प्रभारी डा० वि० एकक सा.का.नि. 42 ( अ ) .- केन्द्रीय सरकार, केन्द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप, जिसे मोटर यान अधिनियम, 1989 (1989 का 59) की धारा 27 और धारा 64 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाने का प्रस्ताव करती है, उक्त अधिनियम की धारा 212 की उपधारा ( 1 ) की अपेक्षानुसार ऐसे सभी व्यक्तियों की, जिनके उससे प्रभावित होने की संभावना है, जानकारी के लिए प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप नियमों पर, उस तारीख से, जिसको भारत के राजपत्र में यथाप्रकाशित अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस दिन की समाप्ति के पश्चात्, विचार किया जाएगा ;
इन प्रारूप नियमों से संबंधित आक्षेप या सुझाव, संयुक्त सचित (परिवहन) , सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, नई दिल्ली को भेजे जा सकेंगे ;
ऐसे आक्षेप या सुझाव, जो इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे , उन पर केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम

इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान (.... संशोधन) नियम, 2003 है । (1)
ये राजपत्र में, इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

[PART II-SEC. 3 ( i) ] 2. केन्द्रीय मोटर यान नियम, 1989 में, -
नियम 2 के खंड (ध) के स्थान पर निम्नलिखित रखा जाएगा; अर्थात्: -
(क)
'(घ) "स्मार्ट कार्ड" से ऐसी युक्ति अभिप्रेत है जो डाटा का भंडारकरण करने तथा कमांड निष्पादित करने में समर्थ है, जो प्लास्टिक कार्ड पर मढ़ी हुई एकल चिप माइक्रोप्रोसेसर है और कार्ड तथा चिप के परिमाप आईएसओ 7816 विनिर्देशों में, जैसे समय- समय पर संशोधित किए जाएं , विनिर्दिष्ट हैं और वे उपाबंध 11 में यथाविनिर्दिष्ट विनिर्देशों तथा वे सड़क परिवहन और राजमार्ग मंत्रालय के पश्चात्वर्ती ऐसे अनुदेशों के अनुसार होंगे जो समय- समय पर जारी किए जाएं ।
स्पष्टीकरण- इस खंड के प्रयोजन के लिए माइक्रोप्रोसेसर चिप में न्यूनतम 4 किलो बाईट की अवाष्पशील पुनः लिखने योग्य स्मृति क्षमता होगी जिसमें अनुप्रयोग आंकड़े, फाइल प्रवेशिका संकेत सुरक्षा परिभाषाएं और प्रचालन प्रणाली अन्योन्मुखी के लिए अधिकतम 350 बाइट होंगे , जैसा सड़क परिवहन और राजमार्ग मंत्रालय द्वारा समय- समय पर चालन अनुज्ञप्ति और रजिस्ट्रीकरण प्रमाणपत्र आवेदनों के लिए विनिर्दिष्ट किया जाए ।
उपाबंध 10 के पश्चात् निम्नलिखित उपाबंध अंतःस्थापित किया जाएगा, अर्थात् : -

I. चालन अनुज्ञप्ति, रजिस्ट्रीकरण प्रमाणपत्र, प्रादेशिक परिवहन कार्यालय कार्ड, पृष्ठांकन प्राधिकरण कार्ड, पुनर्विलोकन प्राधिकरण कार्ड, की जनरेशन प्राधिकारी कार्ड, आदि के लिए स्मार्ट कार्ड विनिर्देश ।
(क) माइक्रोप्रोसेसर आधारित इंटीग्रेटेड सर्किट कार्ड कान्टैक्ट सहित और न्यूनतम 4 किलो बाइट की इलेक्ट्रीकली इरेजेबल प्रोग्रामेबल रीड आनली मेमोरी (ईईपीआरओएम)
अंतर्राष्ट्रीय मानक संगठन/ आईईसी 7816-1, 2 और 3 को शिकायत
(ख)
एससीओएसटीए v1.2 बी, को शिकायत, तारीख 15 मार्च, 2002

