सा.का.नि. 107(अ) - केन्द्रीय सरकार, कोयला खान भविष्य निधि और प्रकीर्ण उपबंध अधिनियम, 1948 (1948 का 46) की धारा 7 के साथ पठित धारा उङ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कोयला खान पेंशन स्कीम, 1998 में निम्नलिखित और संशोधन करती है, अर्थात्:-
1. (1) इस स्कीम का संक्षिप्त नाम कोयला खान पेंशन (संशोधन) स्कीम, 2003 है ।
(2) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगी ।
2. कोयला खान पेंशन स्कीम, 1998 के पैरा 3(च) में "उपपैरा (2) और (4) के परन्तुक के उपबंधों के" शब्दों, कोष्ठकों और अंकों को हटा दिया जाएगा ।
3. कोयला खान पेंशन स्कीम, 1998 के पैरा 4 में, उपपैस 4क के पश्चात् निम्नलिखित उपपैरा अंतःस्थापित किए जाएंगे, अर्थात्:-
"(5) कोई ऐसा कर्मचारी, जो केन्द्रीय कोयला क्षेत्र लिमिटेड कर्मचारिवृंद भविष्य निधि, दरभंगा हाउस, रांची, जिसे इसमें इसके पश्चात् सीसीएलएसपीएफ कहा गया है या कोयला खान प्राधिकरण लिमिटेड कर्मचारिवृंद भविष्य निधि, जो कोयला खान राष्ट्रीयकरण भविष्य निधि नियम, 1976 के अधीन गठित की गई थी, जिसे इसमें इसके पश्चात् सीएमएएलएसपीएफ कहा 412 G1/2003

[PART II SEC. 3(1 )] गया है, का सदस्य था, 1 अप्रैल, 1994 को या उसके पश्चात् सेवानिवृत्त हुआ है या अधिवर्षिता प्राप्त की है या कोयला खान भविष्य निधि का सदस्य हो गया है, उसे इस स्कीम का सदस्य हुआ समझा जाएगा और वह उसी तारीख से, अधिवर्षिता की तारीख के अनुसरण में या अधिवर्षिता प्राप्त सदस्यों की बाबत या 7 अक्तूबर, 2002 को या उससे पूर्व सेवानिवृत्त हो जाने पर और अन्य सदस्यों की बाबत 8 अक्तूबर, 2002 से इस स्कीम के उपबंधों के अनुसार पेंशन लेने के पात्र होंगे :
परन्तु कर्मचारी या भूतपूर्व कर्मचारी या कुटुम्ब ( किसी भूतपूर्व कर्मचारी की मृत्यु की दशा में) पैरा 3 के खंड (ख) , (ग) , (घ), (ङ) और (च) में विनिर्दिष्ट रकम के समतुल्य बकाया 1 मार्च, 1971 या सेवा ग्रहण करने की तारीख, जो भी बाद में हो से 7 अक्तूबर, 2002 तक ब्याज सहित पेंशन निधि में उन सदस्यों की बाबत , जिन्होंने अपने भविष्य निधि संचयन को वापस नहीं लिया है, ऐसी रकम अपनी भविष्य निधि संचयन के अंतरण को प्राधिकृत करेगा और अन्य सदस्यों की दशा में मांगपत्र द्वारा जमा करेगा ।
टिप्पण- इस पैरा के प्रयोजन के लिए, -
(i) इस पैरा के अधीन समझे गए सदस्य का विकल्प होगा कि वह इस स्कीम में संयोजित न हो , इसके लिए वह इस अधिसूचना के प्रकाशन की तारीख से एक वर्ष के भीतर लिखित में आयुक्त को सूचित करेगा । एक बार दिया गया विकल्प अंतिम होगा ।
(ii) पैरा 3 के खंड (ख) में विनिर्दिष्ट रकम पर ब्याज कोयला खान भविष्य निधि सदस्यों को अनुज्ञेश्य दूर होगी, पैरा 3 के खंड (ग) और (घ) के लिए 12 % प्रतिवर्ष की दर और पैरा 3 के खंड (ङ) के अधीन रकमों पर उस दर पर, जो केन्द्रीय सरकार द्वारा समय - समय पर नियत की जाए , कोयला खान कुटुम्ब पेंशन स्कीम, 1971 में उसके अंशदान पर ब्याज 31.03.1998 तक और 01.04.1998 से 8.5% की दर पर जमा की जाएगी ।
(iii) पेंशन योग्य सेवा की गणना पैरा 2 (ण) के अनुसार यह मानकर की जाएगी कि वे , यथास्थिति, बंद हुई कोयला खान कुटुम्ब पेंशन स्कीम , 1971 या कोयला खान पेंशन स्कीम, 1998 के सदस्य 01.03.1971 से या सीएमएएलएसपीएफ या सीसीएलएसपीएफ में संयोजित होने की तारीख से 7 अक्तूबर, 2002 तक जो भी बाद में हो, या, यथास्थिति, अधिवर्षिता की तारीख या सेवानिवृत्ति की तारीख तक के सदस्य थे । 3

