सा.का.नि. 883 ( अ ).- राष्ट्रीय राजमार्ग अधिकरण (अधिकरण के पीठासीन अधिकारी के रूप में नियुक्ति के लिए प्रक्रिया) नियम, 2003 का निम्नलिखित का प्रारूप, राष्ट्रीय राजमार्ग नियंत्रण ( भूमि और यातायात) अधिनियम, 2002 (2003 का 13) की धारा 50 की उपधारा ( 1 ) की अपेक्षानुसार, भारत के राजपत्र, असाधारण, भाग 2, खंड 3 , उपखंड ( ⅰ) , तारीख 8 अगस्त, 2003 में भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं० सा0का0नि0 645(अ) , तारीख 8 अगस्त, 2003 द्वारा प्रकाशित किया गया था, जिसमें ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से, जिसको भारत के उक्त राजपत्र की यथाप्रकाशित अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अवधि की समाप्ति से पूर्व आक्षेप या सुझाव आमंत्रित किए गए थे ;
गई थीं ; और उक्त राजपत्र की प्रतियां जनता को तारीख 8 अगस्त, 2003 को उपलब्ध करा दी
और ऐसे प्रारूप नियमों के संबंध में उक्त अधिसूचना में विनिर्दिष्ट अवधि के भीतर किसी व्यक्ति से कोई आक्षेप और सुझाव प्राप्त नहीं हुए थे ;
अतः, अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग नियंत्रण ( भूमि और यातायात) अधिनियम, 2002 (2003 का 13) की धारा 50 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित नियम बनाती है, अर्थात्:-

[PART II-SEC. 3(i) ] 1. संक्षिप्त नाम और प्रारंभ (1) इन नियमों का संक्षिप्त नाम राष्ट्रीय राजमार्ग अधिकरण (अधिकरण के पीठासीन अधिकारी के रूप में नियुक्ति के लिए प्रक्रिया) नियम, 2003 है ।
(2) ये उस तारीख से प्रवृत्त होंगे जिस तारीख को अधिनियम प्रवृत्त हुआ है ।
2. परिभाषाएं- ( 1 ) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो-
(क) "अधिनियम" से राष्ट्रीय राजमार्ग नियंत्रण (भूमि और यातायात) अधिनियम, 2002 (2003 का 13) अभिप्रेत है ;
(ख) " अधिकरण" से अधिनियम की धारा 5 की उपधारा (1 ) के अधीन स्थापित राष्ट्रीय राजमार्ग अधिकरण अभिप्रेत है ;
(ग) "पीठासीन अधिकारी " से अधिनियम की धारा 6 की उपधारा ( 1 ) के अधीन अधिकरण के पीठासीन अधिकारी के रूप में नियुक्त व्यक्ति अभिप्रेत है ;
(2) उन सभी शब्दों और पदों के जो इन नियमों में प्रयुक्त हैं और परिभाषित नहीं हैं किन्तु अधिनियम में परिभाषित हैं, वही अर्थ होंगे जो अधिनियम में है ।
3. पीठासीन अधिकारी की नियुक्ति की रीति (1 ) पीठासीन अधिकारी के पद पर नियुक्ति के लिए निम्नलिखित से मिलकर बनने वाली एक चयन समिति होगी-
(i) भारत के मुख्य न्यायमूर्ति द्वारा 'यथा नामनिर्देशित भारत के उच्चतम न्यायालय का एक न्यायाधीश. अध्यक्ष ;
(ii) भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय का सचिव...... सदस्य ;
(iii) ..सदस्य ; भारत सरकार के विधि और न्याय मंत्रालय (विधि कार्य विभाग) का सचिव..
(2) उच्चतम न्यायालय का न्यायाधीश चयन समिति का अध्यक्ष होगा ।
(3) चयन समिति के कोई दो सदस्य जिसके अंतर्गत अध्यक्ष भी है, ऐसी समिति की बैठक के लिए गणपूर्ति का गठन करेंगे । भारत का राजपत्र असाधारण

चयन समिति पीठासीन अधिकारी की नियुक्ति के लिए अभ्यर्थी का चयन करने के लिए अपनी स्वयं की प्रक्रिया बना सकेगी ।
(5) चयन समिति, पीठासीन अधिकारी के रूप में नियुक्ति के लिए सड़क परिवहन और राजमार्ग मंत्रालय द्वारा उसके लिए आवेदन आमंत्रित करने के पश्चात् तैयार की गई अभ्यर्थियों की सूची में से व्यक्तियों की सिफारिश करेगी ।
(6) केन्द्रीय सरकार, चयन समिति की सिफारिशों के आधार पर पीठासीन अधिकारी के रूप में नियुक्ति के लिए चयनित व्यक्तियों की एक सूची बनाएगी और उक्त सूची दो वर्ष की अवधि के लिए विधिमान्य होगी । किसी पीठासीन अधिकारी की नियुक्ति इस प्रकार तैयार की गई सूची में से की जाएगी ।
4. चिकित्सक दृष्ट्या योग्यता कोई व्यक्ति पीठासीन अधिकारी के रूप में तब तक नियुक्त नहीं किया जाएगा जब तक कि वह केन्द्रीय सरकार द्वारा इस संयोजन के लिए गठित किए जाने वाले चिकित्सा बोर्ड द्वारा चिकित्सीय रूप से योग्य घोषित न कर दिया गया हो परन्तु यह तब जब किसी समतुल्य प्राधिकारी द्वारा उसे पहले से ही योग्य घोषित नहीं कर दिया गया हो ।
5. केन्द्रीय सरकार का निदेश- यदि इन नियमों के लागू करने के संबंध में कोई प्रश्न उद्भूत होता है तो उसे केन्द्रीय सरकार को विनिश्चय के लिए निर्दिष्ट किया जाएगा और केन्द्रीय सरकार के विनिश्चय को लागू किया जाएगा ।
6. व्यावृत्ति- इन नियमों की कोई बात, अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और व्यक्तियों के अन्य विशेष प्रवर्गों के लिए इस संबंध में समय- समय पर केन्द्रीय सरकार द्वारा जारी किए गए आदेशों के अनुसार उपबंध किए जाने के लिए अपेक्षित आरक्षणों, आयु- सीमा के शिथिलीकरण और अन्य रियायतों को प्रभावित नहीं करेगी ।
7. पद की और गोपनीयता की शपथ धारा 6 की उपधारा (1 ) के अधीन पीठासीन अधिकारी के रूप में नियुक्त प्रत्येक व्यक्ति, अपना पद धारण करने से पूर्व, इन नियमों के साथ संलग्न प्ररूप 1 और प्ररूप 2 में पद और गोपनीयता की शपथ लेगा और हस्ताक्षर करेगा । [PART II-SEC. 3 (i)]

