सा.का.नि. 125( अ ).-केन्द्र सरकार, महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 132 की उपधारा ( 1 ) के साथ पठित धारा 124 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कंडला पत्तन न्यास के न्यासी मंडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में दर्शित कंडला पत्तन न्यास कर्मचारी ( अवकाश ) संशोधन विनियम, 2003 का अनुमोदन करती है ।
2. ये विनियम इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।
अनुसूची
महापत्तन न्यास अधिनियम, 1963 की धारा 28 ( 1963.का 28 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कंडला पोर्ट का न्यासी मंडल एतद्द्वारा कंडला पोर्ट कर्मचारी ( अवकाश ) विनियम, 1964 में निम्नलिखित संशोधन करता है, अर्थात्: -
I. ये विनियम " कंडला पोर्ट कर्मचारी ( अवकाश ) संशोधन विनियम, 2003 " कहे जाएंगे तथा दिनांक 2-8-2000 से लागू होंगे । टिप्पणी: दिनांक 2-8-2000 से लागू हुए वेतन संशोधन समझौते के कारण इसे पूर्व व्यापी प्रभाव दिया गया है । यह पुष्टि की जाती है कि इसके परिणामस्वरूप किसी पर भी प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।
II. ये विनियम उन सभी व्यक्तियों को लागू होगा जो बोर्ड की सेवा में है तथा उसे ' ए ' तथा ' बी' प्रवर्ग के तटीय कामगारों तथा ' बी' प्रवर्ग के तटीय कामगारों को यथा अनुज्ञेय लाभ पाने वाले पृथक्कार तथा चिन्हक तक विस्तारित किया गया है ।
III . निम्नलिखित विनियमों में उपदर्शित आंकड़े " 240 " से " 300 " के रूप में प्रतिस्थापित किया जाए ।

NOTIFICATION
NewDelhi , the 24th February, 2003
G.S.R. 125(E) .- In exercise of the powers conferred by Sub-section ( 1 ) of Section 124, read with Sub- section ( 1 ) of Section 132 of the Major Port Trusts Act, 1963 (38 of 1963 ), the Central Government hereby approves the Kandla Port Trust Employees ( Leave) Amendment Regulations, 2003 made by the Board of Trustees of Kandla Port Trust as set out in the Schedule annexed to this Notification .
2. The said Regulations shall come into force from the date ofpublication of this Notification in the Official Gazette.
SCHEDULE
In exercise of the powers conferred under Section 28 of the Major Port Trusts Act, 1963 (28 of 1963) , the Board of Trustees of the Port of Kandla hereby makes the following amendment to the Kandla Port Employees (Leave) Regulations , 1964 namely:-
I. These Regulations shall be called " Kandla Port Employees' (Leave) Amendment Regulations, 2003 " and shall come into force w.e.f. 2-8-2000.
Note :--The retrospective effect has been given on account of wage revision settlement effective from 2-8-2000 . It is affirmed that no one is likely to be affected adversely due to retrospective effect.
II . These Regulations shall apply to all persons who are employed in the service ofthe Board , and shall be extended to' A' and ' B ' category Shore Workers and Sorter and Markers who have been extended the benefits as admissible to ' B' category Shore Workers .
III . The figure " 240 " appearing in the following Regulations shall be sustained as " 300 "
( 1 ) Sub regulations ( ii ) of Regulation7.
(2) Proviso under Regulation (8) ( 1 ).
(3) 2nd Proviso under Regulation (8) (1 ) .
(4) Sub regulations (2) of Regulation 8 .
(5) Sub regulations ( 3 ) of Regulation 8.
(6) Sub regulations (6) ofRegulation 14.
(7) Sub regulations (7 ) ( a) of Regulation 14 .
(8) Explanation 3 under Sub regulation 7 of Regulation 14.
(9) Sub regulations ( 8 ) of Regulation 14.
( 10) Sub regulations (9) ( a) ( 1 ) Regulation 14 .
