साःका.नि. 928( अ ) - व्यापार चिन्ह ( बौद्धिक संपदा अपील बोर्ड के लिए आवेदन और अपील) नियम , 2003 का प्रारूपं व्यापार चिन्ह अधिनियम , ( 1999 का 47 ) की धारा 157 की अपेक्षानुसार भारत सरकार के वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) की अधिसूचना सं . सा. का.नि. 782 (अ) तारीख 4 अक्तूबर , 2003 द्वारा, भारत के राजपत्र , असाधारण, भाग-2 , खंड-3 उपखंड ( ⅰ ) तारीख 4 अक्तूबर , 2003 में प्रकाशित किया गया था, जिसमें सभी व्यक्तियों से जिनको उससे प्रभावित होने की संभावना थी उस तारीख , जिसको इस अधिसूचना से युक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थी , 15 दिन की समाप्ति से पूर्व आक्षेप और सुझाव आमंत्रित किए गए थे ;

और अधिसूचना से युक्त राजपत्र की प्रतियां जनता को 7 अक्तूबर , 2003 को उपलब्ध करा दी गई थी ।

और जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा विचार कर लिया गया है;

[PART II-SEC. 3(i)) अतः , अब, केन्द्रीय सरकार, व्यापार चिन्ह अधिनियम, 1999 ( 1999 का 4 ) की धारा 157 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती है, अर्थात् : -

1. संक्षिप्त नाम और प्रारंभ (1 ) इन नियमों का संक्षिप्त नाम व्यापार चिन्ह (बौद्धिक संपदा अपील बोर्ड के लिए आवेदन और अपील) नियम, 2003 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. आवेदन और अपील अपील बोर्नु को आवेदन करने की रीति और अपीलों के प्ररूप तथा उनके सत्यापन की रीति वह होगी जो इन नियमों की पहली अनुसूची में उपबंधित है ।

3. फीस अपील बोर्ड के समक्ष आवेदन करने और अपील करने के लि फीस वह होगी जो इन नियमों की दूसरी अनुसूची में यथाविनिर्दिष्ट है जिसे चेन्नई में संदेय बैंक ड्राफ्ट के माध्यम से संदत्त किया जाएगा और उपरजिस्ट्रार बौद्धिक संपदा अपील बोर्ड के पक्ष में आहरित किया जाएगा ।

(तीन प्रतियों में मामले के कथन की तीन प्रतियों सहित और उनमें से प्रत्येक की उतनी प्रतियों के साथ जितने रजिस्ट्रीकरण के अधीन रजिस्ट्रीकृत उपयोक्ता हैं, फाइल किया जाए ) रजिस्ट्रीकृत. मैं हम(1) के नाम में संख्या वर्ग में वाले व्यापार चिन्ह के विषय में .यह आवेदन करता हूं/ करते हैं कि ऊपर वर्णित व्यापार चिन्ह के बारे में रजिस्टर में प्रविष्ट निम्नलिखित रीति में ( हटा दी जाए ) (2) ( परिशोधित की जाए) -- मेरे/ हमारे आवेदन के आधार निम्नलिखित हैं--

NOTIFICATION

New Delhi , the 5th December, 2003

G.S.R. 928 (E) .- Whereas the draft of the Trade Marks (Applications and appeals to the Intellectual Property Appellate Board) Rules , 2003 were published , as required by section 157 of the Trade Marks Act , 1999 (47 of 1999) in Gazette of India, Extraordinary, Part- II , Section 3, sub-section ( i ) dated the 4th October, 2003 , vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion ) number GSR 782 ( E) dated 4th October, 2003, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of fifteen days from the date on which copies of the Gazette containing the notification were made available to the public;

And whereas the copies of the Gazette containing the notification were made available to the public on 7th October, 2003;

And whereas the objections and suggestions received from the public have beenconsidered by the Central Government;

Now , therefore , in exercise of the powers conferred by section 157 of the Trade Marks Act, 1999 (47 of 1999) , the Central Government hereby makes the following rules , namely: -

1. Short title and commencement. ( 1 ) These rules may be called the Trade Marks(Applications and Appeals to the Intellectual Property Appellate Board) Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

Applications and appeals . - The manner of making applications and the 2. forms of appeals to the Appellate Board and the manner of verification thereof shall be as provided in the First Schedule to these rules.

3. Fees. The fees for filing applications and appeals before the Appellate Board shall be as specified in the Second Scheduleto these rules which 20

[PART II-SEC. 3 (i)] shall be paid by way of bank draft payable at Chennai drawn in favour of the Deputy Registrar , Intellectual Property Appellate Board.
