सा.का.नि. 76( अ ). औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिसे औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 33 ढ की अपेक्षानुसार, भारत के राजपत्र असाधारण , भाग II , खंड 3 , उपखंड ( i ) तारीख 20 अगस्त, 2002 में सं ० सा ० का ० नि ० 607 ( अ ) द्वारा प्रकाशित किया गया था और ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, आक्षेप और सुझाव मांगे गए थे और सूचना दी गई थी कि उक्त प्रारूप पर उस तारीख से , जिसको इस अधिसूचना से युक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि के अवसान पर विचार किया जाएगा;
और उक्त राजपत्र तारीख 20 अगस्त, 2002 को जनता को उपलब्ध करा दिया गया था;
और उक्त प्रारूप के संबंध में, जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार ने विचार कर लिया है;
अतः अब, केन्द्रीय सरकार , उक्त अधिनियम की धारा 33 ढ द्वारा प्रदत्त शक्तियों का प्रयोग हुए, औषधि और प्रसाधन सामग्री नियम, 1945 में निम्नलिखित और संशोधन करती है , अर्थात्:-
1. (1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री प्रथम ( संशोधन ) नियम , 2003 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम, 1945 में, -
( क ) नियम 162 के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्: -
" 162 क- आयुर्वेद, सिद्ध और यूनानी औषधि के अनुज्ञापन के लिए राज्य औषधि अनुज्ञापन प्राधिकारी के लिए अर्हताएं:

[PART II- SEC . 3 ( i ) | (क) भारतीय चिकित्सा केन्द्रीय परिषद् अधिनियम, 1970 की द्वितीय अनुसूची के अनुसार आयुर्वेद/सिद्ध/ यूनानी अर्हताएं/किसी मान्यताप्राप्त विश्वविद्यालय से बी. फार्मा ( आयुर्वेद ) ।
(ख) आयुर्वेद/सिद्ध/यूनानी औषधि विनिर्माण या आयुर्वेदिक, सिद्ध और यूनानी औपधियों के परीक्षण या औषधि और प्रसाधन सामग्री अधिनियम के अध्याय 4 क और तद्दीन बनाए गए नियमों के उपबंधों के प्रवर्तन या आयुर्वेद/ सिद्ध/ यूनानी पद्धति की रोगलक्षण ...पद्धति के शिक्षण/अनुसंधान में कम से कम पांच वर्ष का अनुभव" ।

एल. प्रसाद, संयुक्त सचिव ( आई एस एम एंड एच ) पाद टिप्पणः-1-5-1979 तक यथा संशोधित औषधि और प्रसाधन सामग्री नियम , 1945 स्वास्थ्यऔर परिवार कल्याण मन्त्रालय (स्वास्थ्यविभाग ) के उस प्रकाशन में अंतर्विष्ट हैं जिसमें औषधि औरप्रसाधन अधिनियम, 1940 और नियम (पी डी जी एच एस -61 ) सम्मिलित हैं *तथा जिसमें अंतिम संशोधन सा.का.नि. 648 ( E ) तारीख16-9-02 द्वारा किया गया है ।

New Delhi , the 3rd February, 2003
G.S.R. 76 ( E) . Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules . 1945 was published as required by Section 3.3N of the Drugs and Cosmetics Act . 1940 (23 of 1940) in the Gazette of India Extraordinary Part II , Section 3, Sub - section ( i ) , dated the 20th August . 2002 vide No. GSR 607 (E ) inviting objections and suggestions from persons likely to be affected thereby and notice was given that the said draft will be taken into consideration after the expiry ofa period of forty - five days from the date on which copics of the Official Gazette containing the notification were made available to the public:
Andwhereas the said Gazette was made available to the public on 20th August , 2002 ;
Andwhereas objections and suggestion from the public on the said draft have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Section 33 - N of the said Act , the Central Government hereby makes the following further amendments in the Drugs and Cosmetics Rules, 1945 , namely:-
1. ( 1 ) These rules may be called the Drugs and Cosmetics Ist ( Amendment ) Rules , 2003 .
(2) . They shall come into force on the date of their publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945 .
(a ) after rule 162, the following shall be inserted, namely :
"162A - Qualifications for State Drug Licensing Authority for licensing of Ayurveda, Siddha and Unani drugs:
(a) TheAyurvedic/ Siddha/Unani qualifications as per Schedule II of CCIM Act 1970 / B.Pharma ( Ayurveda ) of a recognized University.
(b) At least 5 years experience in the Ayurveda/Siddha/Unani drug manufacturing or testing of Ayurvedic . Siddha and Unani drugs or enforcement of provisions of Chapter IVA ofthe Drugs and Cosmetics Act 1940 and rules made thereunder or teaching/research on clinical practice of Ayurveda/ Siddha /Unani System" .
