सा.का.नि. 927( अ ).- केंद्रीय मोटरयान नियम, 1989 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप , मोटरयान अधिनियम, 1988 ( 1988 का 59) की धारा 212 की उपधारा ( 1 ) की अपेक्षानुसार , भारत सरकार के सडक परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं . सा.का. नि. 754 (अ) , तारीख 19 सितम्बर , 2003 को भारत के राजपत्र, असाधारण , भाग 2 , खंड 3 , उपखंड (ⅰ) , तारीख 19 सितम्बर, 2003 में प्रकाशित किया गया था जिसमें उन सभी व्यक्तियों से , जिनके उससे प्रभावित होने की संभावना है , उस तारीख से, जिसको भारत के उक्त राजपत्र की प्रतियां , जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थीं , तीस दिन की अवधि के भीतर आक्षेप और सुझाव मांगे गए थे;
थीं; और उक्त राजपत्र की प्रतियां 22 सितम्बर , 2003 को जनता को उपलब्ध करा दी गई और केंद्रीय सरकार ने उक्त प्रारुप नियमों के संबंध में जनता से प्राप्त सुझावों पर सम्यक रुप से विचार कर लिया है;

[PART II-SEC. 3 (1)] अतः अब , केंद्रीय सरकार , उक्त अधिनियम की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केंद्रीय मोटरयान नियम , 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्ः-
1. इन नियमों का संक्षिप्त नाम केन्द्रीय मौटरयान (तीसरा संशोधन) नियम, 2003 है ।
2. केन्द्रीय मोटरयान नियम , 1989 के नियम 115 में उपनियम ( 12) के पश्चात् निम्नलिखित उपनियम अंतः स्थापित किया जाएगा , अर्थात्ः-
66 ( 13) केन्द्रीय मोटरयान (तीसरा संशोधन) नियम, 2000 के नियम 1 के उपनियम (2 ) के खंड (क) और केन्द्रीय मोटरयान (दूसरा संशोधन) नियम , 2001 के नियम 1 के उपनियम ( ii) के खंड (क) , केन्द्रीय मोटरयान (तीसरा संशोधन) नियम, 2000 के नियम 1 के उपनियम (2) के खण्ड ( ख) के अधीन जारी की गई अधिसूचना सं.का.आ. 779 (अ) , तारीख 29 अगस्त, 2000 और अधिसूचना सं.का.आ. 90 (अ) , तारीख 27 जनवरी , 2003 , केन्द्रीय मोटरयान (दूसरा संशोधन) नियम , 2001 के नियम 1 के उपनियम (ii) के खण्ड (ख) के अधीन जारी की गई अधिसूचना सं.का.आ. 731 ( अ) , तारीख 21 जुलाई , 2001 , सं.का.आ. 801 (अ) , तारीख 26 जुलाई , 2002 और सं. का.आ. 940 ( अ) , तारीख 4 सितम्बर , 2002 और केन्द्रीय मोटरयान ( तीसरा संशोधन) नियम , 2000 के नियम 1 के उपनियम (2) के खंड (ख) , और केन्द्रीय मोटरयान (दूसरा संशोधन) नियम, 2001 के नियम 1 के उपनियम ( i) के खण्ड (ख) के अधीन जारी की गई अधिसूचना सं.का.आ. 91 (अ) , तारीख 27 जनवरी , 2003 में अन्तर्विष्ट उपबंधों पर प्रतिकूल प्रभाव डाले बिना, उपनियम ( 11 ) के उपबंध , 1 अप्रैल , 2005 से ही विनिर्मित चार पहिया यानों की बाबत सभी राज्यों और संघ राज्य क्षेत्रों में 1 अप्रैल , 2005 से प्रवृत होंगे । "

NOTIFICATION
NewDelhi, the 5th December , 2003
G.S.R. 927 (E)- Whereas the draft of certain rules further to amend the Central Motor Vehicles Rules , 1989 , were published as required by sub -section ( 1 ) of section 212 of the Motor Vehicles Act , 1988 (59 of 1988) in the Gazette of India, Extraordinary , Part-Il , section 3, sub- section ( i ) , dated the 19th September , 2003 in the notification of Government of India in the Ministry of Road Transport and Highways , number G.S.R. 754 ( E) , dated the 19th September , 2003, inviting objections or suggestions from all persons likely to be affected thereby within a period of thirty days from the date on which copies of the Gazette of India, in which the said notification was published , were made available to the public;
And whereas the copies of the said Gazette of India were made available to the public on the 22nd September , 2003;
And whereas the suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;
Now, therefore , in exercise of the powers conferred by section 110 of the said Act , the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules , 1989 , namely:-
1. These rules may be called the Central Motor Vehicles (Third Amendment) Rules , 2003.
2. In the Central Motor Vehicles Rules , 1989 , in rule 115 , after sub- rule (12) , thefollowing sub- rule shall be inserted , namely: -
" ( 13 ) Without prejudice to the provisions contained in clause (a) of sub - rule (2) of THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC. 3 (i) ] rule 1 of the Central Motor Vehicles (3rd Amendment) Rules , 2000 and clause (a) of sub - rule ( ii ) of rule 1 of the Central Motor Vehicles (2nd Amendment) Rules , 2001, notifications number S.O. 779 (E) dated 29th August , 2000 and number S.O. 90 ( E) dated 27th January, 2003 , issued under clause ( b ) of sub - rule (2) of rule 1 of the Central Motor Vehicles (3rd Amendment ) Rules , 2000 , notifications number S.O. 731 ( E) dated 21st July , 2001 , number S.O. 801 ( E) dated 26th July, 2002 and number S.O. 940 ( E) dated 4th September , 2002, issued under clause (b) ofsub - rule (ii ) of rule 1 of the Central Motor Vehicles (2nd Amendment) Rules , 2001 and notification number S.O. 91 ( E) dated 27th January, 2003 , issued under clause ( b ) of sub - rule (2) of rule 1 of the Central Motor Vehicles (3rd Amendment) Rules, 2000 and clause ( b) of sub- rule ( ii ) of rule 1 of the Central Motor Vehicles (2nd Amendment ) Rules, 2001 , the provisons of sub - rule ( 11 ) shall , in respect of four wheeled vehicles manufactured on and from the 1st April , 2005, come into force in all States and Union Territories on the 1st day of April , 2005. " .
