सा.का.नि. 64( अ ).- केन्द्र सरकार, महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 132 की उपधारा ( 1 ) के साथ पठिए धारा 124 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विशाखापट्टनम पत्तन न्यास के न्यासी मंडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में दर्शित विशाखापट्टनम पत्तन न्यास कर्मचारी ( सामान्य भविष्य निधि ) संशोधन विनियम, 2003.का अनुमोदन करती है । 2. ये विनियम इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।
अनुसूची
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 वां ) की धारा 28 के तहत प्रदत्त अधिकारों का प्रयोग करते हुए विशाखापट्टनम पोर्ट ट्रस्टकान्यासी मंडल विशाखापट्टनम पोर्ट कर्मचारी ( सा.भ.नि. ) विनियम, 1993 में आगे और संशोधन करते हुए और उक्त अधिनियम की धारा 124 के तहत केन्द्र सरकार के अनुमोदन की शर्त पर निम्नलिखित विनियम बनाता है :
1. लघु शीर्ष और प्रारम्भ:-
(क ) इन विनियमों को विशाखापट्टनम पोर्ट कर्मचारी सा.भ.नि. संशोधन विनियम, 2003 कहा जाएगा ।
(ख ) ये विनियम भारत के राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।
2. विनियम 2 ( 5 ) के अंतर्गत वर्तमान " नोट " को " नोट -1 " के रूप में पुनः अंकित किया जाए ।
३. उक्त अधिनियम के विनियम 2 ( 5 ) में निम्नलिखित को " नोट-2 " के रूप में जोड़ा जाए ।
'कर्मचारी के बच्चे अध्ययन के उद्देश्य से बाहर होने पर वह उक्त कर्मचारी के बच्चे कहलाने से प्रतिबंधित नहीं हो सकते जब तक प्रतिबंधित न हो , क्यों कि वह कुछ विशिष्ट अवधि के लिए ही माता- पिता से अस्थायी रूप से अलग रहते हैं । '
4. विनियम 4 में निम्नलिखित उप विनियम को जोड़ा जाए ।
" ये विनियम प्रारम्भ होने के बाद मंडल की सेवा में नियुक्त सभी अस्थायी कर्मचारी जो एक वर्ष या अधिक अवधि का लगातार सेवा की है वे इस निधि में चंदा देना होगा " ।

वर्तमान उप विनियम 2 एवं 3 को 3 एवं 4 के रूप में पुनर अंकित किया जाए ।

NOTIFICATION
New Delhi , the 27th January , 2003
G.S.R. 64 (E ) .-- In exercise of the powers conferred by Sub- Section (1 ) of Section 124, read with Sub-section ( 1 ) of Section 132 of the Major Port trusts Act, 1963 (38 of 1963 ), the Central Government hereby approves the Visakhapatnam Port Trust Employees (GPF ) Amendment Regulations , 2003 madeby the Board of Trustees of Visakhapatnam Port Trust as set out in the Schedule annexed to this Notification .
Gazette. 2. The said Regulations shall come into force from the date of publication of this Notification in the Official
SCHEDULE
In exercise of the powers conferred by Section 28 of the MPT Act, 1963 (Act of 38 of 1963 ) the Board of Trustees of the Port of Visakhapatnam hereby makes , the following Regulations further to amend the Visakhapatnam Port Employees ( GPF ) Regulations , 1993 subject to the approval ofthe central Govt. under Section 124 of the said Act .
1. Short Title and Commencement : -
( a ) These Regulations may be called Visakhapatnam Port Employees ( GPF ) amendment Regulations 2003 .
(b ) They shall come into force from the date of publication in the Gazette of India .
2. The existing Note ' under Regulation 2 ( 5 ) may be renumbered as Note- 1 ...
" 3. The following may be added as' Note - 2 ' under Regulation 2( 5 ) of the said Regulations .
When the Children of the employee are away for the purpose of studies , they cannot cease to be the children of the said employee , unless otherwise prohibited by law , because the children leave the association of the parents temporarily for a specific period . '
4. In Regulation 4 , the following sub - regulation may be added.
( 2) All the temporary employees appointed to the Board's service, after commencement of these Regulations , who have rendered continuous service of one year or more shall be required to subscribe to the Fund . ' The existing sub - regulations 2 & 3 will be renumbered as ' 3 & 4 ' .
