सा.का.नि. 113 ( अ )/आ.व./ईख. केन्द्रीय सरकार , आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ईख ( नियंत्रण ) आदेश , 1966 का और संशोधन करने के लिए निम्नलिखित आदेश करती है, अर्थात्:-
1. ( 1 ) इस आदेश का संक्षिप्त नाम ईख (नियंत्रण ) संशोधन, आदेश 2003 है ।
(2 ) यह तुरन्त प्रवृत्त होगा ।
2. ईख (नियंत्रण ) आदेश , 1966 ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) में खण्ड उक के परन्तुक ( i ) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:-
" ( i ) ईख को किसी क्रय केन्द्र पर परिदत्त करने और उसे स्वामी द्वारा रेलसे या अपने स्वयं के परिवहन का प्रयोग करते हुए सड़क से कारखाने तक परिवहित करने की दशा में रिबेट, यथास्थिति, ऐसीन्यूनतम कीमत या तय पाई गई कीमत में से दिया जाएगा, जो केन्द्रीय सरकार या राज्य सरकार द्वारा क्षेत्र में परिवहन की वास्तविक लागत को ध्यान में रखते हुए, संबंधित जिला मजिस्ट्रेट को क्रय केन्द्र से कारखाने तक की वास्तविक दूरी और प्रति किलोमीटर लागू दर को दर्शित करते हुए एक प्रमाण- पत्र जारी करने के लिए प्राधिकृत करते हुए, नियत की जाएगी और स्वामी तदनुसार रिबेट देगा । "

टिप्पण-केन्द्रीय सरकार या राज्य सरकार द्वारा नियत किए गए रूप में रिबेट 2002-2003 के चीनी मौसम के प्रारंभ से अर्थात्अक्तूबर, 2002 से आगे परिदत्त ईख को लागू होगा ।
3. उक्त आदेश के खण्ड 4 क में, परन्तुक ( i ) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:-
" ( i ) ईख को किसी क्रय केन्द्र पर परिदत्त करने और उसे स्वामी द्वारा रेल से या अपने स्वयं के परिवहन का प्रयोग करते हुए सड़क से कारखाने तक परिवहित करने की दशा में रिबेट, यथास्थिति, ऐसीन्यूनतमकीमत या तय पाई गई कीमत में से दिया जाएगा , जोकेन्द्रीय सरकार या राज्य सरकार द्वारा क्षेत्र में परिवहन की वास्तविक लागत को ध्यान में रखते हुए, संबंधित जिला मजिस्ट्रेट को क्रय केन्द्र से खांडसारी यूनिट तक की वास्तविक दूरी और प्रतिकिलोमीटर लागू दर को दर्शित करते हुए एक प्रमाण-पत्र जारी करने के लिए प्राधिकृत करते हुए, नियत की जाएगी और स्वामी तदनुसार रिबेट देगा । "
टिप्पणः केन्द्रीय सरकार या राज्य सरकार द्वारा नियत किए गए रूप में रिबेट 2002-2003 के चीनी मौसम के प्रारंभ से अर्थात् अक्तूबर 2002से आगे परिदत्त ईख को लागू होगा ।

ORDER
New Delhi , the 20th February, 2003
G.S.R. 113(E)/Ess . Com./Sugarcane. In exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955 ( 10 of 1955 ), the Central Government hereby makes the following Order further to amend the Sugarcane ( Control ) Order , 1966, namely : ----
1. ( 1) This Order may be called the Sugarcane ( Control) Amendment Order , 2003 ,
(2) It shall come into force at once .
2 In the Sugarcane ( Control) Order, 1966 (hereinafter referred to as the said Order) , in clause 3A, for proviso ( i ), the following shall be substituted, namely
"( i) in the case of sugarcane delivered at any purchasing centre and the same being transported to the factory by the owner by rail or by road using his own transport , a rebate shall be made from the minimum price or the agreed price , as the case may be , which shall be fixed by the Central Government or the State Government having regard to the actual cost of transportation in the area , authorizing the concerned district magistrate to issue a certificate indicating the actual distance from the purchasing centre to the factory and the rate per kilometre applicable, and the owner shall accordingly make the rebate.
[PART II-SEC . 3 (i ) ] Note: The rebate , as fixed by the Central Government or the State Government , shall be applicable to the sugarcane delivered from the commencement of 2002-2003 sugar season i.e. October 2002 onwards . " 3. In clause 4A ofthe said Order, for proviso ( i ) , the following shall be substituted, namely: ---
"(i) in the case of sugarcane delivered at any purchasing centre and the same being transported to the khandsari unit by the owner by rail or by road using his own transport , a rebate shall be made from the minimum price or the agreed price, as the case may be, which shall be fixed by the Central Government or the State Government having regard to the actual cost of transportation in the area, authorizing the concerned district magistrate to issue a certificate indicating the actual distance from the purchasing centre to the khandsari unit and the rate per kilometer applicable, and the owner shall accordingly make the rebate.
Note: The rebate, as fixed by the Central Government or the State Government, shall be applicable to the sugarcane delivered from the commencement of 2002-2003 sugar season i.e.October, 2002 onwards. " [F. No. 3 ( 5)/2002 - SP ]