(ज) प्रचालन परिवेश तापक्रम रेंज 25 सी से + 55 सी
(झ) ग्लोसी पृष्ठ, पोली विनाइल क्लोराइड (पीवीसी) /एक्रीलोनाईट्रिल ब्यूटाडाइन स्ट्रीन (एबीएस) उपरिशायी सहित प्लास्टिक संनिर्माण जिससे कलरडाई सब्लीमेशन मुद्रण को अनुज्ञात किया जा सके ।
(ञ ) स्मार्ट कार्ड में अंतर्राष्ट्रीय मानक संगठन 7816-6 के अनुसार मुख्य फाइल स्तर पर कार्ड श्रृंखला संख्यांक (टैग 5एफ34) और कार्ड प्रारंभिक लेखा संख्यांक (टैग 5ए) के लिए डाटा ऑब्जेक्टस होने चाहिए । एक बार प्रोग्रामित किए जाने पर यह डाटा आब्जेक्ट परिवर्तित नहीं किए जा सकते ।
II . हस्त धारित टर्मिनल
(क) प्रदर्श : 4 लाइन x 16 अंकीय बैंक लिट लिक्विड क्रिस्टल प्रर्दश (एलसीडी) । कन्ट्रास्ट स्तर ऐसा होना चाहिए जिससे कि इसे दिन के प्रकाश में पढ़ा जा सके ।
(ख) की पैड: अंकीय कृत्य और स्क्रॉल कुंजिया । इस की पैड को उपयोग में लाते समय गैर-अंकीय अक्षर की प्रविष्टि के लिए सहायता भी उपलब्ध होनी चाहिए । (11) पावर ऑन/आफ: स्विच या स्वचालित बंद पद्धति से समर्थ बनाना ।
(घ) स्मार्ट कार्ड रीडर : उवी अन्योनमुखी सहित और टी = 0 या टी = 1 दोनों परिवहन प्रोटोकाल सहित अंतर्राष्ट्रीय मानक संगठन 7816 में दो शिकायत स्मार्ट कार्ड रीडर बनाना ।
(ङ) बैटरी पैक : (पुनःचार्ज करने योग्य और हटाए जाने योग्य) एक समय में 8 घंटे सहित और 7 दिन तक समयानुसार । मानक आकार के 1.5 वोल्ट शुष्क सेल मानक की सहायता से युक्ति के प्रचालन के लिए अधिमानतः आधार होना चाहिए । THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC. 3 (i)] (च) मेमोरी मेमोरी की अपेक्षाएं ऐप्लीकेशन और टर्मिनल द्वारा समर्थित ऐप्लीकेशनों की संख्या पर आधारित होगी ।
(छ) प्रिंटर: प्रिंटर वैकल्पिक है और प्रिंटर पोर्ट वांछनीय है ।
(ज) लागू होना : इस उपाबंध में चालन अनुज्ञप्ति के राष्ट्रीय मानक और रजिस्ट्रीकरण प्रमाणपत्र ।
(झ) संसूचना : साफ्टवेयर (अपग्रेड्स) लोड करने और अनलोड करने के लिए मानक संसूचना अन्योनमुखी ।
III. डाई सब्नीमेशन मुद्रक
मुद्रण प्रक्रिया : डाई सब्लीमेशन
संकलन 300 बिन्दु प्रति इंज (डीपीआई. )
मुद्रण गति प्रति साइड लगभग 30 सेकेंड
रंग- वाईएमसीके + ओ/वाईएमसीकेओ/केओ रिबन का उपयोग करके 16.7 मिलियन रंगों तक ।
कोने से कोने तक प्रिंट करने की क्षमता ।
कार्ड इनपुट होपर और अंतःनिर्मित कार्ड मार्जन प्रणाली होना ।
एकल पास में मुद्रण करने और स्मार्ट कार्ड की इलेक्ट्रोनिकी व्यक्तिगत विशिष्टियां प्रविष्ट करने में सक्षम ।
मुद्रक के भीतर स्मार्ट कार्ड एनकोडर पीसी से स्मार्ट कार्ड रीडर अन्योनमुखी के लिए कारखाना मानक अंतर्राष्ट्रीय संगठन 7816 अनुदत्त आधार उवी चिप कार्ड टी = 0 और टी = 1 प्रोटोकाल सहित होगा ।
IV. स्मार्ट कार्ड रीडर
पीसी से स्मार्ट कार्ड रीडर अन्योनमुखी के लिए कारखाना मानक, आईएसओ 7816 अनुवृत्त आधार उवी चिप कार्ड कार्ड टी = 0 और टी = 1 प्रोटोकाल सहित, यूएसबी [ भाग II- खण्ड 3 ( i ) ]

अन्योनमुखी, बाह्य रीडर पीसीसे स्मार्ट कार्ड रीडर अन्योनमुखी ड्राइवर के लिए कारखाना मानक का होना चाहिए ।
टिप्पण : - उपर्युक्त स्मार्ट कार्ड आधारित चालन अनुज्ञप्ति से परिवहन और गैर- परिवहन यानों के लिए यान रजिस्ट्रीकरण दस्तावेजों के लिए न्यूनतम विनिर्देश हैं । कोई अतिरिक्त मेमोरी क्षमता इलेक्ट्रीकली इरेजेबल प्रोग्रामेबल रीड आनली मेमोरी (ईईपीआरओएम) या माइक्रोप्रोसेसर चिप में कृत्यों या कोई अन्य सूचना भंडारण प्रौद्योगिकी दिए गए न्यूनतम विनिर्देश से अंतर्विरोध नहीं करेगी और प्रचालन प्रणाली के रूप में प्रचालन पर्यावरण प्रोटोकाल और अन्य ब्यौरे, जो पैरा की मद (क) से (ञ) में दिए गए हैं किसी विचलन सहित या उसके बिना लागू होंगे " ।

