सा.का.नि. 37 ( अ )- विस्फोटक नियमावली , 1983 में आगे और संशोधन करने के लिए कतिपय नियमों का जिन्हें विस्फोटक अधिनियम , 1884(1884 का 4) की धारा 5 और 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार द्वारा बनाए जाने का प्रस्ताव है , निम्नलिखित मसौदा उक्त अधिनियम की धारा 18 की उपधारा (1 ) में यथा अपेक्षित इससे प्रभावित होने वालें सभी व्यक्तियों की सूचना के लिए एतद्द्वारा प्रकाशित किया जाता है तथा एतद्वारा यह सूचना दी जाती है कि इस अधिसूचना से युक्त राजपत्र को जनता के लिए उपलब्ध कराए जाने के पैंतालीस दिनों के बाद उक्त मसौदा नियमों पर विचार किया जाएगा । आपत्तियां अथवा सुझाव , यदि कोई हों , संयुक्त सचिव, औद्योगिक नीति और संवर्धन विभाग , वाणिज्य और उद्योग मंत्रालय , उद्योष भवन, नई दिल्ली को भेज दिए जाएं ।
उक्त मसौदा नियमों के संबंध में किसी व्यक्ति से उपर्युक्त विनिर्षिष्ट अवधि से पूर्व प्राप्त हुई आपत्तियों अथवा सुझावों पर केन्द्र सरकार द्वारा विचार किया जाएगा ।
मसौदानियम

इन नियमों का नाम विस्फोटक ( संशोधन) नियम , 2003 है ।

(2) ये उस तिथि से प्रभावी होंगे जब इन्हें सरकारी राजपत्र में अन्तिम रूप से प्रकाशित किया जाएगा ।

[PART II-SEC. 3(1)] 2. विस्फोटक नियम , 1983 में , -
(i) नियम 2 में, -
(क) खंड ( 13) के बाद , निम्नलिखित जोड़ा जायेगा, नामतः
(13 क) पदार्थ में , " मार्किंग एजेंट" जिसे वाष्प खोज तकनीक द्वारा खोज के प्रयोजन के लिए एक मात्रा में प्लास्टिक विस्फोटकों में आरंभ किया गया है । (ख) खंड ( 14 ) के बाद , निम्नलिखित खंड को जोड़ा जायेगा , नामतः
66 " ( 14क) ' प्लास्टिक विस्फोटकों' से. आशय लचीली विस्फोटक सामग्री से है अथवा लोच एक या अधिक विस्फोटकों से निर्मित होगी जो 25 डिग्री सैंटीग्रेड के तापमान पर 10 पी ए से कम वाष्प दबाव के रूप में अपने शुद्धरूपों में बाइन्डर सामग्री बन जाती है और एक मिश्रण के रूप में सामान्य कक्ष तापमान पर मुलायम अथवा लचीला है ,"
(ii) नियम 6 में,-
(क) उप-नियम ( 2) में खंड ( क) के लिए निम्नलिखित प्रतिस्थापित किया जायेगा , नामतः -
"(क) विस्फोटकों के संयोजन की प्रकृति और प्लास्टिक विस्फोटकों के मामले में मार्किंग एजेंट का नाम और प्रतिशत" ;
(ख) उप-नियम (6 ) में , खंड ( ii ) में , उप- खंड (ञ ) के लिए निम्नलिखित प्रतिस्थपित किया जायेगा , नामतः:-
"(ञ ) सुनिश्चित करना कि प्लास्टिक विस्फोटकों की पहचान वाष्प खोज तकनीक से हो सके;
( ट) कोई भी दूसरे परीक्षण जो मुख्य विस्फोटक नियंत्रक द्वारा निर्धारित किये गये हों" ;
(iii) नियम 9 में , -
(क) उप- नियम ( 1 ) में , खंड ( छ) के पश्चात् निम्नलिखित खंड डाला जायेगा, नामतः:-

