का.आ. 119 ( अ ) .- जबकि 19,93,764.91 रुपये ( उन्नीस लाख तिरानवे हजार सात सौ चौसठ रुपये तथा इकानवे पैसा मात्र) जमा ग्रामोद्योग ऋण पर 4 प्रतिशत ब्याज ब्रिज ग्राम सेवा मण्डल, एक पंजीकृत समिति जिसका पंजीकृत कार्यालय तिलक द्वार , मथुरा (उत्तर प्रदेश ) है , द्वारा खादी और ग्रामोद्योग आयोग (इसके पश्चात् उक्त आयोग कहा गया ) को देय है ।
जबकि , खादी और ग्रामोद्योग आयोग नियमावली 1957 (इसके पश्चात उक्त नियमावली कहा गया ) के नियम 25 -क के उप- नियम (i ) के अन्तर्गत यथा अपेक्षित उक्त आयोग ने उक्त समिति को 8 अप्रैल , 1971 को यह आदेश देते हुये कारण बताओं नोटिस दिया कि उक्त नोटिस की प्राप्ति के तीस दिनों के भीतर उक्त आयोग की राशि उन्नीस लाख तिरानवे हंजार सात सौ चौसठ रूपये तथा इकानवे पैसा का भुगतान करें, ऐसा न करने पर उक्त आयोग खादी और ग्रामोद्योग आयोग , नियमावली, 1957 के नियम 25 के साथ पठित , खादी और ग्रामोद्योग अधिनियम , 1956 ( 1956 का 61 ) की धारा 19 ख के अन्तर्गत भूमि राजस्व के बकाया के रूप में उस वसूलने की कार्यवाही करेगा । जबकि , उक्त ब्रिज ग्राम सेवा मण्डल ने आयोग को 19,93,76.91 रुपये ( उन्नीस लाख तिरानवे हजार सात सौ चौसठ रूपये तथा इकानवे पैसा) की राशि के भुगतान की अपनी देनदारी विवादास्पद कर रखी है , ने आयोग के मुख्य कार्यकारी अधिकारी को अभ्यावेदन दिया कि आयोग के मामले को उक्त नियमावली के नियम 25 क तथा 25ख के साथ पठित खादी और ग्रामोद्योग आयोग अधिनियम 1956 की धारा 19 ख के संदर्भ में नोटिस में मांगी गई राशि का भुगतान करने के उत्तरदायित्व से मना करने की स्थिति में निर्णय लेने तथा निर्धारित करने के लये एक ट्रिब्यूनल गठित करने हेतु केन्द्रीय सरकार को भेज दिया जाये ।

[PART II-SEC. 3(ii)) अब , इसलिये , उक्त नियमावली के नियम 25 ख के साथ पठित खादी और ग्रामोद्योग आयोग अधिनियम , 1956 (1956 का 61 ) की धारा 19 ख द्वारा प्रदत्त शाक्तियों का प्रयोग करते हुये केन्द्रीय सरकार एत्द द्वारा एक व्यक्ति , नामतः श्री एस . के. मुखर्जी, निदेशक , लघु उद्योग मंत्रालय , उद्योग भवन , नई दिल्ली-110011 को शामिल करते हुये एक ट्रिब्यूनल गठित करती है तथा उक्त अधिनियम की धारा 19 ख की उप- धारा (i ) के अर्थ (परिभाषा) के भीतर उक्त आयोग को ब्रिज ग्राम सेवा मण्डल , तिलक द्वार , मथुरा , उत्तर प्रदेश द्वारा देय का भुगतान करने के बारे में निर्णय लेने के लये विवाद के प्रश्न को उक्त ट्रिब्यूनल को सौंपती है ।
ट्रिब्यूनल अपनी रिपोर्ट केन्द्रीय सरकार को यथाशीघ्र प्रस्तुत करेगा लेकिन इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से 90 दिनों के भीतर , बाद में नहीं । ट्रिब्यूनल का मुख्यालय नई दिल्ली में होगा ।
यह मंत्री ( कृषि एवं ग्रामीण उद्योग मंत्रालय ) के अनुमोदन से जारी किया जा रहा है ।

NOTIFICATION
New Delhi , the 29th January, 2003
S.O. 119 ( E) .- Whereas a sum of Rs . 19,93,764.91 ( rupees nineteen lakh ninety three thousand seven hundred sixty four and ninety one paises only) plus 4 percent interest on Village Industries loan is payable by the Brij Gram Seva Mandal , a Registered Society having its registered Office at Tilak Dwar , Mathura ( Uttar Pradesh) to the Khadi and Village Industries Commission (hereinafter referred to as the said Commission ) ;
And whereas , as required under sub - rule ( i) of rule 25 A of the Khadi and Village Industries Commission Rules , 1957 ( hereinafter referred to as the said rules) the said Commission caused notice dated the 8th April , 1971 served on the said society directing them to pay the said sum of rupees nineteen lakh ninety three thousand seven hundred sixty four and ninety one paises to the said Commission within thirty days from the receipt of the said notice failing which the said Commission will proceed to recover the same as arrears of land revenue under section 19B of the Khadi and Village Industries Commission 3

Act , 1956 ( 61 of 1956) read with rule 25A of the Khadi and Village Industries Commission Rules , 1957 ;
And whereas, the said Brij Gram Seva Mandal has disputed its liability to pay the said sum of Rs . 19,93,764.91 (rupees nineteen lakh ninety three thousand seven hundred sixty four and ninety one paises only) to the said Commission , represented to the Chief Executive Officer of the Commission that the case of the Commission may be referred to the Central Government for constitution of a Tribunal to decide and determine as to denial of liability to pay the amount as demanded under notice in terms of section 19B of the Khadi and Village Industries Commission Act, 1956 , read with rules 25A and 25B of the said rules ;
Now , therefore , in exercise of the powers conferred by section 19B of the Khadi and Village Industries Commission Act , 1956 (61 of 1956) read with rule 25B of the said rules , the Central Government hereby constitutes a Tribunal consisting of one person , namely , Shri S.K. Mukherjee, Director , Ministry of Small Scale Industries , Udyog Bhavan , New Delhi 110011 and refers the question of dispute to the said Tribunal for deciding about the payment of dues by the Brij Gram Seva Mandal , Tilak Dwar , Mathura , Uttar Pradesh to the said Commission within the meaning of sub - section ( 1 ) of section 19B of the said Act .
The Tribunal shall submit its report to the Central Government as soon as possible not later than ninety days from the date of publication of this notification in the Official Gazette . The headquarters of the Tribunal shall be at New Delhi .
This has the approval of Minister of Agro and Rural Industries .
