्क में 0.5 ग्राम नमूने को तोलें । 50 मि.ली. आसवित जल मिलाएं तथा 2 ग्राम फेरस सल्फेट मिलाएं ; हेप्टाहाइड्रेट करें और धीरे-धीरे हिलाएं , 20 मि.ली. H2SO4 मिलाएं और गर्म ज्वाला पर तब तक पाचित करें जब तक कि सारा जल वाष्पित हो जाए और सफेद धुआं निकलने लगे । 0.7 ग्रा . कॉपर सल्फेट , 15 ग्रा . पोटाशियम सल्फेट और 50 मि.ली. conc . H2SO4 मिलाएं तथा क्रम संख्या 3 में इस भाग की मद ( iv) पैरा (क) 3 के अनुसार आगे कार्यवाही करें ।

(क) " अभिकर्मक" से संबंधित पैरा ( क) में , उप- पैरा (4) का लोप किया जाएगा ।

(ख) " प्रक्रिया" से संबंधित पैरा ( ग) में , -

(1 ) "अ. यूरिया में" अक्षर और शब्दों के स्थान पर , " यूरिया में" शब्द रखे जाएंगे ;

( ii) "आ . मिश्रित उर्वरकों में" शीर्षक पैरा और उसके अधीन पैरा ( 1 ) से (9) का लोप किया जाएगा । 24

35. उक्त आदेश की अनुसूची 2 में , भांग रख में , उप- शीर्ष "4. फास्फेट्स का अवधारण " के नीचे , -

(i ) प्रक्रिया से संबंधित मद (1 ) में , उप- मद ( ख ) में पैरा (ङ) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा अर्थात्: -

टिप्पा: पैरा ( क) सभी एन.पी.के. सम्मिश्रणों , एन.पी. के . मिश्रणों ( जैव उर्वरकों की थोड़ी मात्रा सहित ) को लागू है तथा पैरा ( ख ) रॉक फास्फेट के लिए लागू है । " ;

( II) मद ( ii ) में , -

(क) अभिकर्मकों से संबंधित उप - मद ( क) में , पैरा ( 3 ) में " 28 मि.ली." अंकों और अक्षरों के स्थान पर " 280 मि.ली." अंक और अक्षर रखे जाएगें ;

(ख) प्रक्रिया से संबंधित उप- मद ( ख ) में , पैरा (2 ) में " कांच तन्तु निस्पंदक पेपर " शब्दों के पश्चात् , या सिन्टारित कांच गूच क्रूसीबल ग्रेड 4 ( 30 मि.ली. क्षमता ) " शब्द शामिल किए जाएगें ;

(ख) प्रक्रिया:

1. तैयार किए गए नमूने का लगभग 2.5 ग्रा. सही तोलें और 250 मि.ली. की एर्लेन्मेयर फ्लास्क मेंडालें ।

2. 100 मि.ली. न्यूट्राल एसिटोन मिलाएं । रिस्ट एक्शन शेकर में जमाएं । एक घंटे तक हिलाएं । 3. व्हाटमैन फिल्टर पेपर नं. । द्वारा तेजी से एसिटोने के 10 मि.ली. के हिस्से से चार बार धुली हुई 250 मि.ली. की एर्लेन्मेयर फ्लास्क में छान लें ।

4. जहां तक संभव हो एसिटोन को वाष्पित करें ।

5. लगभग 50 मि.ली. जल और ब्रोमोक्रिसोल ग्रीन इन्डिकेटर की बूदें मिलाएं ।

6. मानक NaOH विलयन के साथ अनुमापन करें , जब तक रंग पीले से नीले में परिवर्तित नहीं हो जाता ।

37. उक्त आदेश की अनुसूची 2 में, भाग ख में , उप- शीर्षक " 7 जिंक सल्फेट ( हेप्टाहाइड्रेट तथा मोनोहाइड्रेट दोनों) के विश्लेषण की विधि" के नीचे , मद ( iii) में , उप-मद (ख) , में

38. उक्त आवेश की अनुसूची 2 में , भाग ख में , उप- शीर्षक " 8. जिंक सल्फेट ( हेप्टाहाइट्रेट और मोनोहाइड्रेट दोनों) के विश्लेषण की अनुकाल्पिक पद्धति" के नीचे , निम्नलिखित पैरा रखा जाएगा , अर्थात्: -

* ( 1 ) मानक जस्ता विलयन एक बीकर में ठीक- ठीक 1,0 ग्राम जस्ता धातु (ए.आर. ) को तोलें । 20 मि.ली. एचसीएल (1 : 1 ) मिलाएं । कुछ घंटों के लिए रखें और इसे पूर्णतया घुलने वें । एक लीटर आयतनी फ्लास्क में इस घोल को अन्तरित करें । ग्लास के आसवित जल से आयतन बना लें । यह 1000 पीपीएम जिंक घोल , ( जिसे इसमें इसके पश्चात् मानक क कहा गया है) है । इस घोल को आगे प्रयोग करने के लिए एक साफ बोतल में भर कर रखें । मानक ख के रूप में आयहित 10 पीपीएम मानक जिंक विलयन प्राप्त करने के लिए 100 मि.ली. में 1मि.ली. मानक क मिलाएं ।" ;

