अधिसूचना

सा.का.नि. 43 (अ ) .- केन्द्रीय सरकार, केन्द्रीय मोटर यान नियम , 1989 का और संशोधन करने के लिए निम्नलिखित प्रारूप नियम, जिन्हें मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 27 और धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाना चाहती है, ऐसे व्यक्तियों की जानकारी के लिए , जिनके उससे प्रभावित होने की संभावना है, उक्त अधिनियम की धारा 212 की उपधारा (1 ) की अपेक्षानुसार प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से , जिसको भारत के राजपत्र में यथाप्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि कै अवसान के पश्चात् विचार किया जाएगा ;
किसी व्यक्ति से उक्त प्रारूप नियमों की बाबत ऊपर विनिर्दिष्ट अवधि की समाप्ति के भीतर प्राप्त किन्हीं आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा विचार किया जाएगा ;
इन नियमों से संबंधित आक्षेपों या सुझावों को उपर्युक्त अवधि के भीतर संयुक्त सचिव (परिवहन) , सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, नई दिल्ली को भेजा जाएगा ।
प्रारूप नियम
1. (1) इन नियमों का संक्षिप्त नाम क्रेन्द्रीय मोटर यान (.... संशोधन) नियम, 2003 है । (2
) जब तक कि इन नियमों में अन्यथा विनिर्दिष्ट न हो, ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. केन्द्रीय मोटर यान नियम , 1969 (जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 2 में खंड ( घ) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्: --
'(न) " अंतर्राष्ट्रीय चालन अनुज्ञापत्र " से ऐसी अनुज्ञप्ति अभिप्रेत है जो भारत में किसी अनुज्ञापन प्राधिकारी द्वारा अधिनियम के अध्याय 2 के अधीन किसी भारतीय राष्ट्रिक को उसमें विनिर्दिष्ट व्यक्ति को प्ररूप 4 क में यथाविनिर्दिष्ट किन्हीं प्रवर्गों के मोटर यानों को चलाने के लिए भारत से भिन्न देशों के किन्तु उन देशों को छोड़कर जिनके साथ कोई राजनयिक संबंध नहीं हैं, क्षेत्रों या राज्यक्षेत्रों में जारी की गई हो । ' ।
3. उक्त नियमों के नियम 14 को उसके उपनियम (1 ) के रूप में संख्यांकित किया जाएगा और इस प्रकार संख्यांकित उपनियम ( 1 ) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्: --
"(2) अंतर्राष्ट्रीय चालन अनुज्ञापत्र के लिए आवेदन प्ररूप 4क में किया जाएगा और उसके साथ निम्नलिखित होंगे, -
(क) इन नियमों के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी विधिमान्य चालन अनुज्ञप्ति;
(ख) नियम 32 में यथाविनिर्दिष्ट समुचित फीस ;
(14) आवेदक के पासपोर्ट आकार की नवीनतम फोटो की तीन प्रतियां ;
(घ) प्ररूप 1 क में चिकित्सा प्रमाणपत्र ; और
(ङ) भारतीय राष्ट्रीयता का विधिमान्य सबूत ।" ।
4. उक्त नियमों के नियम 16 के उपनियम (3) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा , अर्थात्: --
" (4) प्रत्येक अंतर्राष्ट्रीय चालन अनुज्ञापत्र, जो अनुज्ञापन प्राधिकारी द्वारा जारी किया गया या नवीकृत किया गया हो, प्ररूप 6क में होगा और यथास्थिति जारी या नवीकृत किए जाने की तारीख से एक वर्ष से अनधिक की अवधि के लिए या चालन अनुज्ञप्ति की विधिमान्यता तक, जो भी पूर्वतर हो, विधिमान्य होगा ।" ו
5. उक्त नियमों के नियम 18 के उपनियम (2) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्: --
"(3) किसी अंतर्राष्ट्रीय चालन अनुज्ञापत्र के नवीकरण के लिए कोई आवेदन प्ररूप 9 क में किया जाएगा और उसके साथ निम्नलिखित होंगे, - भारत का राजपत्र : असाधारण

