का.आ. 193 ( अ) - राष्ट्रपति, संविधान के अनुच्छेद 77 के खंड ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार ( कार्य- आबंटन ) नियम, 1961 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -
1. (1 ) इन नियमों का संक्षिप्त नाम भारत सरकार ( कार्य-आबंटन ) ( दो सौ अड़सठवां संशोधन ) नियम , 2003 है ।
(2) ये तुरन्त प्रवृत्त होंगे ।
2. भारत सरकार ( कार्य-आबंटन ) नियम , 1961 की द्वितीय अनुसूची में,-
(क) " वित्त और कंपनी कार्य मंत्रालय " शीर्षक के अंतर्गत , " ग. राजस्व विभाग " उप-शीर्षक के नीचे, प्रविष्टि 9 , प्रविष्टि 11 और प्रविष्टि15 के स्थान पर, क्रमशः निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्: -
" 9. अफीम पोस्त की खेती, और ऐसी अफीम से अफीम व्युत्पन्नों का विनिर्माण, ऐसी अफीम और अफीम व्युत्पन्नों का विक्रय और उन पर नियंत्रण के प्रयोग से संबंधित सभी मामले ।
11. स्वापक औषधियों, मनः प्रभावी पदार्थों और पूर्वगामी रसायनों के संबंध में अंतर्राष्ट्रीय कन्वेंशनों, करारों, नयाचार, आदि से संबंधित सभी मामले जिनके लिए राजस्व विभाग और इसके अंतर्गत संगठन कार्रवाई करने के लिए प्राधिकृत है केवल उन मामलों की छोड़कर, जो गृह मंत्रालय को आबंटित मामले हैं । 1 15. अधीनस्थ संगठन:
(क) आयकर विभाग;
(ख) सीमा शुल्क विभाग;
(ग ) केन्द्रीय उत्पाद शुल्क विभाग; और
(घ ) स्वापक पदार्थ विभाग ( इसके अंतर्गत स्वापक पदार्थ नियंत्रण ब्यूरो नहीं है ) । " ;
(ख) " गृह मंत्रालय " शीर्षक के अंतर्गत, " क. आंतरिक सुरक्षा विभाग " उप- शीर्षक के नीचे, प्रविष्टि 57 के पश्चात्, निम्नलिखित प्रविष्टियां जोड़ी जाएंगी, अर्थात्: -

[PART II-SEC. 3 ( ii) ] " 58 . स्वापक औषधि और मनः प्रभावी पदार्थ अधिनियम , 1985 की धारा 4 ( 3 ) के उपबंधों के अधीन स्थापित स्वापक पदार्थ नियंत्रण ब्यूरो तथा स्वापक औषधियों और मनः प्रभावी पदार्थों के दुरुपयोग और अवैध व्यापार को रोकने तथा उसके प्रतिरोध करने के लिए सभी उपायों के समन्वय से संबंधित सभी मामले ।
59. स्वापक औषधियों, मनःप्रभावी पदार्थों और पूर्वगामी रसायनों में अवैध व्यापार के संबंध में अंतर्राष्ट्रीय कन्वेंशनों, करारों, नयाचार आदि से संबंधित सभी मामले , जिनके लिए गृह मंत्रालय और उसके अधीन संगठन कार्रवाई करने के लिए प्राधिकृत हैं, केवल उन मामलों को छोड़कर, जो वित्त और कंपनी कार्य मंत्रालय, राजस्व विभाग को आबंटित हैं । " ।

New Delhi , the 18th February, 2003
S.O. 193 (E ). In exercise of the powers conferred by clause (3 ) of article 77 of the Constitution , the President hereby makes the following rules further to amend the Government of India ( Allocation of Business) Rules , 1961 , namely:----
1. (1) These rules may be called the Government of India ( Allocation ofBusiness ) (Two hundred and sixty- eighth Amendment ) Rules , 2003 .
(2) They shall come into force at once .
2. In the Government of India ( Allocation ofBusiness ) Rules , 1961 , in the Second Schedule ,-
(A) Under the heading " MINISTRY OF FINANCE AND COMPANY AFFAIRS ( VITTA AUR COMPANY KARYA MANTRALAYA) " , under the sub - heading " C. DEPARTMENT OF REVENUE (RAJASWA VIBHAG ) " , for entries 9,11 and 15, the following entries shall be substituted respectively, namely :-
"9. All matters relating to cultivation of opium poppy , manufacture of opium derivatives from such opium, sale of such opium and opium derivatives and exercise of control thereon.
11. All matters relating to international conventions , agreements , protocols , etc. in respect of narcotic drugs, psychotropic substances and precursor chemicals which the Department of Revenue and Organizations under it are authorized to deal with except matters allocated to the Ministry of Home Affairs.
15. Subordinate Organisations:-
(a) Income Tax Department;
(b) Customs Department ;
(c) Central Excise Department ; and
(d) Narcotics Department ( excluding Narcotics Control Bureau) . " ;
(B) Under the heading "MINISTRY OF HOME AFFAIRS (GRIH MANTRALAYA ) " under the sub - heading "A. DEPARTMENT OF INTERNAL SECURITY ( ANTRIK SURAKSHA VIBHAG ) " after entry 57 , the following entrics shall be added , namely:--
"58. All matters relating to Narcotics Control Bureau set up under the provisions of Section 4 (3 ) of the Narcotic Drugs and Psychotropic Substances Act , 1985 and co -ordination of all measures for preventing and combating abuse of and illicit traffic in narcotic drugs and psychotropic substances .
59. All matters relating to international conventions , agreements , protocols , etc. , in respect of illicit traffic in narcotic drugs , psychotropic substances and precursor chemicals which the Ministry of Home Affairs and Organizations under it are authorized to deal with except matters allocated to theMinistry of Finance and Company Affairs , Department of Revenue. ".