(ख) उप-मव (ख) में , पैरा ( 1 ) में " अच्छी तरह हिलाकर पदार्थ को घोल लें" शब्दों के पश्चात् ' 1 मि.ली. सान्द्रित H2S04 मिलाएं" शब्द , अंक और अक्षर अंतःस्थापित किए जाएंगे ;

(III) मद (III) में , उप-मद (ख ) में , " ( चरण ए 2.2.1 ) " शब्द , कोष्ठक अक्षर और अंको के स्थान पर " [ चरण 8 ( II) (ख) ( 1 ) ] " शब्द कोष्ठक , अक्षर और संख्या अंक रखे जाएंगे ;

(2) 100 मि०ली० के आयतनमापीय फ्लास्क में तैयार किया हुआ 1 मी०लि० घोल लें , उसमें 20 मि० ली० लेन्थनम घोल अथवा 10 मि०ली० स्ट्रॉनटियम क्लोराईड घोल मिलायें और मात्रा तैयार करें । जरूरत पड़ने पर छान ले"

44. उक्त आदेश के अनुसूची-2 के भाग ख में उप- शीर्षक " 21. कैल्सियम नाईट्रेट का अवधारण " और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित उप- शीर्षक और प्रविष्टियां अंतःस्थापित की जायेंगी , अर्थातः-

" 22. परमाणविक अवशोषण स्पेक्ट्रोफोटोमिट्रिक पद्धति द्वारा सूक्ष्म पोषक तत्वों वाले उर्वरक मिश्रणों का विश्लेषण ।"

(क) अभिकर्मकः

(1 ) अम्लीय जलः 10 लीटर दो गुणा आसुत जल में 10 मि ०ली० का 10% सल्फ्यूरिक अम्ल घोलें और H2SO4 या NaOH का उपयोग करते हुए PH मीटर की सहायता से 2.5 (+0.5) तक PH को समायोजित करें ।

(2) स्ट्रॉनटियम क्लोराईड का घोलः एक लीटर आसुत जल में 7.5 ग्राम स्ट्रॉन टियम 'क्लोराईड (SrCl2.6H2O) घोलें ।

(3) पोटाशियम सल्फेट का घोलः 1 लीटर आसुत जल में 25 ग्राम AR पोटाशियम सल्फेट घोलें ।

(ख) प्रक्रियाः

(i) मानक स्टाक घोल तैयार करना:

उपयुक्त विलायक की मदद से विनिर्दिष्ट तत्व के लिए मानक सामग्री की विशिष्ट मात्रा मिलायें , जैसा कि नीचे उपदर्शित है तथा आसुत जल के साथ 1000 मि०ली० की मात्रा तैयार करें । इसके साथ ही फेरस , कॉपर , मैंगनीज तथा जिंक के मामले में अम्लीकृत जल के साथ उपयुक्त ज्वलन रेंज तक इसे तनुकृत करें । मैग्नीशियम के मामले में 20 मि०ली० , स्ट्रॉनटियम क्लोराईड मिलायें और मोलीबेडनम के मामले में अम्लीकृत जल के साथ 100 मि०ली० आयतनमापी फ्लास्क में उपयुक्त मात्रा तैयार करने के पहले 20 मि०ली० पोटाशियम मिलायें । 32

(ii) नमूना घोल तैयार करनाः

1 ग्राम पोषक तत्व वाले उर्वरक का मिश्रण ( ठोस या द्रव) लें । उसे अम्लीकृत जल की मदद से 100 मि०ली० आयतनीय फ्लास्क में स्थानांतरित करें तथा चिन्ह तक मात्रा तैयार करें , अच्छी तरह हिलायें और कम से कम 4-6 घंटे तक छोड़ दें । फेरस , कॉपर , मैंगनीज और जिंक के मामले में अम्लीकृत जल के साथ उपयुक्त मानक कार्य करण रेंज तक इसे आगे और तनुकृत करें । मैंगनीज के मामले में 20 मि०ली० स्ट्रॉनाटियम क्लोराईड मिलायें और मोलीबेडिनम के मामले में अम्लीकृत जल के साथ 100 मि ०ली० आयतनीय फ्लास्क में उपयुक्त मात्रा तैयार करने से पहले 20 मि०ली० पोटाशियम सल्फेट मिलायें ।

(iii ) घोल का ज्वलनः

सांद्रण पद्धति पर विशिष्ट तत्व के मानक घोल का ज्वलन करें । तत्पश्चात विनिर्दिष्ट तत्व के सान्द्रण ( पी.पी.एम. में) को देखने के लिए नमूना घोल को प्रदीप्त करें । [भाग -खण्ड 3 (ii) ]

(2) 2 मि०ली० बीकर में 25 ग्राम सांद्रित नाईट्रिक अम्ल मिलायें । हल्का गर्म करें और 100 मि०ली० को जल के साथ तनु करें ।

(3) घोल को गर्म करें ( किंतु उबालें नहीं) ।

(5) इसे ठंडा करे और इसे 250 मि०ली० आयतनीय फ्लास्क में डालें और आसुत जल के साथ चिन्ह तक तनुकृत करें ।