कोयला खान पेंशन स्कीम, 1998 अधिसूचना सं० सा० का०नि० सं० 123 (अ) , तारीख 5 माच, 1998 द्वारा प्रकाशित की गई थी और पश्चात्वर्ती संशोधन निम्नलिखित सं ० द्वारा हुए :-

2. सा0का0नि0 218 (अ) , तारीख 22 मार्च, 1999

स्पष्टीकारक ज्ञापन
कोयला खान भविष्य निधि और प्रकीण उपबंध अधिनियम, 1948 (1948 का 46) की धारा 7 , केन्द्रीय सरकार को इस अधिनियम के अधीन विरचित किसी स्कीम को भविष्य लक्षी या भूतलक्षी प्रभाव से वर्धित , संशोधित या परिवर्तित करने के लिए सशक्त करती है ।
कोयला खान पेंशन स्कीम, 1998 31 मार्च, 1998 से प्रवृत्त हुई थी । कोयला खान प्राधिकरण लिमिटेड कर्मचारिवृंद भविष्य निधि और केन्द्रीय कोयला क्षेत्र लिमिटेड कर्मचारिवृंद भविष्य निधि के वे सदस्य जो 8 अक्तूबर, 2002 को सेवा में थे अधिसूचना सं ० सा०का०नि० 687 (अ) , तारीख 8.10.2002 के अनुसार 8.10.2002 से कोयला खान भविष्य निधि के सदस्य हो गए हैं । कोयला खान भविष्य निधि न्यासी बोर्ड ने तारीख 9.8.2001 को अपने 133वें अधिवेशन में कार्यसूची मद सं0 16 के अधीन यह सिफारिश की थी कि कोयला न भविष्य निधि के वे सदस्य जो कोयला खान कुटुम्ब पेंशन स्कीम के अधीन कुटुम्ब पेंशन स्कीम के सदस्य नहीं THE GAZETTE OF INDIA : EXTRAORDINARY
PART II Sac. 341 थे, किन्तु तारी 1.4.94 से 31.3.1996 के बीच सेवा से निकाले गए थे, कोयला खान पेंशन स्कीम, 1998 में भाग लेने के लिए विकल्प देने के लिए भी अनुज्ञात किए जा सकेंगे । यह विकल्प केन्द्रीय कोयला क्षेत्र लिमिटेड कर्मचारिवृंद भविष्य निधि स्कीम, 1998 और कोयला खान प्राधिकरण लिमिटेड कर्मचारिवृंद भविष्य निधि के सदस्यों और उनको, जिन्हें अधिसूचना स० सा०का०नि० 687(अ), तारीख 8.10.2002 से कोयला खान भविष्य निधि का सदस्य समझा गया है को भी यह विकल्प विस्तारित किया जाएगा । कोयला खान भविष्य निधि के ऐसे सदस्य, जो कोयला खान कुटुम्ब पेंशन स्कीम, 1971 के सदस्य नहीं थे, तारीख 1.4.1994 से 31.3.1998 के बीच अधिवर्षिता को प्राप्त हुए हैं और जिन्होंने अधिसूचना सं० सा०का०नि० 482(अ) , तारीख 8 जुलाई, 2002 द्वारा इस आशय का पहले ही विकल्प दे दिया है । यह प्रस्तावित संशोधन ऐसे फायदों को कोयला खान प्राधिकरण लिमिटेड कर्मचारिवृंद भविष्य निधि और केन्द्रीय कोयला क्षेत्र लिमिटेड कर्मचास्वृिंद भविष्य निधि के उन भूतपूर्व सदस्यों को भी विस्तारित करेगा जो 1.4.94 से 7.10.2002 के बीच अधिवर्षिता को प्राप्त हो गए हैं या सेवानिवृत्त हुए थे और 8 अक्तूबर, 2002 को कोयला खान भविष्य निधि के सदस्य हो गए हैं, इस स्कीम के सदस्य होंगे ।

G.S.R. 10708)- In exercise of the powers conferred by section 3EЕ read with section 7 of the Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 (46 of 1948), the Central Government hereby makes the following further amendments in the Coal Mines Pension Scheme, 1998, namely:-
1. (1 ) This Scheme may be called the Coal Mines Pension (Amendment) Scheme, 2003.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In Coal Mines Pension Scheme, 1998 in the paragraph 3(f) the words namely "the provisions of the proviso to sub- paragraphs (2) and (4) of" shall be deleted.

