सा.का.नि. 65( अ ). राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तत्कालीन शहरी कार्य और रोजगार मंत्रालय (शहरी विकास विभाग), केन्द्रीय इंजीनियरी (सिविल) समूह 'क' सेवा नियम , 1996 का संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाते हैं अर्थात्ः-
1. (1) इन नियमों को शहरी कार्य और रोजगार मंत्रालय (शहरी विकास विभाग) केन्द्रीय इंजीनियरी (सिविल) समूह ' क' सेवा ( द्वितीय संशोधन) नियम, 2003 कहा जाएगा । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. शहरी कार्य और रोजगार मंत्रालय (शहरी विकास विभाग) केन्द्रीय इजीनियरी (सिविल) समूह 'क' सेवा नियम , 1996 ( जिन्हें यहाँ इसके बाद उक्त नियम कहा जाएगा) में :- नियम 7 में , खंड (iii) में, उप खंड (क) में 'मेरिट पर चयन' शब्दों के स्थान पर 'चयन' शब्द को प्रतिस्थापित किया जाएगा ।
3. अनुसूची II में. अधीक्षण अभियंता (सिविल) के पद से संबंधित क्रम सं. 2 के सामने कॉलम 3 मैं कोष्ठकों तथा शब्दों (चयन - सह- मेरिट)' के स्थान पर कोष्ठक तथा शब्द " (चयन)" को पतिस्थापित किया जाएगा ।
4. अनुसूची IV मे क्रम सं. 3 के कालम 13 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियाँ प्रतिस्थापित की जाएगी अर्थात्ः-
1. अध्यक्ष या सदस्य, संघ लोक सेवा आयोग- अध्यक्ष
2. निर्माण महानिदेशक या अपर निर्माण महानिदेशक सदस्य
3. अपर सचिव या संयुक्त सचिव , शहरी विकास और गरीबी उपशमन मंत्रालय- सदस्य

[PART II-SEC. 3(i )] टिप्पणी:-मूल नियम दिनांक 28 अक्तूबर, 1996 को सं. सा. का. नि. 500 (अ) द्वारा भारत के राजपत्र में प्रकाशित हुए थे । मूल नियम में किए गए संशोधनों को दिनांक 24 जनवरी , 2002 को सं. सा. का. नि. 107 (अ)द्वारा भारत के राजपत्र में अधिसूचित किया गया है ।

NOTIFICATION
New Delhi , the 24th January, 2003
G.S.R. 65(E ). In exercise of powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules amendment to the erstwhile Ministry of Urban Affairs and Employment (Department of Urban Development) , Central Engineering (Civil) Group 'A' Services Rules , 1996, namely: - 1. (1) These rules may be called the Ministry of Urban Affairs and Employment (Department of Urban Development) Central Engineering ( Civil ) Group 'A' Service ( Second Amendment) Rules , 2003 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Ministry of Urban Affairs and Employment (Department of Urban Development) Central Engineering (Civil ) Group 'A' Services Rules , 1996 (hereinafter referred to as the said rules); -
In rule 7, in clause ( iii ) , in sub clause (a) for the words ' Selection on merit' , the words " Selection " shall be substituted.
3. In Schedule II , against Sl.No.2 relating to the post of Superintending Engineer (Civil), in column 3 , for the brackets and words '(Selection- cum- merit ) ' the brackets and word " ( Selection) " shall be substituted.
4. In Schedule IV, against the entries at Sl . No. 3 in column 13 , for the entries the following entries shall be substituted, namely as under : -
Chairman 1. Chairman or Member , Union Public Service Commission
2. Director General of Works or Additional Director General
ofWorks
Member 3. Additional Secretary or Joint Secretary, Ministry of Urban Development and Poverty Alleviation
Member .