(6) अवक्षेपण को बैठने के लिए छोड़ दें तथा आसुत जल के साथ चिन्ह तक इसे तनु करें । (7) बीकर में पहले कुछ बूंदों को छोड़ते हुए , शुष्क फिल्टर (सं०-40) पेपर से इसे छानिये । (8) 250 मि०ली० के बीकर में 100 मि०ली० फिल्ट्रेट को पीपेट के जरिये डालिये और कुछ बूंदे उपदर्शक घोल का मिलाये ।

(9) पूरी तरह चलाते हुए 10% एन.ए.ओ.एच. घोल की कुछ बूंदें मिलायें , जब तक उपदर्शक पूरी तरह नीला न हो जाय ।

) 250 मि०ली० के बीकर में शुष्क फिल्टर पेपर ( सं०40) से छानें और ठंडे जल के साथ कई बार अपशिष्ट को सावधानीपूर्वक धोयें । कुल मात्रा 150 से 200 मि०ली० होनी चाहिये । ( 11 ) तनुकृत एच.एन.ओ.3 मिलाकर पी.एच. को लगभग 5 तक समायोजित करें । 90से ० तक गर्म करें ( उबाले नहीं) , सी.ओ.2 हटाने के लिए 'अच्छी तरह हिलायें । घोल को ठंडा करें । (

12) पी.एच. मीटर के इलेक्ट्रोड्स को घोल में रखें और एन.ए.ओ.एच. घोल का प्रयोग करते हुए , ठीक 6.3 तक पी.एच. समायोजित करें ।

(13) 10 ग्राम मैनीटोल मिलायें और फिर एन.ए.ओ.एच. घोल के साथ पी.एच. को टीक 6.3 तक समायोजित करें ।

(14) 10 ग्राम भाग में मैनीटोल को मिलाना जारी रखें , जब तक कि पी.एच. 6.3 पर स्थिर न हो जाय । मैनीटोल को प्रथम बार मिलाने के लिए प्रयुक्त 0.02 एन. एन.ए.ओ.एच. की मात्रा को ध्यान में रखें (चरण 13)

(15) उर्वरक मिश्रण पर ब्लैंक निर्धारण जारी रखें , जिसमें बोरोट नहीं मिलाया गया है । (ग) संगणनाः

ORDER

New Delhi , the 16th January, 2003

S.O.49(E ). In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955) , the Central Government hereby makes the following Order further to amend the Fertiliser (Control ) Order, 1985, namely: -

1. (1 ) This Order may be called the Fertiliser (Control) Amendment Order, 2003.

(2) It shall come into force on the date of its publication in the Official Gazette .

2. In the Fertiliser (Control) Order, 1985 (hereinafter referred to as the said Order) , in clause 2,

(i) after sub clause (n) , the following sub-clause shall be inserted, namely: -

'( nn) " Notified Authority " means an authority appointed under clause 26 A. ' ;

(ii) in sub - clause (s) , after the word and figures "clause 26" , the words " in respect ofmixture of fertilizers and special mixture of fertilizers " shall be inserted.

3. For chapter heading " IV . REGISTRATION OF DEALERS " of the said Order , the chapter heading " IV . AUTHORISATION OR REGISTRATION OF DEALERS " shall be substituted .

4. For clause 7 of the said Order , the following clause shall be substituted, namely: -

" 7. Registration of Industrial dealers and authorisation of other dealers No person shall sell , offer for sale or carry on the business of selling of fertilizer at any place as wholesale dealer or retail dealer except under and in accordance with clause 8:

bynotification in the Official Gazette, exempt from the provisions ofthis clause any person selling fertilizer to farmers in such areas and subject to such conditions as may be specified in that notification . '

5. Forclause 8 of the said Order , the following clauses shall be substituted, namely: "8. Application for intimation or registration

(1 ) Every person intending to sell or offer for sale or carrying on the business of selling of fertilizer as Industrial .Dealer shall obtain a certificate of registration from the controller by making an application in Form A together with the fee prescribed under clause 36 and a Certificate of source in Form O

(2) Every person including a manufacturer, an importer, a pool handling agency, wholesaler and a retail dealer intending to sell or offer for sale or carrying on the business of selling of fertilizer shall make a Memorandum of Intimation to the Notified Authority, in Form Al duly filled in, in duplicate, together with the fee prescribed under clause 36 and certificate of source in Form O.

(3) On receipt of a Memorandum of Intimation, complete in all respects , the Notified Authority shall issue an acknowledgement of receipt in Form A2 and it shall be deemed to be an authorisation letter granted and the concerned person as authorised dealer for the purposes of this Order :

Provided that a certificate of registration granted before the commencement of the Fertiliser (Control ) Amendment Order, 2003 , shall be deemed to be an authorization letter granted under the provisions of this Order:

Provided further that where the applicant is a State Government , a manufacturer or an importer or a pool -handling agency , it shall not be necessary for it or him to submit Form 0:

Provided also that a separate Memorandum of Intimation shall be submitted by an applicant for whole sale business or retail dealership , as the case may be:

Provided also that where fertilizers are obtained for sale from different sources, a certificate of source from each such source shall be furnished in Form O." .