(क) इन नियमों के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी अंतरराष्ट्रीय चालन अनुज्ञापन ; :
(ख) नियम 32 में यथाविनिर्दिष्ट समुचित फीस ;
(ग) आवेदक के पासपोर्ट आकार की नवीनतम फोटो की तीन प्रतियां ;
और
(घ) प्ररूप 1 क में चिकित्सा प्रमाणपत्र ;
6. उक्त नियमों के नियम 32 की सारणी में, -
(i) क्रम सं० 2 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित क्रम सं० और प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात्: --

प्ररूप 6क में अंतर्राष्ट्रीय चालन अनुज्ञापत्र को नवीकृत करने की बाबत । THE GAZETTE OF INDIA: EXTRAORDINARY
[PART II-SEC. 3 ( i ) ] (iii) क्रम सं 0 7 के सामने, स्तंभ (3 ) में " तीस रुपए " शब्दों के स्थान पर "सौ रुपए और बढ़ाई गई अवधि के अवसान की तारीख से संगणित की गई एक वर्ष की विलंब की अवधि या उसके भाग के लिए पचास रुपए की दर पर अतिरिक्त फीस " शब्द रखे जाएंगे ;
7. उक्त नियमों के नियम 50 के उपनियम (1 ) के खंड (vi) में परन्तुक के पश्चात् निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा, अर्थात् :--
"परन्तु यह और कि कृषि ट्रैक्टरों के लिए रजिस्ट्रीकरण प्लेटों का आकार निम्नानुसार होगा :
सभने 285 x 45 मि.मी.
पीछे 200 x 100 मि.मी.।" ।
8. उक्त नियमों के नियम 95 में, उपनियम (1 ) के पश्चात् " (2) संन्निर्माण उपस्कर यान के टायरों के आकार " कोष्ठको, अंक और शब्दों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: --
" (2क) किसी संन्निर्माण उपस्कर यान के टायरों के आकार" ।
9. उक्त नियमों के नियम 96 क के पश्चात् और नियम 97 से पूर्व " 96क. उच्च गति की ब्रेकिंग अपेक्षाएं" अंकों, अक्षर और शब्दों के स्थान पर " 96ख . उच्च गति की ब्रेकिंग अपेक्षाएं " अंक, अक्षर और शब्द रखे जाएंगे ।
10. उक्त नियमों के नियम 115 के उपनियम ( 11 ) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्: --
" ( 12) दो पहिए और तिपहिए के लिए 1 अप्रैल, 2005 से ही द्रव्यमान उत्सर्जन मानक (भारत स्टेज- 2) निम्नानुसार होंगे, अर्थात्: --

(क) परीक्षण करने वाले अभिकरणों द्वारा परीक्षण चेसिस डायनोमीटर पर अतप्त प्रवर्तन सहित उस भारतीय चालन चक्र के अनुसार होगा जो नीचे दी गई सारणी में विनिर्दिष्ट हैं, अर्थात् : -

