सा.का.नि. 108 (अ ).- केन्द्रीय सरकार, कोयला खान भविष्य निधि और प्रकीर्ण उपबंध अधिनियम, 1948 (1948 का 46) की धारा 3 ङ के साथ पठित धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कोयला खान पेंशन स्कीम, 1998 का और संशोधन करने के लिए निम्नलिखित स्कीम बनाती है, अर्थात् :-
1. (1 ) इस स्कीम का संक्षिप्त नाम कोयला खान पेंशन (संशोधन) स्कीम, 2003 है ।
(2) यह 31 मार्च , 1998 को प्रवृत्त हुई समझी जाएँगी ।
2 कोयाला खान पेंशन स्कीम, 1998 में, -
(क) पैरा 2 में, खंड (च) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात् :-
' (चक) "उसकी सेवा निवृत्ति की तारीख से 1 अप्रैल, 1994 को या उसके पश्चात् आरंभ होने वाली सेवा निवृत्ति की तारीख अभिप्रेत है । '
(ख) पैरा 4 के उप पैरा (4) में " अधिवर्षिता या सेवा निवृत्ति" शब्दों के स्थान पर जहां भी वे आते हैं " अधिवर्षिता या उसकी सेवा निवृत्ति की तारीख" शब्द रखे गए समझे जाएंगे ;

PART -SEC. 3 (1) (ग) पैरा 12 के उप पैरा (3) में " अधिवर्षिता या सेवा निवृत्ति" शब्दों के स्थान पर " अधिवर्षिता
या उसकी सेवा निवृत्ति की तारीख " शब्द रखे गए समझे जाएंगे ;
(घ) पैरा 17 में " अधिवर्षिता या सेवा निवृति" शब्दों के स्थान पर " अधिवर्षिला या उसकी सेवा निवृति की तारीख " शब्द रखे गए समझे जाएंगे ।

स्पष्टीकारक ज्ञापन
कोयला खान भविष्यनिधि और प्रकीर्ण उपबंध नियम , 1948 (1948 का 46) की धारा 7 केन्द्रीय सरकार को, अधिनियम के अधीन विरचित किसी स्कीम का भविष्यलक्षी रूप से या भूतलक्षी रूप से परिवर्धन , संशोधन या उसमें फेरफार करने के लिए सशक्त करती है ।
2. कोयला खान पेंशन स्कीम , 1998 , 31 मार्च , 1998 से प्रवृत हुई थी। मूल स्कीम में पैरा 4 (4) , 12 (3) और 17 में आने वाला " अधिवर्षिता " शब्द अनुपयुक्त था क्योंकि इससे अधिवर्षिता से भिन्न पद्धति द्वारा सेवा निवृत होने वाले कर्मचारियों को पेंशन के फायदे से अपवर्जित कर दिया गया था । कोयला खान भविष्यनिधि न्यासी बोर्ड ने 20 नवंबर , 1998 को हुए उसके 125 वें अधिवेशन में " अधिवर्षिता" शब्द के स्थान पर " अधिवर्षिता या सेवा निवृति " शब्द रखे जाने का अनुमोदन कर दिया है । आशयित संशोधन को लाने के लिए सा0 का0नि0 218 (अ) तारीख 22 मार्च , 1999 द्वारा एक अधिसूचना जारी की गई थी । तथापि अनवधानता से अधिसूचना की प्रभावी तारीख आशयित तारीख अर्थात् 31 मार्च , 1998 के वजाय उसके प्रकाशन की तारीख दी गई थी । परिणामस्वरूप वे सभी कर्मचारी जो 22 मार्च , 1999 से पूर्व सेवा निवृत हो चुके थे पेंशन स्कीम के फायदे के लिए अपात्र हो जाएंगे जबकि आशय यह था कि सभी कर्मचारियों को जो 31 मार्च , 1998 को या उसके पश्चात् सेवा निवृत हुए थे तथा उन कर्मचारियों को जो 1 अप्रैल , 1994 को या उसके पश्चात् सेवा निवृत हुए थे को एक विकल्प दिया जाए । तथापि , स्कीम के अधीन फायदा 1 मार्च , 1998 से अर्थात् जब स्कीम प्रभाव में लाई गई थी से लागू होगा ।
3. प्रमाणित किया जाता है कि इस अधिसूचना को भूतलंक्षी प्रभाव से प्रवृत किए जाने से किसी भी कर्मचारी पर विपरीत प्रभाव नहीं पड़ेगा । भारत का राजपत्र असाधारण

NOTIFICATION
New Delhi , the 13th February, 2003
G.S.R. 108(E).- In exercise of the powers conferred by section 7, read with section 3 E of the Coal Mines Provident Fund and Miscellaneous Provisions Act , 1948 (46 of 1948) , the Central Government hereby makes the following Scheme further to amend the Coal Mines Pension Scheme , 1998 , namely: -
1. (1) This Scheme may be called the Coal Mines Pension (Amendment ) Scheme, 2003 .
(2) Itshall be deemed to have come into force on the 31st day of March , 1998.
2. In the Coal Mines Pension Scheme , 1998
(a) in paragraph 2 , after clause (f) the following clause shall be inserted , namely: - '( fa) " date of his retirement " means the date of retirement beginning on or after the first day of April , 1994. '
or (b) in paragraph 4, in sub- paragraph (4) , for the words , " superannuation retirement, " wherever they occur , the words , " superannuation or date of his retirement , " shall be deemed to have been substituted;
(c) in paragraph 12 , in sub -paragraph (3 ) , for the words , " superannuation or retirement , " the words , " superannuation or date of his retirement ," shall be deemed to have been substituted;
(d) in paragraph 17 , for the words , " superannuation or retirement, " the words , "superannuation or date of his retirement " shall be deemed to have been substituted.

Foot Note: The Coal Mines Pension Scheme , 1998 was published vide G.S.R. 123 (E ) dated the 5th March , 1998 and subsequently amended vide number: -
1. GSR 268 (E ) , dated the 25th May , 1998.
2. GSR 218 ( E) , dated the 22nd March 1999.
3. GSR 689 (E ) , dated the 29th August , 2000 .
4. GSR 256 ( E) , dated the 12th April , 2001 .

[PART II-SEC. 3 (i ) ) Explanatory Memorandum
Section 7 of the Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 (46 of 1948) empowers the Central Government to add to, amend or vary a scheme framed under the Act either prospectively or retrospectively.
2. The Coal Mines Pension Scheme, 1998 came into force with effect from the 31st day of March 1998. In the principal scheme , the word "superannuation " occurring in paragraphs , 4( 4) , 12(3 ) and 17 was inappropriate as it excluded employees from the benefit of pension who would retire by mode other than superannuation. The Board of Trustees , Coal Mines Provident Fund in its 125th Meeting held on 20th November , 1998 approved substitution of word " superannuation " by " superannuation or retirement . " A notification vide GSR 218 (E ) dated 22nd March, 1999 was issued to bring the intended amendment. However, inadvertently effective date of notification was given the date of its publication instead of intended date i.e. 31st March, 1998. As a result all those employees who had retired prior to 22nd March , 1999 would be rendered ineligible for the benefit of Pension Scheme , whereas the intention was to give an option to all the employees who retired on or after 31st Day of March, 1998 as well as to those employees who retired on or after the 1st day of April 1994. However , the benefit under the Scheme would be applicable w.e.f. 31st day of March, 1998 i.e. when the Scheme was brought into force.
3. It is hereby certified that no employee would be adversely affected by bringing into force this notification retrospectively.
