सा.का.नि. 101 ( अ ).- खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार खाद्य अपमिश्रण निवारण अधिनियम , 1954 ( 1954 का 37 ) की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात् बनाना चाहती है उक्त अधिनियम की धारा 23 की उक्त उपधारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकरी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको उस राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती हैं, साठ दिन की अवधिके अवसान के पश्चात्, विचार किया जाएगा;
जासकेंगे । आक्षेप या सुझाव, यदि कोई हों, सचिव, स्वास्थ्य और परिवार कल्याण मंत्रालय भारत सरकार, निर्माण भवन , नई दिल्ली -110011 को भेजे ऐसे आक्षेप या सुझाव पर, जो उक्त प्रारूप नियमों की बाबत इस प्रकार विनिर्दिष्ट अवधि के अवसान से पूर्व प्राप्त हो सकेंगे, केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूपनियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण ( संशोधन ) नियम, 2003 है ।
(2) ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खाद्य अपमिश्रण निवारण नियम 1955 में,-
) नियम 13 के उपनियम ( 1 ) के परन्तुक में " आठ वर्ष की आयु से ऊपर की " शब्दों का लोप किया जाएगा ।

(ii ) नियम 51 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्-
" 51 अनुज्ञप्तियों की अवधि- कोई अनुज्ञप्ति जब तक कि शीघ्र निलंबित या रद्द न कर दी जाए, पांच साल की अवधि के लिए याऐसी कालावधि के लिए जो राज्य सरकार विहित करे प्रवृत्त रहेगी ।

[PART II-SEC. 3( 1 ) ] परन्तु अनुज्ञप्तिधारी , अनुज्ञप्ति की विधिमान्यता की समाप्ति के न्यूनतम तीन मास पूर्व नयी अनुज्ञप्ति के लिए आवेदन करेगा और अनुज्ञापन प्राधिकारी प्रवृत्त अनुज्ञप्ति की विधि मान्यता की अवधि की समाप्ति से पूर्व, आवेदन पर आदेश पारित करेगा ।
3. खाद्य अपमिश्रण निवारण नियम, 1955 के परिशिष्ट ' क' में, प्ररूप 8 के पश्चात् निम्नलिखित प्ररूप अन्तःस्थापित किया जाएगा, अर्थात्ः-

(ऐसे विक्रेता और या व्यक्ति ( यों ) का नाम और पता जिसका नाम, पता और अन्य विशिष्टियां, यदि कोई हो, धारा 14- क के अधीन प्रकट की गई हैं )
---पर स्थित आपके परिसर से नीचे विनिर्दिष्ट खाद्य के नमूने लिए गए हैं , उन्हें लोक विश्लेषक द्वारा विश्लेषित किया गया है, उन्हे खाद्य अपमिश्रण निवारण अधिनियम , 1954 और उनके अधीन बनाए गए नियमों के उपबंधों के अनुरूप पाया गया है ।

12-9-1955 द्वारा प्रकाशित किए टिप्पणः - खाद्य अपमिश्रण निवारण नियम, 1955 भारत के राजपत्र भाग 2, खंड 3, में का० नि० आ० 2105, तारीख गए थे और सा ० का ०नि० सं० 853 ( अ ) तारीख 30-12-02 द्वारा अंतिम बार संशोधित किए गए थे ।

NOTIFICATION
New Delhi, the 11th February, 2003
G.S.R. 101 ( E) .-The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955 , which the Central Government , after consultation with the Central Committee for Food Standards , proposes to make , in exercise of the powers conferred by sub - section ( 1 ) of section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954 ) , is hereby published as required by said sub - section of section 23 of the said Act for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules will be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette of India in which this notification is published are made available to the public;
Objection or suggestions , if any , may be addressed to the Secretary, Ministry of Health and Family Welfare , Government of India , Nirman Bhavan, New Delhi - 110011 .
The objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be considered by the Central Government ;
DRAFT RULES
1. ( 1 ) These rules may be called the prevention of Food Adulteration (Amendment) Rules , 2002.
(2) They shall come into force on the date of their Final publication in the Official Gazette .

2. In the Prevention of Food Adulteration Rules , 1955 ,
(i) In Rule 13 , in proviso to sub - rule ( 1 ) , the words " above the age of eight years " , shall be omitted.
(ii) For Rule 51 , the following rule shall be substituted, namely:-
"51 Duration of Licences- A licence shall unless sooner suspended or cancelled, be in force for a period of five years or for such period as the State Government may prescribe :
Provided that the licensee shall make an application for a fresh licence minimum three months before the expiry of the period of validity of the licence and the licensing authority shall pass orders on the application before the expiry period ofvalidity of the licence in force .
3. In Appendix 'A ' of the Prevention of Food Adulteration Rules , 1955 , after FORM VIII , the following FORM shall be inserted namely:-

to have the Whereas sample of food specified below taken from your premises situated at same analysed by the Public Analyst, has been found to be conforming to the provisions of the Prevention of Food Adulteration Act, 1954 and rules made thereunder.