NOTIFICATION
New Delhi , the 21st January, 2003
G.S.R.42(E). The following draft of certain rules further to amend the Central Motor Vehicles Rules , 1989 , which the Central Government proposes to make in exercise of the powers conferred by sections 27 & 64 of the Motor Vehicles Act , 1989 (59 of 1988 ) , is hereby published as required by sub -section ( 1 ) of section 212 ofthe said Act for information of all persons likely to be affected thereby ; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India , are made available to the public ;
Objections or suggestions to these draft rules may be sent to the Joint Secretary (Transport) , Ministry of Road Transport and Highways , Transport Bhawan , NewDelhi;
The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be considered by the Central Government.
DRAFT RULES
1. (1 ) These rules may be called the Central Motor Vehicles ( .... Amendment ) Rules, 2003.
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Central Motor Vehicles Rules , 1989 ,
(a) in rule 2, for clause (s ) , the following shall be substituted , namely: -
'(s) "Smart Card " means a device capable of storing data and executing commands, which is a single microprocessor chip mounted on a plastic card and the dimensions of the card and chip are specified in ISO- 7816 specifications , as may be amended time to time and shall be as per the specifications as specified in Annexure-XI and any subsequent instructions from Ministry of Road Transport and Highways as may be issued from time to time.
Explanation . For the purposes of this clause , microprocessor chip shall have non- volatile rewritable memory capacity of minimum 4 Kilo Byte consisting of application data , file headers , security definitions , and a maximum of 350 bytes for Operating System Interfacing , as specified by the Ministry of Road Transport and Highwaysfrom time to time for Driving License and Registration Certificate applications .

(3 ) after Annexure - X, the following Annexure shall be inserted , namely: -
"ANNEXURE XI
[Seeclause(s ) of rule 2]
I. Smart Card specifications for Driving License, Registration Certificate, Regional Transport Office cards, endorsing authority cards , reviewing authority cards , key generation authorities cards, etc.
(a) Microprocessor based Integrated Circuit Card with contacts and with a minimum of 4kbyte available Electrically Erasable Programmable Read Only Memory (EEPROM)
(b) Compliant to International Standards Organisation /IEC 7816-1,2 and 3
(c) Compliant to SCOSTA v1.2b, dated March 15 , 2002
(d) Supply voltage 3V nominal
(e) T= 0 or T= 1 transport protocol
(f) Min 10 years data retention
(g) Min 300,000 EEPROM write cycles
(h) Operating ambient temperature range -25C to + 55C
(i ) Glossy surface, Poly Vinyl Chloride ( PVC)/Acrylonitrile Butadiene Styrene (ABS) plastic construction with overlay to allow color dye printing sublimation (j ) Smart Cards must have data objects for card sequence no (Tag 5F34 ) and cards primary account no (Tag 5A) at the Master File level as per International Standards Organisation 7816-6 . Once programmed these data objects can not be changed .
II . Hand Held Terminals
(a) Display : 4 lines X 16 characters back lit Liquid Crystal Display( LCD ) . Contrast level should such that it can be read in broad day light.
(b) Key Pad : Numeric, Function and scroll keys . Support for entering non - numeric characters using this key pad should also be available.
(c) Power On/Off : Switch or automated sleep mode enabled.
(d) Smart Card Readers : Two built in International Standards Organisation 7816 complaint smart card readers with 3V interface and with both T= 0 and T= 1 transport protocols .
(e) Battery pack: ( Rechargeable and removable ) with 8 hours of on time and 7 days stand-by time . Preferably support should be there to operate device with the help of standard 1.5 Volts Dry Cells of Standard size.
(f) Memory Memory requirements will depend on the application and the number of applications supported by the Terminal .
(g) Printer: Printer is Optional and Printer Port is desirable
(h) Application : National Standard of Driving License and Registration Certificate in this Annexure .
(i ) Communication : Standard Communication interfaces for loading and unloading of software (upgrades) 8

Colors up to 16.7 million colors by using YMCK+ O/YMCKO/ KO ribbon .
Capable of edge to edge printing
Having card input hopper and in - built card cleaning system.
Capable of printing and smart card electronic personalization in single pass .
Smart card encoder within the printer shall be Factory Standard for PC to Smart Card Reader interface, Interriational Standards Organisation 7816 compliant, support 3V chip card with T= 0 and T= 1 protocol .
IV Smart Card Reader
Factory Standard for PC to Smart Card Reader interface, ISO 7816 compliant, support 3V chip card with T= 0 and T= 1 protocol , USB interface , external . Readers must have Factory Standard for PC to Smart Card Reader interface drivers.
Note: The above are the minimum specifications for smart card based Driving License, Vehicle Registration Documents for Transport and Non- Transport Vehicles . Any additional memory capacity Electrically Erasable Programmable Read Only Memory(EEPROM) or functions in the Microprocessor chip or any other information storage technology shall not conflict with the minimum specifications given . Further, the operating environment in the form of Operating System , Protocol and other details given in items (a) to (j ) of paragraph I shall be complied with , without any variation".
