सा. का. नि. 48( अ ). राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा 2 मार्च, 2004 को सा.का.नि. 159 ( ड़ ) के जरिए भारत के राजपत्र में प्रकाशित पर्यटन और संस्कृति मंत्रालय, संस्कृति विभाग , राष्ट्रीय पुस्तकालय, कोलकाता निदेशक समूह ' क' पद भर्ती नियमावली 2001 का ऐिसी अन्य बातों के सिवाय अधिक्रमण करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गयाहै, लोप किया गया है, पर्यटन और संस्कृति मंत्रालय, संस्कृति विभाग में निदेशक, राष्ट्रीय पुस्तकालय के पद की भर्ती के तरीके को विनियमित करने के लिए एतद्द्वारा निम्नलिखित नियम बनाते हैं :-
1. लघु शीर्ष एवं प्रारंभम:-( 1 ) इन नियमों को पर्यटन और संस्कृति मंत्रालय , संस्कृति विभाग, निदेशक, राष्ट्रीय पुस्तकालय, भर्ती नियमावली , 2003 कहा जाए ।
(2) ये नियम सरकारी राजपत्र में इनके प्रकाशन तारीख से प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इसके निषों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा, और उससे संबंधित अन्य बातें, वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता-वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृति: - इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष एन्र्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पणी:- आयुसीमा निर्धारित करने के लिए निर्णायक तारीख भारत में उम्मीदवारों से आवेदन पत्र प्राप्त करने की अन्तिम तारीख होगी । ( न कि असम , मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर, नागालैण्ड, त्रिपुरा, सिक्किम , जम्मूतथा कश्मीर राज्य का लद्दाख मंडल, हिमाचल प्रदेश का लाहौल तथा स्पिति जिला तथा चम्बा जिले का पांगी उपमंडल, अण्डमान और निकोबार द्वीप समूह संघ राज्य क्षेत्र तथा लक्षद्वीप संघ राज्य क्षेत्र के लिए निर्धारित अन्तिम तारीख ) ।

( i ) किसी मान्यता प्राप्त विश्वविद्यालय से स्नात- कोत्तर उपाधि या समकक्ष

संस्थानों/राष्ट्रीय महत्व के स्थायी/स्वायत्त निकायों के पुस्तकालय में वरिष्ठ प्रशासनिक क्षमता में पांच वर्षोंकेअनुभव सहित शिक्षण/अनुसंधान में 18 वर्षों काअनुभव।
201 टिप्पणी: - 1. अभ्यर्थियों के अन्यथा सुयोग्य होने केमामले में संघ लोक सेवा आयोग के विवेकके आधार पर अर्हताएं शिथिलनीय हैं ।
टिप्पणीः-2. यदि चयन के किसी स्तर पर संघ
लोक सेवा आयोग यह महसूस करे कि उनके लिए आरक्षित पदों को भरने के लिए इन समुदायों के अपेक्षित अनुभव रखने वाले अभ्यर्थी पर्याप्त संख्या में उपलब्ध नहीं हैं तो अनुसूचित जातियों अथवा अनुसूचित जनजातियों से संबंध रखने वाले अभ्यर्थियों केमामले में अनुभव के संबंध में अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेक के आधार पर शिथिलनीयहै ।

प्रतिनियुक्ति (अल्पकालिक संविदा सहित )
स्थायीकरण पर विचार करने के लिए समूह 'क' विभागीय पदोन्नति समिति
प्रत्येक अवसर पर संघ लोकसेवा आयोग से परामर्श आवश्यकहै । केन्द्र/राज्य सरकार/संघ राज्य क्षेत्र/सरकारी क्षेत्र के उपक्रमों/विश्व- विद्यालयों/मान्यताप्राप्त अनुसंधान संस्थानों/अर्ध सरकारी/सांविधिक अथवा स्वायत्त संगठनों के अधिकारी ।
1. सचिव ( संस्कृति )-अध्यक्ष 2.अपर सचिव (संस्कृति विभाग )-सदस्य
(क) ( 1 ) जो मूल संवर्ग/ विभाग में नियमित आधार पर समकक्ष पदों को धारण किए हुए हैं ; या
(2) जिन्होंने मूल संवर्ग/ विभाग में 18400-22400 रु. या समतुल्यवेतनमान में नियमित आधार पर ग्रेड में नियुक्ति के बाद ग्रेड में तीन वर्ष की सेवा पूरी कर ली हो; और
(ख) जिनके पासकॉलम 8 के अंतर्गत सीधी भर्ती हेतु निर्धारित शैक्षिक अर्हता तथा अनुभव हो ।
(फीडर श्रेणी में ऐसे विभागीय अधिकारी जो पदोन्नति के सीधे क्रम में हैं, पर प्रतिनियुक्ति पर नियुक्ति हेतु विचार नहीं किया जाएगा । इसी प्रकार, प्रतिनियुक्ति वाले अधिकारी पदोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के लिए पात्र नहीं होंगे । इस नियुक्ति से ठीक पहले केन्द्र सरकार के उसी या किसी अन्य संगठन/विभाग में धारित किसी अन्य संवर्ग बाह्य पद पर प्रतिनियुक्ति/संविदा की अवधि सहित प्रतिनियुक्ति/संविदा की अवधि पांच वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति (अल्पकालिक संविदा सहित ) द्वारा नियुक्ति के लिए अधिकतम आयु सीमा, आवेदन प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

NOTIFICATION
New Delhi , the 23rd January, 2003
G. S. R. 48 (E) .-- In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession. of the Ministry of Tourism and Culture, Department of Culture, National Library, Kolkata, Director Group 'A' Posts Recruitment Rules, 2001 published in the Gazette of India vide GSR 159 (E) dated the 2nd March, 2001 , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules to regulate the method of recruitment to the post of Director , National Library, Kolkata in the Ministry of Tourism and Culture, Department of Culture , namely:-
1. Short title and commencement.- ( 1 ) These rules may be called the Ministry of Tourism and Culture, Department ofCulture, Director, National Library, Kolkata , Recruitment Rules , 2003 ..
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post, classification and scale of pay. The number ofpost , its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed hereto.
3. Method of recruitment , age limit , qualifications , etc. The method of recruitment to the said post, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .
4. Disqualifications . No person ,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who , having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .
5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, in consultation with the Union Public Service Commission, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. Nothing in these rules shall affect reservations, relaxation ofage limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government, from time to time , in this regard.
