का.आ. 1296 ( अ) .- केन्द्रीय सरकार को लोकहित में यह आवश्यक प्रतीत होता है कि हरियाणा राज्य में एचबीजे (ग्रेप) पर ग्राम छॉयसा स्थित टैप ऑफ प्वाइन्ट के माध्यम से गुड़गाँव पाइपलाइन परियोजना तक प्राकृतिक गैस के परिवहन के लिए गेल (इण्डिया) लिमिटेड द्वारा पाइपलाइन बिछाई जानी चाहिए;
और , सरकार ने, पेट्रोलियम और खनिज पाइपलाइन ( भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 ( 1962 का 50) की धारा 2 के खण्ड (क) के अधीन अधिसूचना का.आ. 1062 तारीख 20 मई , 1998 द्वारा हरियाणा राज्य सरकार से गेल (इण्डिया) लिमिटेड में प्रतिनियुक्ति पर तहसीलदार को सक्षम प्राधिकारी के कृत्यों का पालन करने के लिए प्राधिकृत किया था;
और केन्द्रीय सरकार ने उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) के अधीन अधिसूचना का.आ. 81 (अ) तारीख 23 जनवरी , 2003 द्वारा उनसे उपाबद्ध सम्बन्धित अनुसूचियों में विनिर्दिष्ट रीति से भूमि में उपयोग के अधिकार के अर्जन के लिए प्रकाशित की थीं;
अतः, अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 2 के खण्ड (क) और धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है, यह निदेश देती है कि नीचे वर्णित सारणी में विनिर्दिष्ट भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचनाओं में से प्रत्येक अधिसूचना का उक्त सारणी में तत्स्थानी प्रविष्टि में विनिर्दिष्ट रीति से संशोधन किया जाए , अर्थात्ः-

NOTIFICATION
New Delhi , the i 1th November,2003
S.O. 1296 ( E) .- Whereas it appears to the Central Government that it is necessary in the public interest that for the transportation of Natural Gas through Tap off point at village Chhainsa on HBJ ( GREP) to Gurgaon Pipeline Project in the State of Haryana by GAIL ( India) Limited , a pipeline should be laid;
And whereas , the Government authorized Tehsildar on deputation from the State Government of Haryana to GAIL ( India) Limited to perform the functions of the competent a uthority under clause ( a) of section 2 of the Petroleum and Minerals Pipelines (Acquisition of Right of user in Land) Act , 1962 (50 of 1962) vide S.O. No. 1062 dated the 20th May , 1998 ;
And whereas , the Central Government vide S.O. 81 ( E) dated the 23rd January , 2003 ; published notifications under sub- section ( 1 ) of section 6 of the said Act for acquisition of right of user in the land in the manner specified in the respective Schedules annexed thereto ;
Now, therefore, in exercise of the powers conferred by clause (a) of section 2 and Sub -section ( 1 ) of section 3 of the said Act , the Central Government being satisfied that it is necessary in the public interest, so to do , hereby directs that each of the notifications of the Government of India in the Ministry of Petroleum and Natural Gas specified in the table mentioned below may be amended in the manner specified in the corresponding entry in the said Table.
