सं. 5/2003-केन्द्रीय उत्पाद शुल्क
सा.का.नि. 104( अ ).-केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क अधिनियम, 1944 ( 1944 का 1 ) की धारा ऽक की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि ऐसा करना लोकहित में आवश्यक है, ये निर्देश देती है कि इससे उपाबद्ध सारणी के स्तंभ (2 ) में विनिर्दिष्ट भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग) की प्रत्येक अधिसूचनाओं का, उन बातों के सिवाय , जिन्हें ऐसे संशोधन से पूर्व किया गया है या करने से लोप किया गया है , उक्त सारणी के स्तंभ (3) की तत्स्थानी प्रविष्टि में विनिर्दिष्ट रीति में और संशोधन किया जाएगा ।

उक्त अधिसूचना में , दूसरे पैरा के खंड (ख ) में निम्नलिखित परन्तुक जोडा जाएगा, अर्थातः- 39/ 2001 - केन्द्रीय उत्पाद शुल्क, तारीख 31 जुलाई , 2001
" परन्तु ऐसा प्रतिदाय चालू खाते से संदत्त शुल्क की उस रकम से अधिक नहीं होगा, जो इस अधिसूचना के अधीन निकासी किए गए माल के विनिर्माणा में या उसके संबंध में प्रयुक्त निवेश पर संदत्त शुल्क की बाबत प्राप्त सेनवेट प्रत्यय की रकम को घटाकर प्राप्त की गई हों ।" ;

उक्त अधिसूचना में, दूसरे पैरा के खंड ( ख) में निम्नलिखित परन्तुक जोडा जाएगा, अर्थातः- 56/ 2002-केन्द्रीय शुल्क, तारीख 14 नवम्बर , उत्पाद 2002
" परन्तु ऐसा प्रतिदाय चालू खाते से संदत्त शुल्क की उस रकम से अधिक नहीं होगा, जो इस अधिसूचना के अधीन निकासी किए गए माल के विनिर्माचा में या उसके संबंध में प्रयुक्त निवेश पर संदत्त शुल्क की बाबत प्राप्त सेनवेट प्रत्यय की रकम को पटाकर प्राप्त की गई हों ।" ;

3 मूल अधिसूचना सं ० 57 / 2002- केन्द्रीय उत्पाद शुल्क तारीख 14 नवम्बर, 2002 [ सा० का० नि० 76 ( अ) , तारीख 14 नवम्बर, 2002 ] द्वारा भारत के राजपत्र, असाधारण द्वारा प्रकाशित की गई थी ।

New Delhi , the 13th February, 2003 No. 5/2003-Central - Excise
G.S.R. 104 ( E) . In exercise of the powers conferred by sub - section ( 1 ) of section 5A of the Central Excise Act, 1944 ( 1 of 1944 the Central Government being satisfied that it is necessary in the public interest so to do , hereby that each of the notifications of the Government of India , in the erstwhile Ministry of Finance ( Department of Revenue ) , specified in column ( 2 ) of the table hereto annexed shall be further amended , except as respects things done or omitted to be done before such amendment, in the manner specified in the corresponding entry in column (3 ) of the said table .

सा.का.नि. 105( अ ).-केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क अधिनियम, 1944 ( 1944 का 1 ) की धारा 37 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय मूल्यवर्धित कर प्रत्यय नियम, 2002 नियम, 2002 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थातः-
1.. (1) इन नियमों का संक्षिप्त नाम केन्द्रीय मूल्यवर्धित कर प्रत्यय (संशोधन) , नियम, 2003 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय मूल्यवर्धित कर प्रत्यय नियम, 2002 में, नियम 3 के उपनियम (3) के पश्चात् निम्नलिखित परन्तुक अंतः स्थापित किया जाएगा, अर्थातः-
" परंतु यह और कि अधिसूचना सं0 39/2001-केन्द्रीय उत्पाद शुल्क, तारीख 31 जुलाई, 2001 [ सा०का०नि० 565 (अ), तारीख 31 जुलाई, 2001 ], 56/2002- केन्द्रीय उत्पाद शुल्क, तारीख 14 नवम्बर, 2002 [ सा०का० नि० 764 (अ) , तारीख 14 नवम्बर, 2002] तथा 57/2002- केन्द्रीय उत्पाद शुल्क , तारीख 14 नवम्बर, 2002 [ सा0 का0 नि0 765 (अ) , तारीख 14 नवम्बर, 2002 ] के अधीन छूट प्राप्त करने के पश्चात् निकासी किए गए अतिम उत्पादों के विनिर्माण में प्रयुक्त निवेशों पर संदत्त शुल्क का सेनषेट प्रत्यय केवल उन अंतिम उत्पादों पर शुल्क, के संदाय के लिए उपयोग में लाया जाएगा; जिन पर क्रमशअधिसूचना सं. 39 /2001 - केन्द्रीय उत्पाद शुल्क, तारीख 31 जुलाई, 2001, 56/2002- केन्द्रीय उत्पाद शुल्क, तारीख 14 नवम्बर, 2002 तथा 57/20 केन्द्रीय उत्पाद शुल्क, तारीख 14 नवम्बर 2002 के अधीन छूट प्राप्त की गईथी, "

G.S.R. 105 (E ) .-- In exercise of the powers conferred by Section 37 of the Central Excise Act, 1944 (1 of 1944), the Central Government hereby makes the following rules further to amend the CENVAT Credit Rules , 2002, namely:- :
1. (1) these rules may be called the CENVAT Credit ( Amendment) Rules , 2003 .
(2) They shall come into force on the date of their publication in the. Official Gazette .
2. In the CENVAT Credit Rules , 2002, in rule 3 , in sub-rule (3) , after the proviso, the following Proviso shall be inserted, namely: -
"Provided further that the CENVAT credit of the duty paid on the inputs used in the manufacture of final products cleared after availing of the exemption. under the notifications number 39/2001 -Central Excise , dated the 31 July , 2001 [ G.S.R. 565 (E) dated the 31 July, 2001 ] , 56/2002- Central Excise dated the 14th November , 2002 [G.S.R. 764 (E) dated the 14th November, 2002] and 57/2002-Central Excise dated the 14th November , 2002 [ G.S.R. 765 (E) dated the 14th November , 2002 ] , shall respectively be utilized only for payment of duty on final products , in respect of which exemption under the said notifications number 39/2001 - Central Excise , dated the 31 July, 2001 , 56/2002-Central Excise dated the 14th November , 57/2002- Central Excise dated the 14th November, 2002, is availed.