ک "मैं, .(पीठासीन अधिकारी का नाम) जो पीठासीन अधिकारी के रूप में नियुक्त हुआ हूं सत्यनिष्ठा से प्रतिज्ञान करता हूं/ ईश्वर की शपथ लेता हूं कि मैं पीठासीन अधिकारी के रूप में अपने कर्तव्यों का श्रद्धापूर्वक और शुद्ध अंतःकरण से, अपनी पूरी योग्यता, ज्ञान और विवेक से भय या पक्षपात, अनुराग या द्वेष के बिना निर्वहन करूंगा ।"

NOTIFICATION
New Delhi , the 12th November , 2003
G.S.R. 883 (E) .- Whereas the draft of National Highways Tribunal (Procedure for appointment as Presiding Officer of the Tribunal ) Rules , 2003 , was published as required by sub- section (1 ) of section 50 of the Control of the National Highways (Land and Traffic) Act , 2002 ( 13 of 2003) in the Gazette of India, Extraordinary , Part II , Section 3 , Sub-section ( i ) , dated the 8th August , 2003 with the notification of Government of India in the Ministry of Road Transport and Highways , number G.S.R. 645 (E) , dated the 8th August, 2003 , inviting objections and suggestions from all persons likely to be affected thereby before the expiry of thirty days from the date on which the copies of said notification, as published in Gazette of India , are made available to the public;
And , whereas , copies of the said notification were made available to the public on the 8th August, 2003 ;
And, whereas no objections or suggestions had been received from any person with respect to such draft rules within the time period specified in the said notification;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 50 of the Control of National Highways (Land and Traffic) Act , 2002 ( 13 of 2003 ) , the Central Government hereby makes the following rules , namely : -
1. Short title and commencement (1) These rules may be called the National Highways Tribunal (Procedure for appointment as Presiding Officer of the Tribunal ) Rules , 2003 .
(2) They shall come into force on the date on which the Act comes into force .
2. Definitions - ( 1 ) In these rules , unless the context otherwise requires -
(a) "Act " means the Control of National Highways (Land and Traffic) Act , 2002( 13 of 2003) ;
(b) "Tribunal " means the National Highways Tribunal established under sub- section ( 1 ) of section 5 of the Act ;
(c) "Presiding Officer " means a person appointed as Presiding Officer of the Tribunal under sub- section ( 1 ) of section 6 of the Act ;
(2) All other words and expressions used and not defined in these rules but defined in the Act shall have the meanings respectively assigned to them in the Act .
3. Method of appointment of Presiding Officer - ( 1 ) For the purpose of appointment to the post of a Presiding Officer , there shall be a Selection Committee consisting of - THE GAZETTE OF INDIA : EXTRAORDINARY

(i) a Judge of the Supreme Court of India as nominated by the Chief Justice ofIndia . Chairman;
(ii) the Secretary to the Government of India in the Ministry of Road Transport and Highways .. .Member;
(iii) the Secretary to the Government of India in the Ministry of Law and Justice (Department of Legal Affairs ) . Member.
(2) The Judge of the Supreme Court shall be the Chairman of the Selection Committee.
(3) Any two members of the Selection Committee including the Chairman shall form a quorum for meeting of such Committee.
(4) The Selection Committee may devise its own procedure for selecting a candidate for appointment as Presiding Officer .
(5) The Selection Committee shall recommend persons for appointment as Presiding Officer from amongst the persons on the list of candidates prepared by the Ministry of Road Transport and Highways after inviting applications therefor .
(6) The Central Government shall on the basis of the recommendations of the Selection Committee make a list of persons selected for appointment as Presiding Officer and the said list be valid for a period of two years . The appointment of a Presiding Officer shall be made from the list so prepared .
4. Medical Fitness. -- No person shall be appointed as a Presiding Officer unless he is declared medically fit by a Medical Board to be constituted by the Central Government . for the purpose unless be has already been declared fit by an equivalent authority.
5. Direction of the Central Government . If any question arises relating to the implementation of these rules the same shall be referred to the Central Government for its decision and the decision of the Central Government shall be implemented .
6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes , ex - servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.
7. Oaths of office and secrecy . Every person appointed to be Presiding Officer under sub - section ( 1 ) of section 6 shall , before entering upon his office, make and subscribe an oath of office and secrecy in the Form I and Form II annexed to these rules .