6. In clause 9 of the said Order , -

(i) in the opening portion, the words "registering authority or as the case may be the" shall be omitted;

(ii) in the proviso, in clause (f) , for the words " a valid certificate of registration " , the words " an authorisation letter " shall be substituted.

7. For clause 10 of the said Order , the following clause shall be substituted , namely: - " 10. Period of validity of certificate of registration and letter of authorization.

[PART II-SEC. 3 (億)】 Every certificate of registration granted under clause 9 and every authorization letter issued under clause 8 shall , unless renewed, suspended or cancelled, be valid for a period of three years from the date of its issue. "

8. Forclause 11 of the said Order , the following clause shall be substituted, namely: - "11. Renewal of certificates of registration and asthorization letters

(1 ) Every holder of a certificate of registration granted under clause 9 or authorization letter granted or deemed to have been granted under clause 8, desiring to renew such certificate or authorization letter shall , before the date of expiry of such certificate of registration or authorization letter, as the case may be , make an application for renewal to the Controller, in Form C, or to the Notified Authority in Form Al , respectively, in duplicate, together with the fee prescribed under clause 36 for such renewal and a certificate of source as required under clause 8.

(2) On receipt of an application under sub-clause ( 1 ) , together with such fee and certificate of source, the controller may renew the certificate of registration or the Notified Authority , as the case maybe shall issue acknowledgement receipt of renewal in form A 2 :

Provided that a certificate of registration shall not be renewed if the holder of the same did not sell any fertiliser during the period of one year immediately preceding the date of expiry of the period of validity.

(3 ) If any application for renewal is not made before the expiry of the period of validity of the certificate of registration or, as the case may be, the authorization letter but is made within one month from the date of such expiry , the certificate of registration or, as the case may be, the authorization letter shall be dealt as provided in sub-clause (2) on payment of such additional fee as may be prescribed under clause 36 in addition to the fee for renewal.

(4) Where the application for renewal of certificate of registration is made within the time specified in sub- clause ( 1 ) or sub-clause (3) , the applicant shall be deemed to have held a valid certificate of registration until such date as the controller passes orders on the application for renewal .

(5) If an application for renewal of a certificate of registration or authorisation letter is not made within one month from the date of expiry of their period of validity ,the same shall be deemed to have lapsed on the date on which its validity expired and any business carried on after that date shall be deemed to have been carried on in contravention of clause 7. ".

9. In clause 13 of the said Order, sub -clause (3 ) shall be omitted.

10. Inclause 15 of the said Order , -

(i) for sub -clause ( 1 ) , the following sub -clause shall be substituted, namely:-

"( 1 ) On receipt of an application under clause 14, the registering authority shall , by order inwriting, either grant or refuse to grant the certificate of manufacture in respect of any mixture of fertilizer or special mixture of fertilizer and shall, within forty- five days from the date of receipt of the application, furnish to the applicant a copy of the order so passed." ;

(ii) insub-clause (2) , -

(a) for the words "the registering authority shall grant " , the words, "the registering authority shall, within forty - five days from the date of receipt of the application , grant " shall be substituted;

(b) for the words "such authority shall grant " , the words " such authority shall , within forty- five days from the date of receipt of the application, grant " shall be substituted.

11. In clause 16 of the said Order, in sub -clause (2 ), -

(i) for the words " three months " , the words " six months " , shall be substituted;

( ii) in the proviso , for the words " six months " , the words , " twelve months " shall be substituted.

12 . In clause 18 of the said Order , in sub-clauses (2) , (3 ) and (4) , for the words " certificate of registration" wherever they occur , the words " certificate of manufacture " shall be substituted.

13. In clause 19 of the said Order , in item (c) , in sub - item ( ii) , for the words " imitation or" , the words " imitation of or " shall be substituted.

14. After clause 20 of the said Order , the following clause shall be inserted , namely:-

" 20 A. Specification in respect of provisional fertilizer

Notwithstanding anything contained in this Order, the Central Government may, by order published in the Official Gazette, notify specifications , valid for a period not exceeding three years, in respect of fertilizers to be manufactured by any manufacturing unit for conducting commercial trials ." .

15. In clause 21 of the said Order, -

(i) for paragraph (a), the following paragraph shall be substituted, namely: -

"(a) Every container in which any fertiliser is packed shall conspicuously be superscribed with the word "FERTILISER" and shall bear only such particulars and unless otherwise required under any law nothing else, as may from time to time, be specified by the Controller in this behalf; and";

(ii) after paragraph (b ) , the following paragraph shall be inserted , namely : -

"(c) Every fertiliser bag in which any fertiliser is packed for sale shall be of such weight and size as may be specified by the Central Government from time to time in this behalf. " .

