नईदिल्ली, 24 जनवरी , 2003
का.आ. 70 ( म) .-केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48 ) ( जिसे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 क की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की । अधिसूचना संख्या का. आ. 238(अ ) , तारीख 27 फरवरी , 2002 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है ) में निम्नलिखित संशोधन करती है , अर्थात्:-
उक्त अधिसूचनामें,
(क) प्रस्तावना में, आरंभिक पैरा में, " तमिलनाडु राज्य में संख्या 46 कृष्णागिरी- रानीपेट खण्ड के बीच " अक्षरों, अंकों तथा शब्दोंके स्थान पर " तमिलनाडु राज्य में संख्या 4 चेन्नई रानीपेट खण्ड" अक्षर, अंक तथा शब्द रखे जाएंगे ।
(ख) अनुसूची में " तमिलनाडु राज्यमें " शब्दों के साथ आरंभ होने वाले तथा " भूमि का संक्षिप्त ब्यौरा " शब्दों के साथ समाप्त होने वाले भाग में" राष्ट्रीय राजमार्ग सं. 46 के कृष्णा गिरी रानीपेट खंड " शब्दों, अक्षरों और अंकों के स्थान पर " राष्ट्रीय राजमार्ग सं. 4 के चेन्नई रानीपेट खंड" शब्द, अक्षर और अंक रखे जाएंगे ।
2. उक्त अधिसूचना जो इस अधिसूचना द्वारा संशोधित है , में उल्लिखित भूमि में हितबद्ध कोई व्यक्ति, राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से इक्कीस दिन के भीतर उक्त अधिनियम की धारा उग की उप - धारा ( 1 ) के अधीन उक्त अधिसूचना में उल्लिखित प्रयोजन के लिए ऐसी भूमिके उपयोग पर आक्षेप कर सकेगा;
3. ऐसा प्रत्येक आक्षेप सक्षम प्राधिकारी को लिखित रूप में किया जाएगा और उसमें उसके आधार अभिकथित किए जाएंगे और सक्षम प्राधिकारी आक्षेपकर्ता को व्यक्तिगत रूप में या किसी विधि व्यवसायी द्वारा सुने जाने का अवसर देगा और ऐसे आक्षेपों की सुनवाई के पश्चात तथा ऐसी और जांच करने के पश्चात्, यदि कोई हो , जिसे सक्षम प्राधिकारी आवश्यक समझे, आदेश द्वारा या तो आक्षेपों को अनुज्ञात करेगा अथवा अननुज्ञात करेगा;
4. उक्त अधिनियम की धारा उग की उप धारा ( 2 ) के अधीन सक्षम प्राधिकारी द्वारा किया गया कोई आदेश अंतिम होगा;

[PART II-SBC. 3( ii)] 5. उक्त अधिसूचना जो इस अधिसूचना द्वारा संशोधित की गई है , के अधीन आने वाली भूमि के रेखांक और अन्य ब्यौरे उपलब्ध हैं और उनका सक्षम प्राधिकारी अर्थात् जिला राजस्व अधिकारी , जिला वेल्लोर, तमिलनाडु के कार्यालय में हितबद्ध व्यक्ति द्वारा निरीक्षण किया जा सकता है ।

New Delhi , the 24th January, 2003
S.O. 70 (E) . In exercise of the powers conferred by sub - section ( 1 ) of section 3A of the National Highways Act , 1956 (48 of 1956) ( hereinafter referred to as the said Act) , the Central Government hereby makes the following amendments inthe notification of the Government of India in the Ministry of Road Transport and Highways , number S. O. 238 (E ) , dated the 27th February, 2002 ( hereinafter referred to as the said notification), namely :-
In the said notification,-
(a) in the preamble , in the opening paragraph, for the letters, figures and words "No. 46 in the State ofTamil Nadubetween Krishnagiri -Ranipet Section " , the letters figure and words " No. 4 in the State of Tamil Nadu between Chennai-Ranipet Section" shall be substituted;
(b) in the Schedule , in the portion beginning with the words " Brief description of land" and ending with the words " in the State of Tamil Nadu " , for the words , letters and figures " Krishnagiri -Ranipet Section of National Highway No. 46" , the words , letters and figures " Chennai -Ranipet Section of National Highway No. 4" shall be substituted.
2. Any person interested in the land mentioned in the said notification, as amended by this notification, may, within twenty-one days from the date of publication of this notification in the Official Gazette , raise objection on the use of the land for the purpose mentioned in the said notification under sub- section ( 1 ) of section 3C of the said Act. 3. Every such objection shall be made to the competent authority in writing, and shall set out the grounds thereof andthe competent authority shall give the objector an opportunity ofbeing heard, either in person or by a legal practitioner andmay after hearing , all such objections and after making such further inquiry, if any, as the competent authority thinks necessary, by order, either allow or disallow the objection;
4. Any order made by the competent authority under sub - section (2) of section 3C of the said Act shall be final ; 5. The land plans and other details of lands covered under the said notification as amended by this notification are available and can be inspected by the interested person at the office of the competent authority i.e. the District Revenue Officer, DistrictVellore, Tamil Nadu.
