का.आ. 52( अ ) - भारत सरकार के पर्यावरण एवं वन मंत्रालय की अधिसूचना संख्या का.आ.114(अ) दिनांक 19 फरवरी , 1991 , (जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है) , के द्वारा तटीय क्षेत्र को तटीय विनियमन क्षेत्र घोषित किया था और उक्त क्षेत्र में उद्योगों को स्थापित करने और उनके विस्तार, प्रचालन और प्रक्रियाओं पर निर्बधन अधिरोपित किए गए थे;
और अंडमान और निकोबार द्वीप संघ राज्य क्षेत्र प्रशासन ने उक्त राज्य क्षेत्र के तटीय विनियमन क्षेत्र में बालू के खनन पर लगे निर्बंधन के कारण स्थानीय व्यक्तियों द्वारा सहन की जा रही कठिनाइयों की ओर केन्द्रीय सरकार का ध्यान आकृष्ट किया था और केन्द्रीय सरकार की यह राय है कि उक्त अधिसूचना में संशोधन किया जाना चाहिए ;
और पर्यावरण (संरक्षण) नियम, 1986 के नियम 5 के उप नियम (4) में यह उपबंध है कि उप नियम (3) में अंतर्विष्ट किसी बात के होते हुए भी जहां केन्द्रीय सरकार को ऐसा प्रतीत होता है कि लोक हित में ऐसा करना आवश्यक है, वहां वह उक्त नियम के उपनियम (3 ) के खंड (क) के अधीन सूचना की अपेक्षा को समाप्त कर सकती है;
जाए; और केन्द्रीय सरकार की यह राय हे कि लोकहित में सूचना की अपेक्षा को समाप्त कर दिया अतः अब केन्द्रीय सरकार पर्यावरण ( संरक्षण) नियम , 1986 के नियम 5 के उपनियम (3) और (4) के साथ पठित पर्यावरण ( संरक्षण ) अधिनियम, 1986 (1986 का 29) की धारा 3 की उपधारा ( 1 ) और उपधारा (2) के खंड (v) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त 155 G1/2003

[PART --SEC. 3( ii ) ] अधिसूचना में निम्नलिखित और संशोधन करती है, अर्थातः-
उक्त अधिसूचना में
66 (क) पैस 2 के उप पैरा ( ix ) " बशर्ते कि" शब्द से प्रारम्भ और " पर्यावरण पर प्रतिकूल प्रभाव " शब्द के साथ समाप्त भाग में निम्नलिखित परन्तुक प्रतिस्थापित किया जाए, अर्थात्
बशर्ते कि अण्डमान एवं निकोबार द्वीप समूह के संघ शासित क्षेत्र में उप- राज्यपाल द्वारा गठित समिति, जिसमें 1 ) मुख्य सचिव; 2) सचिव, पर्यावरण विभाग 3 ) सचिव, जल संसाधन विभाग और 4) सचिव, लोक निर्माण विभाग शामिल होंगे , द्वारा बालू के खनन की अनुमति दी जाएः इसके अतिरिक्त बशर्ते समिति बालू की सपूर्ति या जमाव की दर के साथ साथ चयनित स्थलों के आधार पर 01 अप्रैल, 2002 से 31 मार्च 2003 तक की अवधि के लिए प्रत्येक मामले के आधार पर निर्माण कार्यों के लिए 55,127 घन मीटर तक बालू के खनन की अनुमति प्रदान कर सकती है ।
परन्तु इस उप पैरा के अन्तर्गत बालू के खनन की अनुमति खनन योजनाओं पर आधारित होगी जो मूंगा, कछुओं, मगरमच्छों, पक्षी वासस्थलों और सुरक्षित क्षेत्रों सहित संवेदी तटीय पारि प्रणाली को होनेवाली क्षति से बचाने के लिए पर्याप्त सुरक्षा सुनिश्चित करती हो ।
तटीय विनियमन जोन 4 अंडमान और निकोबार द्वीप " शीर्षक में, (ख) अनुबन्ध 1 में, "
मद ( iv) की उपमद (ख) में " 31 सितम्बर, 2002 " शब्दों और अंको के स्थान पर " 31 मार्च 2003 " शब्द और अंक रखे जाएंगे ।

NOTIFICATION
New Delhi , the 16th January, 2003
S.O. 52 ( E) . Whereas by notification of the Government of India in the Ministry of Environment and Forests number S.O.114(E) , dated the 19th February, 1991 (hereinafter referred to as the said notification) , the Central Government declared Coastal Stretches as Coastal Regulation Zone and restrictions were imposed on the setting up and expansion of industries , operations and processes in the said Zone;
And whereas the Andaman and Nicobar Administration of the Union Territory of the Andaman and Nicobar Islands has drawn the attention of the Central Government to the difficulties being faced by the local population of the said territory due to restrictions on mining of sand in the Coastal Regulation Zone in the said territory;
Andwhereas the issue has been examined by the Government of India in the Ministry ofEnvironment and Forests;
And whereas the Central Government is of the opinion that the said notification should be amended ;
And whereas sub- rule (4) of the rule 5 of the Environment ( Protection) Rules, 1986 provides that notwithstanding anything contained in sub- rule (3 ) , wherever it appears to the Central Government that it is in public interest to do so , it may dispense with the requirement of notice under clause ( a) of sub- rule (3 ) ;
And whereas the Central Government considers that in public interest the said requirement of notice should be dispensed with;
Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) and clause (v) of sub - section (2 ) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub - rules (3 ) and (4) of rule 5 of the Environment (Protection) Rules , 1986, the Central Government hereby makes the following amendments in the said notification, namely: -
In the said notification , -
(a) in paragraph 2, in sub -paragraph (ix) , for the portion beginning with the words "provided that ' and ending with the words " adverse impacts on the environment" , the following provisos shall be substituted, namely : -
"Provided that in the Union Territory of the Andaman and Nicobar Islands , mining of sand may be permitted by a Committee constituted by the Lieutenant Governor of the [ PART 11- SEC . 3 ( ii )|

Andaman and Nicobar Islands comprising ( 1 ) the Chief Secretary; (2) Secretary, Department of Environment ; (3 ) Secretary , Department of Water Resources; and (4 ) Secretary, Public Works Department:
Provided further that the Committee may permit mining of sand upto 55,127 cu.m. for construction purposes on a case to case basis, for the period on and from the 1st day of April , 2002 to the 31st day of March, 2003 , from sites selected, inter-alia , based on rate of replenishment or deposition of sand:
Provided also that the permission as may be granted under this sub- paragraph for mining of sand shall be based on mining plans and stipulate sufficient safeguards to prevent damage to the sensitive coastal eco - system including corals, turtles , crocodiles , birds nesting sites and protected areas.";
(b) in Annexure - I , under the heading " CRZ - IV Andaman and Nicobar Islands " , in item ( iv) , in sub - item (b), for the figures , letters and words "31 day of September, 2002, " the figures , letters and words "31st March, 2003 " shall be substituted.