(ख) निर्देश परीक्षण ईंधन उपाबंध 12 में दिए विनिर्देशों के अनुसार होगा ।
(ग) (i ) सभी प्रकार के दो पहिए और तिपहिए गैसोलीन यानों के लिए, टाइप अनुमोदन सीमाओ / सीओपी सीमाओं के संबंध में 1.2 के क्षयकारक टिकाऊपन के लिए लागू होगा :
परन्तु यह कि यान विनिर्माता क्षय कारकों के मूल्यांकन के लिए 30000 किलोमीटर के किसी कालप्रभावन परीक्षण का विकल्प उस प्रक्रिया के अनुसार दे सकेगा जो केन्द्रीय सरकार द्वारा समय- समय पर अधिकथित की जाए ;
(ii) सभी प्रकार के दो पहिए और तिपहिए डीजल यानों के लिए क्षय कारक सीओ के लिए 1.1 एचसी + एनओएक्स के लिए 1.0 तथा विशिष्ट मामले में 1.2 टाइप अनुमोदन सीमाएं/सीओपी सीमाएं टिकाऊपन के लिए लागू होंगी :
परन्तु यह कि यान विनिर्माता क्षय कारकों के मूल्यांकन के लिए 30000 किलोमीटर के किसी कालप्रभावन परीक्षण का विकल्प उस प्रक्रिया के अनुसार दे सकेगा जो केन्द्रीय सरकार द्वारा समय - समय पर अधिकथित की जाए ;
(घ) डीजल इंजन यानों के लिए दृश्य प्रदूषक (धुंआ) उत्सर्जन धुंआ घनत्व की सीमा मान से अधिक नहीं होगा , जब उसका परीक्षण स्थिर गति पर पूर्ण भार पर किया जाए, नियम 115 के उपनियम (9) के उपाबंध 1 में यथा उपदर्शित विभिन्न प्रसामान्य प्रवाह के लिए प्रकाश अवशोषण सहदक्षता के लिए प्रकट किया जाए ;
(ङ) तिपहियों का परीक्षण द्रव्यमान उत्सर्जन के लिए समतुल्य जीवीडब्ल्यू निष्क्रियता सहित चेसिस डायनोमीटर पर किया जाएगा ;
(च) सीओपी बारंबारता और नमूने : --

सीओपी उत्तीर्ण या अनुत्तीर्ण विनिश्चय के लिए न्यूनतम 3 यान और अधिकतम 32 यानों का परीक्षण किया जाना ।
(छ) परीक्षण प्रक्रिया समय - समय पर भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय द्वारा यथा संशोधित निर्देश दस्तावेज एमओएसटी/ सीएमवीआर/टीएपी-115/ 116 के अनुसार होगी ।"
11. उक्त नियमों के नियम 125 को उसके उपनियम (1 ) के रूप में संख्यांकित किया जाएगा ।
12. उक्त नियमों के प्ररूप 4 में " (नियम 14 देखें) " कोष्ठकों, शब्दों और अंकों के स्थान पर नियम [ 14 (1 ) देखें ] " कोष्ठक, शब्द और अंक रखे जाएंगे । 13 - उक्त नियमों में, प्ररूप 4 के पश्चात् निम्नलिखित प्ररूप अंतःस्थापित किया जाएगा अर्थात्- "66 प्ररूप 4 क [नियम 14 (2) देखें]
दूसरे देशों में मोटर यान चलाने के लिए अंतरराष्ट्रीय चालन अनुज्ञापत्र (आई डी पी) जारी करने के लिए आवेदन का प्ररूप

(घ) यात्रियों के वहन के लिए प्रयुक्त मोटर यान और जिनमें चालक की सीट के अतिरिक्त आठ से अधिक सीटें नहीं हैं ।
(ङ) यानों का संयोजन जिनमें चालन यान उस प्रवर्ग या प्रवर्गों में है जिनके लिए चालक को अनुज्ञप्ति (ख और/ अथवा ग और/ अथवा घ) दी गयी है किंतु वह स्वयं उस प्रवर्ग या प्रवर्गों में नहीं है ।

यह अनुज्ञापत्र निम्नलिखित राज्यक्षेत्र के लिए विधिमान्य नहीं है ।
(1)
चालन के लिए वाहनों का प्रवर्ग जिनके लिए यह विधिमान्य है जो इस प्ररूप में पैस आ पर उपवर्णित है ।
(2) यह अनुज्ञा पत्र किसी भी तरह धारक को आवास से संबंधित विधियों और विनियमों के अनुपालन की बाध्यता तथा प्रत्येक राज्य में, जहां वह यात्रा करता है में वृत्ति करने से छूट नहीं देता है । विशिष्टतया, यह उस राज्य में तब विधिमान्य नहीं रह जाएगा जब इसका धारक वहां सामान्य निवास स्थापित कर लेता है ।