3. In Coal Mines Pension Scheme , 1998 , in paragraph 4, after sub- paragraph 4(A) following sub -paragraphs shall be inserted namely: -
"(5) An employee , who was a member of the Central Coalfields Limited Staff Provident Fund, Darbhanga House , Ranchi , hereinafter referred to as CCLSPF , or the Coal Mines Authority Limited Staff Provident Fund constituted under the Coal Mines Nationalisation Provident Fund rule 1976 , hereinafter referred as CMALSPF retired or superannuated on or after first day of April , 1994 or has become the member of Coal Mines Provident Fund, shall be deemed to have become the member of this scheme and eligible to draw pension from the date , following the date of superannuation or retirement in respect of members superannuated or retired on or before 7th October , 2002 , and other members as per the provisions of this scheme from 8thOctober, 2002 :
Provided the employee or the ex - employee or the family (in the event of death of an ex- employee ) deposits into the pension fund the arrears , equivalent to the amounts specified in clauses (b) , ( c), (d) , ( e)& (f) of Paragraph 3 , alongwith interest till the date of deposit from the first day of March, 1971 or the date of joining service , whichever is later, till 7th October, 2002 or the date of superannuation or retirement, as the case may be, by way of authorising transfer of such amounts from his /her provident fund accumulations , in respect of members who have not withdrawn their Provident Fund accumulations , and for other member's cases , by way of Demand Draft .
Note.- for the purpose of this paragraph.-
(i) A deemed member under this paragraph shall have the option not to join this scheme . For this , he shall inform the Commissioner in writing within one year from the date of publication of this notification. The option once exercised shall be final .
(ii ) The amounts specified in clause (b) of paragraph 3 shall carry an interest at the rates admissible to Coal Mines Provident Fund members , for clause (c) and (d) of paragraph 3 , at the rate of 12% per annum and the amounts under clause (e) of paragraph 3 , at such rate , fixed by the Central Government from time to time credited interest in its contributions to the Coal Mines Family Pension Scheme , 1971 till 31.03.1998 , and at the rate of 8.5% with effect from 01.04.1998 .
(iii) The pensionable service shall be counted in terms of paragraph 2(0) deeming that they were the members of ceased Coal Mines Family Pension Scheme, 1971 or Coal Mines Pension Scheme , 1998 as the case may be, from 01.03.1971 or from the date of joining into CMALSPF or CCLSPF , whichever is later till 7th, October, 2002 or date of superannuation or retirement , as the case may be .

The Coal Mines Pension Scheme, 1998 was published vide GSR No. 123 (E) dated the 5th March , 1998 and subsequently amended vide numbers : -
1. GSR 268 (E) , dated the 25th May, 1998
2. GSR 218 (E) , dated the 22nd March , 1999.
3. GSR 689 (E ) , dated the 29th August, 2000
4. GSR 256(E) , dated the 12th April , 2001
5. GSR 861 (E) , dated the 23rd November, 2001 6. GSR 16 (E) , dated the 9th January, 2002

Explanatory Memorandum
Section 7 of the Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 (46 of 1948) empowers the Central Government to add to, amend or vary a Scheme framed under the Act either prospectively or retrospectively.
The Coal Mines Pension Scheme , 1998 came into force with effect from 31st day of March , 1998. The member of the Coal Mines Authority Limited Staff Provident Fund and Central Coalfields Limited Staff Provident Fund who are in service as on 8th October, 2002 have become the members of the Coal Mines Provident Fund with effect from 8th October, 2002 as per notification No. GSR 687(E) dated 8.10.2002. The Board of Trustees of Coal Mines Provident Fund in its 133rd meeting held on 9.8.2001 under agenda item No. XVI recommended that Coal Mines Provident Fund members who were not members of Family Pension Scheme under Coal Mines Family Pension Scheme, 1971 but made on exit from the services between 1.4.94 to 31.3.1998 may also be allowed to give option to join Coal Mines Pension Scheme, 1998. This option will also be extended to Central Coalfields Limited Staff Provident Fund & Coal Mines Authority Limited Staff Provident Fund members and to those who are deemed to have become the member of Coal Mines Provident Fund, by virtue of the notification no . G.S.R 687 (E) dated 8.10.2002 . The members of the Coal Mines Provident Fund, who were not members of Coal Mines Family Pension Scheme , 1971 , superannuated between 1.4.1994 to 31.3.1998 have already been given option to this effect vide notification No. GSR 482(E) dated 8th July, 2002. This proposed amendment will extend such benefit also to those ex -members of Coal Mines Authority Limited Staff Provident Fund and Central Coalfields Limited Staff Provident Fund who were superannuated or retired between 1.4.1994 to 7.10.2002 and have become the members of Coal Mines Provident Fund on 8thOctober , 2002 to become the members of this scheme .
