का.आ. 182( अ ).-केन्द्र सरकार ने राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) ( इसे आगे उक्त अधिनियम कहा गया है ) की धारा 8 ( क ) के अंतर्गत जारी और भारत के राजपत्र के भाग II , खंड 3 , उप खंड ( ii ) में प्रकाशित भारत सरकार, तत्कालीन जल भूतल परिवहन मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) ( सड़क पक्ष ) की दिनांक 18 फरवरी , 2000 की अधिसूचना सं. का.आ. 137 ( अ ) द्वारा राजस्थान राज्य में राष्ट्रीय राजमार्ग सं. 8 पर 368 कि.मी. ( किशनगढ़ बाइपास ) पर विद्यमान रेलवे क्रासिंग के स्थान पर चार लेन के सड़क उपरि पुल के प्रयोग केलिए यंत्रचालित वाहनों पर सरकारी राजपत्र में उस अधिसूचना के प्रकाशन की तारीख से 3 वर्ष की अवधि के लिए उस अधिसूचना के साथ संलग्न अनुसूची में विनिर्दिष्ट दरों पर शुल्क की वसूली और उसे अपने पास रखने के लिए मैं. एम. एस. के. प्रोजेक्ट ( इंडिया ) लि. , 707 , स्टरलिंग रोड, आर . सी. दत्त रोड, अलकापुरी , बड़ोदरा -390005 को अधिकृत किया था ।
उक्त मैं. एम. एस. के. प्रोजेक्ट ( इंडिया ) लि. ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा किए गए करार के खंड संख्या 10.2 के तहत मध्यस्थ अधिकरण के समक्ष यह दावा किया कि शुल्क वसूली के लिए 36 माह की अवधि में, परियोजना के निर्माण में हुई समय की बचत तक वृद्धि कीजाए ।
उक्त मध्यस्थ अधिकरण ने 8 दिसम्बर, 2002 के अपने आदेश/निर्णय द्वारा यह निर्देश दिया है कि रियायत ग्राही मैं. एम. एस. के. प्रोजेक्ट ( इंडिया ) लि. 3 वर्ष , 2 माह और 9 दिन अर्थात् 26 अप्रैल, 2003 तक की अवधि के लिए पथकर वसूल कर सकता है और अपने पास रख सकता है।
अतः , अब, केन्द्र सरकार मध्यस्थ अधिकरण के पूर्वोक्त आदेश/ निर्णय को लागू करने के लिए उक्त अधिनियम की धारा 8 ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए दिनांक 18 फरवरी , 2000 की अधिसूचना सं. का.आ. 137( अ ) में निम्नलिखित संशोधन करती है, अर्थात्: - उक्तअधिसूचना में " तीन वर्ष की अवधि के लिए " शब्दों, अंकों और अक्षरों के लिए " 3 वर्ष, 2 माह और 9 दिन अर्थात् 26 अप्रैल , 2003 तक की अवधिके लिए " प्रतिस्थापित किया जाएगा ।

NOTIFICATION
New Delhi , the 14th February, 2003
S.O. 182(E) . Whereas by the notification of the Government of India in the erstwhile Ministry of Surface Transport(Department of Road Transport and Higyways ) ( Roads Wing ) , number S.O. 137 (E ) , dated 18th February, 2000 published in the Gazette of India , Part II , Section 3 , Sub-section ( ii ) , issued under Section 8 (A) of the National Highways Act . 1956 ( 48 of 1956) (hereinafter referred to as the said Act) , the Central Government authorized M/s . MSK Projects (India ) Limited. 707 , Sterling Road , R. C. Dutt Road, Alkapuri , Vadodara- 390005 to collect and retain fees at the rate specifed in the Schedule annexed to that notification for a period of three years from the date of publication of that notification in the Official Gazette on mechanical vehicles for the use of the four - lane road over bridge in lieu of existing railway corssing at Km. 368 ( Kishangarh Bypass) on National Highway No. 8 in the State of Rajasthan;
Whereas the said M/s . MSK Projects (India) Limited by invoking Clause No. 10.2 of the Agreement entered into by the National Highways Authority of India, claimed before the Arbitration Tribunal that period of 36 months for fee collection be extended by the time saved in construction of the project .
Whereas the said Arbitration Tribunal vide its order/award dated 8th December, 2002 had directed that the user fees can be collected and retained by M/ s. MSK Projects ( India) Limited, the concessionaire , for a period ofthree years two months and nine days , i.e. , upto 26th April , 2003;
Now, therefore , to give effect to the aforesaid order /award of the Arbitration Tribunal , and in exercise of powers conferredby Section 8 (A) of the said Act, the Central Government hereby makes the following amendments in the said notification number S.O. 137 ( E) dated 18th February, 2000 , namely :-
In the said notification , for the words " for a period of three years " , the words , figures and letters for a period of three years , two months and nine days i.e. upto 26th April , 2003 " shall be substituted.