"(ज) प्लास्टिक विस्फोटकों के मामले में , शब्द ' अंतर्रास्ट्रीय नागर विमानन संगठन समझौते के अनुसार मार्किंग एजेंट जोड़े जायेंगे"
(ख) उप-नियम (3) में, खंड (ख ) के लिए निम्नलिखित खंड प्रतिस्थापित जायेगा, नामतः:-
"(ख ) विस्फोटकों का नाम और प्लास्टिक विस्फोटकों के मामले में अतिरिक्त शब्द "मार्किंग एजेंट जोड़ें" ;
(iv) नियम 21 में , उप- नियम (2) में, खंड ( ग ) के पश्चात् निम्नलिखित जोड़ा जायेगा , नामतः:-
"(घ) "प्लास्टिक विस्फोटक , बिना मार्किंग एजेंट जोड़े" ;
(v) नियम 87 में, उप- नियम (1 ) में निम्नलिखित उप- नियम जोड़ा जायेगा. नामतः:-
"( 1 क) अंतर्राष्ट्रीय नागरिक विमानन संगठन समझौते के अनुसार कोई भी व्यक्ति बिना मार्किंग ऐजेंटों के किसी भी प्लास्टिक विस्फोटक का विनिर्माण नहीं करेगा । "
(IV) नियम 89 में, उप-नियम (2) में , खंड (च) के लिए निम्नलिखित प्रतिस्थापित किया जायेगा , नामतः:-
"(च) वाष्प खोज तकनीक द्वारा खोज के लिए प्लास्टिक विस्फोटकों में मार्किंग एजेंट का नाम व प्रतिशत जोड़ा जायेगा ;
(छ) निर्धारित किया गया जांच शुल्क" ।

NOTIFICATION
New Delhi , the 17th January, 2003
G.S.R. 37(E) -The following draft of certain rules further to amend the Explosives Rules , 1983 which the Central Government proposes to make in exercise ofthe powers conferred by section 5 and 7 of the Explosives Act 1884 (4 of 1884) is hereby published as required by sub -section ( 1 ) of section 18 of the said Act for information ofall persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration forty five days after the Gazette containing this notification is made available to the public.
The objections or suggestions, if any , may be sent to the Joint Secretary, Department of Industrial Policy and Promotion, Ministry of Commerce and Industry , Udyog Bhavan, New Delhi;
Objections or suggestions received from any person with respect to the said draft rules before the period specified above will be considered by the Central Government.
DraftRules
1. (1) These rules may be called the Explosives (Amendment ) Rules, 2003.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Explosives Rules ; 1983 ,-
inrule 2,-
(i)
(a) after clause (13 ), the following clause shall be inserted, namely: - (13a) marking agent ' in substance which is introduced into the plastic explosives in a quantity for the purpose of detection by means of vapour detection technique. "
(b) after clause(14) , the following clause shall be inserted, namely: - "( 14 a) ' plastic explosives ' means an explosive material in flexible or elastic shall form formulated with one or more explosives which in their puriforms as a vapour pressure less than 10< 4 > Pa at a temperature of 25 degree centigrade is formulated in a binder material , and is as a mixture malleable or flexible at normal room temperature ";
(ii) In rule 6, -
(a) in sub- rule (2), for clause (a), the following shall be substituted, namely: - 6

[PART II-SEC. 3 (i)) "(a) the nature of composition of the explosives and in the case of plastic explosives, the name and the percentage of the marking agent" ;
(b) in sub- rule (6), in clause ( ii) , for sub-clause (j ), the following shall be substituted, namely:-
"(j ) ensure that plastic explosives are detected by vapour detection technique;
(k) such other tests as the Chief Controller of Explosives may specify";
(iii)in rule 9, -
(a) in sub -rule ( 1 ) , after clause (g) , the following clause shall be inserted, namely: -
"(h) in case of plastic explosives , the words ' marking agent to be added as per International Civil Aviation Organisation convention"
(b) in sub - rule (3 ) for clause ( b ) , the following clause shall be substituted, namely:-
"( b) the name of the explosives and in case of plastic explosives add the additional words ' marking agent " ;
(iv) in rule 21 , in sub- rule (2 ), after clause (c ) , the following clause shall be inserted , namely: -
"(d) plastic explosives without addition of marking agent " ;
(v) in rule 87, after sub- rule ( 1 ) , the following sub-rule shall be inserted, namely: -
"( la) No person shall manufacture any plastic explosives without marking agent as per International Civil Aviation Organisation Convention"
( võin rule 89, in sub- rule (2 ) , for clause ( f) , the following shall be substituted,. namely: -
("f) name and percentage of marking agent to be added in plastic explosives for detection by vapour detection technique;
(g) prescribed scrutiny fee".