16. In clause 23 of the said Order , - [PART II-SEC . 3 (ii)]

(i) in sub -clause ( 1 ) , -

(a) for the words " any fertiliser ", the words " any fertiliser except any fertiliser imported by the Central Government ," shall be inserted;

(b) for the words " registering authority " , the words " Notified Authoriy " shall be substituted ;

(ii) in sub -clause (2) for the words " registering authority", the words " Notified Authority " shall be substituted ;

(iii) after sub - clause (3 ) , the following sub - clause shall be inserted , namely: -

"(4) Where any fertiliser imported by the Central Government is found to be of non- standard and the Central Government decides that the fertilizer cannot be permitted for direct use in agriculture , it may permit the use of such fertiliser by manufacturers of complex fertilisers , mixture of fertilisers or special mixture of fertilisers to be sold at such price as may be fixed by the Central Government . "

17.

In clause 26 of the said Order , the words , " excepting for grant or renewal of certificate of registration for Industrial dealers . " shall be omitted.

18. After clause 26 of the said Order , the following clause shall be inserted , namely: - "26A. Notified Authority- The State Government may , by notification in the Official Gazette , appoint such number of persons , as it thinks necessary , to be Notified Authorities for the purpose of this Order and define the local limits within which each such Notified Authority shall exercise his jurisdiction." . :

19 . In clause: 28 of the said Order , in sub- clause ( 1 ) , in paragraph (d) , for the words " about to be committed, " the words " attempted to be committed " shall be substituted.

20 (i) The existing clause 29 of the said Order shall be re - numbered as sub - clause ( 1 ) thereof;

(ii ) in sub- clause ( 1 ) as so renumbered , the words " with the prior approval of the Central Government" shall be added at the end ;

( iii ) after sub - clause ( 1 ) as so re - numbered , the following sub - clause shall be inserted narnely:-

"(2) Every laboratory referred to in sub - clause ( 1 ) shall , in order to ensure accurate analysis , of fertiliser samples , possess minimum equipment and other laboratory facilities, as may be specified from time to time by the Controller in this behalf . " .

21. After clause 29 A of the said Order , the following clause shall be inserted , namely : - "29 B. Laboratories for referee analysis

(1) Every laboratory referred to in sub - clause ( 1 ) of clause 29 shall be designated as referee laboratory for the purpose of analysis of any sample of fertiliser :

Provided that no such laboratory which carried out the first analysis of the fertiliser sample shall be so designated in respect of that sample:

Provided further that in respect of any sample the analysis of which has been challenged, may be sent for referee analysis to any one of the other laboratories except those which are located in the State or where the first analysis has been done.

Provided also that the Central Fertiliser Quality Control and Training Institute and Regional laboratories shall be considered as one group of laboratories and a sample first analysed by any one of them, shall not be sent for referee analysis to any other in that group , but only to any other laboratory notified by a State Government.

(2) Notwithstanding anything contained in this Order , the Appellate Authority as specified under paragraph (b ) of sub-clause ( 1 ) or paragraph (b ) of sub-clause (2) of clause 32, in case of sample analysed by the State Government laboratory, or the Controller , in case of samples analysed by Central Fertiliser Quality Control and Training Institute, Faridabad or its Regional Fertiliser Control Laboratories , as the case may be , shall decide and send, one of the two remaining samples , for reference analysis as provided under sub - clause ( 1 ) . " .

22 . In clause 30 of the said Order , -

(i) in sub- clause (2) , for the figures and word " 60 days " , the figures and word " 30 days " shall be substituted ;

(ii) in sub - clause- ( 3 ) , for the figures and word " 30 days " the figures and word " 15 days " shall be substituted.

23 . For clause 31 of the said Order , the following clause shall be substituted, namely: -

"31 Suspension , Cancellation Or Debarment

(1) A Notified Authority , registering authority , or as the case may be, the controller may , after giving the authorized dealer or the holder of certificate of registration or certificate ofmanufacture or any other certificate granted under this Order, an opportunity of being heard, suspend such authorization letter or certificate or debar the dealer from carrying on the business of fertilizer on one or more of the following grounds , namely : -

( a)

that the authorization letter or certificate of registration or certificate of manufacture , as the case may be, has been obtained by wilful suppression of material facts or by misrepresentation of relevant particulars:

(b) thatany of the provisions of this Order or any terms and condition of the Memorandum of Intimation or certificate of registration or the certificate of manufacture , as the case may be , has been contravened or not fulfilled:

Provided that while debarring from carrying on the business of fertiliser or canceling the certificate, the dealer or the certificate holder thereof may be allowed for a period of thirty days to dispose of the balance stock of fertilizers, if any, held by him:

[PART II-SEC. 3(ii) Provided further that the stock of fertilizer lying with the dealer after the expiry of the said period of thirty days shall be confiscated.

(2) Where the contravention alleged to have been committed by a person is such as would, on being proved, justify his debarment from carrying on the business of selling of fertilizer or , cancellation of authorization letter or certificate of registration or certificate of manufacture or any other certificate granted under this Order to such person the Notified Authority or registering authority or, as the case may be , the controller may, without any notice , suspend such certificate , authorization letter , as an interim measure:

Provided that the registering authority, Notified Authority or, as the case may be , the controller shall immediately furnish to the affected person details and the nature of contravention alleged to have been committed by such person and, after giving him an opportunity of being heard, pass final orders either revoking the order of suspension or debarment within fifteen days from the date of issue of the order of suspension:

Provided further that where no final order is passed within the period as specified above , the order of interim suspension shall be deemed to have been revoked without prejudice, however, to any further action which the registering authority, Notified Authority or, as the case may be , the controller may take against the affected person under sub-clause ( 1 )

(3) Wherever an authorization letter or certificate is suspended, cancelled or the person is debarred from carrying on the business of fertiliser , the Notified Authority, registering authority, or as the case may be , the Controller shall record a brief statement of the reasons for such suspension or, as the case may be, cancellation or debarment and furnish a copy thereof to the person whose certificate or authorization letter has been suspended or cancelled or business has been debarred .

