सा.का.नि. 83( अ ).- केन्द्रीय मोटर यान नियम , 1989 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप , मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 212 की उपधारा ( 1 ) की अपेक्षानुसार भारत के राजपत्र, असाधारण, भाग 2, खंड 3 , उपखंड (i ) ; तारीख 11 अक्तूबर, 2002 में भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं० सा०का०नि० 702(अ), तारीख 11 अक्तूबर, 2002 द्वारा प्रकाशित किया गया था, जिसमें ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से, जिसको भारत के उस राजपत्र की प्रतियां, जिसमें यह अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थीं, पैंतालिस दिन की अवधि के भीतर आक्षेप या सुझाव आमंत्रित किए गए थे ;
और उक्त राजपत्र की प्रतियां जनता को तारीख 17 अक्तूबर, 2002 को उपलब्ध करा दी गई थीं ;
और केन्द्रीय सरकार ने जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया है ;

अतः , अब , केन्द्रीय सरकार उक्त अधिनियम की धारा 64 के खंड (क) और धारा 110 की उपधारा ( 1 ) के खंड (छ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय मोटर यान नियम, 1989 में निम्नलिखित और संशोधन करती है, अर्थात्:--

[PART II-SEC. 3(1 ) ] 1. (1) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान ( पहला संशोधन) नियम, 2003
है ।
(2) ये इन नियमों में जैसा अन्यथा उपबंधित है, उसके सिबाय, राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय मोटर यान नियम, 1989 में,-
(1) नियम 47 के उपनियम ( 1 ) में खंड (ज) के स्थान पर निम्नलिखित खंड रखा
जाएगा, अर्थात्: --
" (ज) आयातित यानों की दशा में, अनुज्ञप्ति और बंधपत्र, यदि कोई हो, के साथ सीमा शुल्क निकासी प्रमाणपत्र :
परन्तु यात्री सामान नियम, 1998 के अधीन आयातित यानों से भिन्न, आयातित यानों की दशा में, रजिस्ट्रीकरण प्राधिकारी द्वारा अनुसरण की जाने वाली प्रक्रिया वही होगी जिसका भारत में विनिर्मित यानों के रजिस्ट्रीकरण के लिए अनुसरण किया जाता है, और " ;
(2) नियम 115क में, -
(i) उपनियम (4) में, " कृषि ट्रैक्टर और संन्निर्माण उपस्कर यान " शब्दों के स्थान पर " संन्निर्माण उपस्कर यान" शब्द रखे जाएंगे ;
यह उपबंध 1 जून, 2003 को प्रवृत्त होगा ।
(ii) उपनियम (4) के पश्चात्, निम्नलिखित उपनियम अंतःस्थापित किया
जाएगा, अर्थात्: --
" (5) प्रत्येक डीजल चालित कृषि ट्रैक्टर उसके विनिर्माता द्वारा इस प्रकार विनिर्मित और उत्पादित किया जाएगा कि जब उसका आईएसओ 8178 4'सी 1'8 रीति चक्र में वर्णित प्रक्रिया के अनुसार परीक्षण किया जाता है तो, वह उसके द्वारा उत्सर्जित गैस युक्त प्रदूषकों के निम्नलिखित मानकों का, उपनियम (2) में यथाउपबंधित दृश्यमान प्रदूषकों के अतिरिक्त अनुपालन करता है, अर्थात्:-
परीक्षण के दौरान उत्सर्जित कार्बन मोनोआक्साइड (सीओ) , हाइड्रोकार्बन (एचसी) तथा नाइट्रोजन के आक्साइड (एनओएक्स) और विविक्त द्रव्य (पीएम) भारत को राजपत्र असाधारण

के भारित औसत द्रव्यमान ग्राम प्रति किलोवाट घंटों में किस्म अनुमोदन (टीए) और उत्पादन अनुरूपता (सीओपी) परीक्षणों के लिए नीचे सारणी में दी गई सीमाओं से अधिक नहीं होगा, अर्थात्:-

NOTIFICATION
New Delhi, the 5th February, 2003
G.S.R. 83 (E). Whearas the draft of certain rules further to amend the Central Motor Venicies Rules , 1989, were published as required by sub- section ( 1 ) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988) , in the Gazette of India, Extraordinary , Part-II , Section 3 , Sub-section ( i ) , dated the 11th October , 2002 vide notification of Govemment of India in the Ministry of Road Transport and Highways number G.S.R. 702 ( E) , dated the 11th October , 2002, inviting objections or suggestions from all persons likely to be affected thereby within a period of forty five days from the date on which copies of the Gazette of India , in which the said notification was published , were made available to the public;
And whereas the copies of the said Gazette were made available to the public on the 17th October , 2002;
And whereas the objections and suggestions received from the public have beenconsidered by the Central Govemment ;
Now, therefore, in exercise of the powers conferred by clause (a ) of section 64 and clause (g) of sub-section ( 1 ) of section 110 of the said Act , the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989 , namely: -
1. ( 1 ) These rules may be called the Central Motor Vehicles ( First Amendment) Rules, 2003.
(2) They shall come into force on the date of their publication in the Official Gazette, save as otherwise provided in these rules.
2. In the Central Motor Vehicles Rules , 1989 , -
(1 ) in rule 47 , in sub - rule ( 1 ) , for clause ( h ) , the following clause shall be substituted, namely:-
"(h) Custom'sclearance certificate in the case of imported vehicles along with the licence and bond, if any:
Provided that in the case of imported vehicles other than those imported under the Baggage Rules , 1998 , the procedure followed by the registering authority shall be same as those procedure followed for registering of vehicles manufactured inIndia , and" ;
(2) in rule 115A , -
(i) in sub- rule (4) , for the words , "agriculture tractor and constuction equipment vehicles " , the words " construction equipment vehicles " shall be substituted;
This provision shall come into force on 1st June, 2003.

(ii ) after sub- rule (4) , the following sub- rule shail be inserted , namely: -
"
(5) Every diesel driven agriculture tractor shall be so manufactured and produced by the manufacturer that it complies with the following standards of gaseous pollutants emitted by them in addition to those of visible pollutants as provided in sub- rule (2) when tested as per the procedure described in ISO 8178-4 ' C1 ' 8 mode cycle , namely:-
The weighted average Mass of Carbon Monoxide (CO) , Hydrocarbon (HC) and oxides of nitrogen ( NOx) , and Particulate Matters (PM ) in gram per kilo watthour emitted during the test shall not exceed the limits given below in the Table for Type Approval (TA) and Conformity of Production (COP) tests, namely:-