11 उपयोग की निर्बन्धनात्मक शर्तें निम्न प्रकार है :

G.S.R. 43 (E)- The followingdraft rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by sections 27 and 110 of the Motor Vehicles Act, 1988 (59 of 1988) is hereby published as requiredby sub-section ( 1 ) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft ruleswill be taken into consideration after expiry of the period of forty- five days from the date on which the copies of this notification , as published in the Gazette of India , are made available to the public;
Any objections or suggestions which may be received from any person with respect to the said draft rules within the expiry of the period specified above will be considered by the Central Government;
The objections or suggestions to these rules be sent to the Joint Secretary (Transport) , Ministry of Road Trarısport and Highways , Transport Bhavan , New Delhi , within the period, specified above .
DRAFT RULES
1. ( 1)
Amendment) These rules maybe called the Central Motor Vehicles ( ... Rules , 2003.
(2) They shall come into force on the date of their final publication in the Official Gazette, unless otherwise specified in these rules.
2. In the Central Motor Vehicles Rules , 1989 (hereinafter referred to as the said rules) , in rule 2, after clause (s) , the following clause shallbe inserted, namely: -
'( t)." International Driving Permit" means the licence issued by a licensing authority in India under Chapter II of the Act to an Indian National authorising the person specified therein to drive any categories of motor vehicles as specified in Form 4A in the areas or territories of countries other than India but excluding the countries with whom there are no diplomatic relations .' .

3. Rule14 of the said rules shall be numbered as sub- rule ( 1 ) thereof; and after sub rule ( 1 ) so numbered , the following sub- rule shall be inserted, namely: -
"(2) An application for an International Driving Permit shall be made in Form 4 A and shall be accompanied by
(a) valid driving licence issued by the licensing authority under these rules;
(b) appropriate fee as specified in rule 32;
three copies of the applicant's recent passport photograph.
(c)
a medical certificate in Form 1A; and
(d)
(e) valid proof of Indian Nationality. " .
4. In rule 16 of the said rules , after sub-rule (3 ), the following sub- rule shall be inserted , namely: -
"(4) Every International Driving Permit issued or renewed by a licensing authority shall be in Form 6A and shall be valid for a period of not more than one year from the date of issue or renewal , as the case may be , or till the validity of the driving licence , whichever is earlier ." .
5. In rule 18 of the said rules , after sub- rule (2) , the following sub- rule shall be inserted , namely: -
"( 3) An application for the renewal of an International Driving Permit shall be made in Form 9A and shall be accompaniedby-
(a) International Driving Permit issued by the licensing authority under these rules;
(b) appropriate fee as specified in rule 32;
(c) three copies of the applicant's recent passport photograph ; and
(d) a medical certificate in Form 1A. " .
6. In rule 32 of the said rules , in the Table,

(c) (i) For all types of two-wheeler and three-wheeler gasoline vehicles , a deterioration factor of 1.2 on type approval limits/ COP limits shall be applicable for durability:
Provided that the vehicle manufacturer may opt for an ageing test of 30000 kms for evaluating deterioration factor , as per procedure that may be laid down by the Central Government from time to time;

(ii) For all types of two-wheeler and three-wheeler diesel vehicles , a deterioration factor of 1.1 for CO , 1.0 for HC + NOx and 1.2 for Particulate Matter for type approval limits /COP limits shall be applicable for durability:
Provided that the vehicle manufacturer, may opt for an ageing test of 30000 kms for evaluating deterioration factor, as per procedure that may be laid down by the Central Governmerit from time to time;
(d) Fordiesel engine vehicles , the emission of visible pollutants ( smoke ) shall not exceed the limit value to smoke density , when expressed as light absorption co-efficient for various nominal flow as indicated in Annexure I to sub - rule (9) of rule 115 when tested at constant speed over full load;
(e) three-wheelers to be tested on chassis dynamometer for mass emission with equivalent GVW inertia;