(4) Wherever the person alleged to have committed the contravention is an industrial dealer, the Notified Authority may take action against the holder of such certificate of registration under sub - clause ( 1 ) and sub -clause (2) :

Provided that where such certificate is suspended or cancelled, the Notified Authority shall , within a period of fifteen days from the date of issue of such order of suspension or cancellation, furnish to the controller also , besides sending the same to the person whose certificate has been suspended or cancelled, a detailed report about the nature of contravention committed and a brief statement of the reasons for such suspension or, as the case may be , cancellation:

Provided further that the controller , shall , in case of the order for suspension passed by the Notified Authority, on receipt of the detailed report and after giving the person an opportunity of being heard , pass final order either revoking the order of suspension or cancelling the certificate of registration, within fifteen days from the date of receipt of the detailed report from the Notified Authority , failing which the order of interim suspension passed by the Notified Authority shall be deemed to have been revoked , without prejudice however, to further action which the controller may take against the holder of certificate under sub -clause ( 1 ) :

Provided also that the order of cancellation passed by the Notified Authority shall remain effective as if it had been passed by the controller till such time the Controller, on receipt of the detailed report from the Notified Authority , and if deemed necessary , after giving the person a fresh opportunity of being heard, pass the final order either revoking or confirming the order of cancellation ." .

For clause 32 ofthe said Order, the following clauses shall be substituted, namely: -

"32. Appeals at Central Government level

( 1) In any State , where the fertiliser allocation is made by the Central Government under this Order and ifthe suspension or cancellation of authorisation letter of the manufacturer and or pool handling agency or debarment of business , in any way, has an effect of dislocating the said allocation and if the Central Government is of the opinion that it is necessary or expedient so to do for maintaining the supplies , may direct the concerned StateGovernment to furnish detailed report about the nature of contravention and a brief statement of the reasons for such suspension or cancellation and pass such order as it may think fit, confirming , modifying or annulling the order of State Government :

Provided that if the report called by the Central Government is not received from the State Government within a period of fifteen days from the date of issue of the communication , the Central Government may decide the case without the report , on merit .

(2) Any person aggrieved by the analysis report of Central Fertiliser Quality Control and Training Institute or its regional laboratories may appeal to the Controller for referee analysis of such sample within a period of 30 days from the receipt of analysis report .

32A. Appeal at the State Government level

(1) The State Government shall ,by notification in the Official Gazette , specify such authority as theAppellate authority before whom the appeals may be filed by any person, except by an industrial dealer , aggrieved by any of the following Orders or action of registering authority or a Notified Authority, namely: -

(i) refusing to grant a certificate of manufacture for preparation of mixture of fertilisers or special mixture of fertilizers; or

suspending or canceling a certificate of manufacture; or

(ii)

(iii) suspending or canceling authorization letter or debarring from carrying on the business of selling of fertilizer, or

(iv) non- issuance ofAuthorisation letter or certificate of manufacture within the stipulated period; or

non- issuance of amendment in authorisation letter within the stipulated period .

2) Any person aggrieved by analysis report of fertilizer Testing laboratories notified by the State Government may appeal to the appellate authority appointed under sub - clause( 1 ) for reference analysis of such sample within thirty days from the date ofreceipt of analysis report ." .

25. In clause 33 of the said Order , -

(i) in the heading, after the words " copies of " , the words " authorisation letter or certificate of manufacture " shall be inserted;

after the word " where " , the words " an authorization letter or " shall be inserted;

(ii)

(iii) for the word " lost " , the words " lost or defaced , the Notified Authority " shall be substituted .

26. For clause 34 of the said Order , the following clause shall be substituted, namely: - "34 Amendment of authorisation letter , certificate of manufacture and certificate of Registration

The Notified Authority, registering authority or controller, as the case may be , may, on application being made by the holder of an authorization letter , a certificate of registration or certificate of manufacture , together with the fee prescribed for the purpose under clause 36, amend an entry in such authorization letter, certificate of Registration or certificate of manufacture , as the case may be.".

27. In clause 36 of the said Order , in sub - clause ( 1 ) , -

(i) the words "with prior approval from the Controller" shall be omitted;

after the words " amendment or renewal of" , the words " an authorization letter or " shall be inserted; (ii)

(iii) The proviso shall be omitted.

28. In clause 38 of the said Order , in sub - clause (4) , the words " or wholly of co- opted members " shall be omitted .

