का.आ. 216 ( अ ).- बहु- राज्यीय सहकारी समिति अधिनियम, 2002 ( 2002 का 39 ) की धारा 4 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार निर्देश देती है कि अधिनियम की धारा 84 के अंतर्गत केन्द्रीय पंजीकार द्वारा प्रयोग में लाई जाने वाली शक्तियां राज्यों/ संघ शासित क्षेत्रों की सहकारी समितियों के पंजीकार द्वारा अपने संबंधित क्षेत्राधिकार में स्थित समितियों के संबंध में भी प्रयोग में लाई जा सकेंगी , जोकि निम्नलिखित शर्तों एवं दिशानिर्देशों के विषयाधीन होंगी कि:-
1. राष्ट्रीय सहकारी समिति के संबंध में ऐसी शक्तियां इन अधिकारियों द्वारा प्रयोग में नहीं लाई जा सकेंगी ।
2. अधिकारी (न्यायालय मामलों से इतर) इस अधिनियम की धारा 4 की उपधारा ( i ) के अंतर्गत नियुक्त केन्द्रीय पंजीकार द्वारा समय- समय पर दिए दिशानिर्देशों का पालन करेंगे ।
3. सहकारी समितियों के राज्य पंजीकार द्वारा मध्यस्थ की नियुक्ति निम्नलिखित दिशानिर्देशों के विषयाधीन होगी:-
(क) संगठनात्मक एवं वैधानिक मामलों से संबंधित विवादों के मामले में मध्यस्थ, प्रैक्टिस करने वाले वकील अथवा न्यायिक/सिविल सेवाओं के सेवानिवृत्त सदस्य अथवा सहकारिता विभाग के कम से कम उप- पंजीकार या अधिक स्तर के ऐसे अधिकारी जो नियुक्ति कीतारीख से दो वर्ष पूर्व से पहले सेवानिवृत्त न हुए हों, होने चाहिए ।
(ख) वसूली विवादों सहित वित्तीय एवं बैंकिंग मामलों से संबंधित विवादों के मामलों में नियुक्ति के लिए खंड 3 ( क ) में सूचीबद्ध व्यक्तियों के अतिरिक्त चार्टर्ड एकाउंटेंटों/ आई. सी. डब्ल्यू. ए. /सेवानिवृत्त बैंक अधिकारियों ( सेवानिवृत्ति दो वर्ष से पूर्व की न हो) जैसे वित्तीय एवं लेखा का ज्ञान रखने वाले व्यक्तियों पर विचार किया जा सकता है ।
4. अनुमोदित मध्यस्थों की सूची अनुमोदन के 15 दिनों के भीतर केन्द्रीय पंजीकार को प्रस्तुत की जाएगी । सभी अनुमोदित मध्यस्थों की अद्यतन सूची तिमाही आधार पर केन्द्रीय पंजीकार को भेजी जानी चाहिए ।

NOTIFICATION
New Delhi , the 24th February, 2003
S.O. 216 (E ) . In exercise of the powers conferred by Sub - section (2 ) of Section 4 of the Multi - State Co -operative Societies Act, 2002 (39 of 2002 ) , the Central Government hereby directs that the powers exercisable by the Central Registrar under Section 84 of the Act shall also be exercisable by Registrar of Co -operative Societies of the States/UTs in respect of the societies located in their respective jurisdiction , subject to the following guidelines and conditions, that:-
1. Such powers in relation to a National Co -operative Society shall not be exercisable by these officers .
2. The officers shall comply with the directions (other than court cases) as may be given by the Central Registrar, appointed under Sub - section ( 1 ) of Section 4 of this Act, from tinte to time .
3. Appointment of arbitrators by the State Registrar of co -operative societies shall be subject to following guide- lines
(a) In case of disputes relating to organizational and legal matters , arbitrators should either be a practicing Advocate or retired member of Judicial/ Civil services or officers at least of the level of Deputy Registrar and above of co - operative department retired not more than two years prior to the date ofappointment .
(b) In case of disputes relating to financial and banking matters including recovery disputes , persons having financial and accounting background like Chartered Accountants/ICWAs/retired bank officers ( retired not earlier than two years ) may also be considered for appointment in addition to the persons listed in clause 3 (a) .
4. The list of approved arbitrators shall be submitted to the Central Registrar within 15 days of approval . The updated list ofall the approved arbitrators should be sent to the Central Registrar on quarterly basis.
