सा.का.नि. 903(अ) .- केन्द्रीय सरकार, सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21 ) की धारा 58 की उपधारा (2 ) के खंड (छ) के साथ पठित धारा 87 की उपधारा (2) के खंड (v) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती है, अर्थात् : -
1. संक्षिप्त नाम और प्रारंभ (1 ) इन नियमों का संक्षिप्त नाम सूचना प्रौद्योगिकी (सिविल न्यायालय की अन्य शक्तियों का साइबर अपील अधिकरण में निहित होना) नियम, 2003 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं इन नियमों में , जब तक संदर्भ से अन्यथा अपेक्षित न हो,
(क) " अधिनियम " से सूचना प्रौद्योगिकी अधिनियम , 2000 (2000 का 21 ) अभिप्रेत है ;
(ख) " साइबर अपील अधिकरण " से अधिनियम की धारा 48 की उपधारा (1 ) के अधीन स्थापित साइबर
विनियमन अपील अधिकरण अभिप्रेत है ;
(ग) उन शब्दों और पदों के, जो इनमें प्रयुक्त है और परिभाषित नहीं हैं किंतु अधिनियम में परिभाषित है
क्रमशः वहीं अर्थ होंगे जो अधिनियम में उनके दिए गए हैं ।

[PART II -SEC . 3 (i ) ] 3. साइबर अपील अधिकरण की शक्तियां साइबर अपील अधिकरण का, अधिनियम के अधीन अपने कृत्यों का निर्वहन करने के प्रयोजन के लिए, निम्नलिखित विषयों की बाबत वही शक्तियाँ होंगी जो सिविल न्यायालय को सिविल प्रक्रिया संहिता 1908 के अधीन किसी बाद का विचारण करते समय , किसी सिविल न्यायालय में निहित होती हैं, अर्थात्ः-
(क) किसी आवेदन को चूक के कारण खारिज करने के किसी आदेश को या अपने द्वारा एकपक्षीरुप पारित . किसी आदेश को अपास्त करना ;
(ख) किसी न्यायालय या कार्यालय से कोई लोक अभिलेख , दस्तावेज इलैक्ट्रानिक अभिलेखों की अपेक्षा करना ;

NOTIFICATION
New Delhi , the 21st November, 2003
G.S.R. 903 (E ). In exercise of the powers conferred by clause (v) of subsection (2) of section 87 , read wit, clause ( g ) of sub-section (2) of section 58 of the Information Technology Act , 2000 (21 of 2000) , the Central Govemment hereby makes the following rules , namely: -
1. Short title and commencement.- ( 1 ) These rules maybe called the Information Technology (Other powers of Civil Court vested in Cyber Appellate Tribunal ) Rules 2003.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. In these Ruies , unless the context otherwise requires, -
(a) "Act" means the Information Technology Act , 2000 (21 Of 2000) ;
(b) "Cyber Appellate Tribunai" means the Cyber Regulations Appellate Tribunal established under sub - section ( 1 ) of section 48 of the Act;

(c) words and expressions used herein and not defined but defined in the Act shall have the meaning respectively assigned to them in the Act .
3. Powers of Cyber Appellate Tribunal.- The Cyber Appellate Tribunal shall have , for the purposes of discharging its functions under the Act, the same powers are as vested in a civil court under the Code of Civil Procedure , 1908 , while trying a suit , in respect of the following matters , namely: -
(a) setting aside any order of dismissal of any application for default or any order passed by it , ex parte;
(b) requisitioning of any public record , document or electronic record from any court or office .