(iv) under serial number 7 relating to Sampling from bulk fertiliser in ships , bulk carrier and bulk containers , in item ( ii ) , for sub- item B , the following sub - item shall be substituted , namely: -

"B. Sampling from hatch -

In case of bulk fertilisers , from each hatch at least 10-15 samples shall be drawn from different-depth and different points during unloading operations . All the samples drawn from each hatch of the ship , bulk carrier or bulk containers , as the case may be, to be mixed together to make hatch composite sample . Then the composite sample shall be prepared by mixing part of each hatch composite . Further test sample and reference sample shall be prepared as indicated in paragraph 6 of Schedule II , Part -A " .

32. In Schedule II of the said Order, in Part -B relating to Methods of Analysis of Fertilizers , - (i) in serial number 1 relating to " Preparation of samples for analysis in the laboratory " , - ( a) in item (b), for the words , figures and letters "sieve with 1mm circular opening or No. 20 standard sieve " , the words , figures and letters " sieve with 1 mm IS sieve" shall be substituted;

(b) in item (c) , for the figures and words "No. 40 standard sieve " , the words , figures and letters " through 0.425 mm IS sieve " shall be substituted;

(ii) in serial number 2 , relating to determination of moisture, -

1. Standardization of KF reagent :

(i) Set up the instrument.

(ii) Add methanol to the titration vessel until the electrodes are dipped and titrate with Karl Fisher reagent to a pre set end point persists for 30 seconds .

(iii) Add 100mg. of the disodium tartarate dihydrate to the titration vessel carefully and titrate with Karl Fisher reagent to a pre - set end point (the end point should persist for 30 seconds) . Note the volume of KF reagent used as V₁ml .

2.Determination ofmoisture ofsample: -

(i) Weigh accurately about 1 gm of the prepared sample and transfer to titration vessel carefully and stir until dispersed.

(ii) Titrate with KF reagent to the same pre - set end point as above and note the volume of KF reagent used as V2 ml.

[PART I-SEC. 3 (ii)] (i) in item (ii ) relating to reagents for determination of total nitrogen, in sub- item " Caution " , for the word "Nitrites" , the word " Nitriles " shall be substituted;

(ii) in item ( iii) relating to apparatus, in paragraph (b) , for the word " filled", the word "fitted" shall be substituted;

(iii) in item ( iv) relating to "Total nitrogen (in nitrate free samples) ", for sub- item "(a) Procedire" and the entries relating thereto , the following sub- item and entries shall be inserted, namely: - "(iv) Total Nitrogen ( in nitratefree samples)

(a) Procedure

(1) Weight 1 gm prepared sample and place in the kjeldahl flask (capacity 800 ml) .

(2) Add 0.7 g copper sulphate , 15 g K₂SO₄ or anhydrous Na2SO4 and 50 ml conc . H2SO4.

(3) Place flask in inclined position and heat gently until frothing ceases. ( If necessary , add small amount of paraffin to reduce frothing).

(4) Boil briskly until solution clear and then continue digestion for 30 minutes more .

(5) Remove from burner and cool , add 200 ml of water and swirl the flask to dissolve the contents .

(6) Transfer to 500 ml volumetric flask giving several washing with water to the digestion flask, cool and make up the volume to the mark.

(7) Take 25 ml aliquot in the distillation flask, add 300 ml of water and a pinch of zinc dust.

(8) Take 20 ml of standard acid solution in the receiving conical flask. Add 4-5 drops of methyl red indicator and keep the flask at the lower end of condenser in ; such a way that the lower tip of the condenser is fully immersed in acid solution .

(9) Add 30 ml of 45% NaOH to the distilling flask gently so that the contents don't mix.

(10) Immediately connect the distillation flask to the distillation assembly and swirl to mix the contents . Heat until all ammonia is distilled ( at least 150 ml distillate) . Test with red litmus paper , if any ammonia is still coming out .

(11 ) Remove receiving flask. Rinse outlet tube in to receiving flask with a small amount ofdistilled water .

(12) Titrate the contents in the receiver conical flask with N/ 10 NaOH.

(13) Determine blank on reagents using same quality of standard acid in receiver conical flask.

(1 ) Take accurately 1.0g sample (or quantity containing not more than 60 gm nitrate nitrogen) in Kjeldahl flask. Add 1.2 g Chromium powder and 35 ml water.

(2) Let it stand for 30 minutes with occasional gentle swirling to dissolve all nitrate salts . Add 7 ml . Hydrochloric acid and let it stand for 30 minutes . Add 15 g K2SO4 , 0.7g CuSO4, 5 H2O and 50 ml conc ..H₂SO₄ and proceed as given in method 3 iv a. 3 onward.

"(vii).Determination ofammoniacal nitrogen

Dissolve i gram prepared sample in 250 ml water. Take 25 ml allquot in I litre distiilation flask, add approximately 300 ml of water . Add 10 ml of 45 % NaOH for fertilizers which do not contain urea

Add 2 grams of freshly ignited carbonate free MgO for fertilizers containing urea .

(1 ) Immediately connect the distillation flask to the distillation assembly and swirl to mix the contents . Heat until all ammonia is distilled (at least 150 ml distillate ). Test with red litmus paper, if any ammonia is still coming out .

(2) Remove receiving flask. Rinse outlet tube in to receiving flask with a smail amount ofdistilled water.

(3)Titrate the contents in the recelver conical flask with N/10 NaOH .

(4) Determine blank on reagents using same quality of standard acid in receiver conical flask.

Weigh 1 gm micronutrient fertilizer mixture (Solid or liquid) transfer to 100 ml volumetric flask with the help of acidified water and make up the volume up to the mark. Shake well and keep it stand for at least 4-6 ; hours. Dilute it further to suitable standard working range with acidified water in case of Fe , Cu Mn and Zn . (2) Bismuth Nitrate Solution : Dissolve 22 gm of Bismuth Nitrate

[(BINO3 ) 3 5 H2O] in 8 ml of conc . Nitric Acid Warm slightly and dilute to 100 ml with distilled water .

Nitric Acid:- Concentrated AR Grade .

(b) Procedure:

(1) Weigh accurately 2.5 gm of prepared sample in to 250 ml beaker.

(2) Add 2 ml of conc . Nitric Acid and 50 ml of water and warm gently and dilute to 100 ml withwater.

Warm the solution (but do not boil ) .

(3)

(4) Slowly add 5 ml of Bismuth Nitrate Solution for each 1% of P2O5 percent in the sample, from a burette with continuous stirring and maintaining the liquid hot during addition .

(5) Cool and transfer the contents in to 250 ml volumetric flask and dilute up to the mark with distilled water .

(6) Allow precipitate to settle and dilute up to the mark with distilled water .

(7) Filter through a dry filter paper (No. 40) rejecting the first few drops in to a beaker.

(8) Pipette 100 ml of the filtrate in 250 ml beaker , add a few drops of indicator solution.

(9) Add fewdrops of 10% NaOH solution with thorough stirring until the indicator turns blue.

(10) Filter through a dry filter paper (No. 40) into 250 ml beaker and carefully wash the residue several times with cold water . The total volume should be 150 to 200 ml .

(11) Adjust the pH to about 5 by adding diluted HNO3 . Warm to about 90 °C (do , not boil ) , and stir vigorously to avoid CO2 . Cool the solution.

(12) Place in the solution, the electrodes of pH meter and adjust the pH to exactly 6.3 using NaOH solution .

Add 10 gm of mannitol and again adjust pH to exactly 6.3 with 0.02 N NaOH solution .

(13)

(14) Continue adding mannitol in 10 gm portion till pH remains constant at 6.3 . Note the total volume of 0.02 N NaOH used for the 1 " addition of Mannitol (Step 13) .

Carry out a blank determination on fertilizers mixture to which Borate is not added.

TERMS AND CONDITION OF AUTHORISATION

(1) I shall comply with the provisions of the Fertilizer (Control ) Order, 1985 and the notifications issued thereunder for the time being in force.

(2) I shall from time to time report to the Notified Authority and inform about change in the premises of sale depot and godowns attached to sale depot .

(3) I shall also submit in time all the returns as may be prescribed by the State Government.

(4) I shall, not sell fertilizers for industrial use .

(5) I shall file a separate Memorandum of Intimation for , where the storage point is located outside the area jurisdiction of the Notified Authority where the sale depot is located

(6) I shall file a separate MOI for each place when the business of selling fertilizers is intended to be carried on at more than one place

(7) I shall file separate MOI if I carry on the business of fertilizers both as retail and wholesale" dealer .

(8) I confirm that my previous certificate of Registration or Authorisation is not under Suspension or Cancellation or debarred from selling of fertilizers .

47. In the said Order, in Form B in the heading , the words " WHOLESALE/RETAIL " shall be omitted.

48. In the said Order , in Form D, in serial number (5 ) for the words ' Chemical Analysis ' , the words "Specifications " shall be substituted.

49. In the said Order, in Form E , in serial number (6), for the words Chemical Analysis" , the words "specifications" shall be substituted.

50. In the said Order, in Form ' H ' , for the existing 'Note ' , the following Note shall be substituted, namely: -

"Chemical analysis to be indicated shall be one which has been certified by a notified Fertiliser Control Laboratory on the basis of samples drawn by the Fertiliser Inspector ".

51 . In the said Order , in Form J, -

(a) after serial number ( 1 ) and the entry relating thereto , the following serial number and entry shall be inserted namely: -

"( 1A) Certificate of Registration Number" ;

(b) ) in the entry against serial number (3 ) , -

(i ) in item (1 ), the words " with brand " shall be omitted;

52. In the said Order, in Form K, -

(i) in the entry against serial number ( 1 ) , the words " and Brand" shall be omitted;

(ii) serial numbers (3 ) and (4) and the entries relating thereto shall be omitted;

(iii ) for the words " Signature of Fertiliser Inspector' , the words " signature and metallic seal impression of Fertilizer Inspector" shall be substituted.

53. Inthe said Order, in Form ' L' -

(i ) in the entry against serial number ( 1 ) , the words " and Brand" shall be omitted;

(ii) serial number (3 ) and the entry relating thereto shall be omitted;

(iii) in serial number 8, in the table , in the entry against serial number (vii ) , for the words 'Nitrate' , the word "Neutral " shall be substituted;
