का.आ. 1408( अ )- केन्द्रीय सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा उक की उप- धारा (1 ) के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का ० आ 0 999 (अ) तारीख 29 अगस्त, 2003, द्वारा जो भारत के राजपत्र, असाधारण, भाग 2 , खंड 3 उपखंड (ii) तारीख 29 अगस्त, 2003 को प्रकाशित की गई थी, कर्नाटक राज्य में 550 कि.मी. से तथा 11/11 कि.मी. पर (हैदराबाद- बंगलौर खण्ड के येलहंका तथा चेन्नासांद्रा स्टेशनों के बीच) के भूखण्ड पर राष्ट्रीय राजमार्ग संख्या -7 को चौड़ा करने के लोक प्रयोजन के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी ;
और उक्त अधिसूचना का सार 14 सितंबर 2003 के डेकन हेराल्ड और कन्नड़प्रभा समाचारपत्रों में प्रकाशित हुआ था;
और उक्त अधिसूचना में उल्लिखित प्रयोजन के लिए भूमि के उपयोग पर सक्षम प्राधिकारी द्वारा किसी व्यक्ति से कोई आक्षेप प्राप्त नहीं हुए हैं;
और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा उघ की उप- धारा (1 ) के अनुसरण में,. केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
अतः, अब केन्द्रीय सरकार उक्त रिपोर्ट के प्राप्त हो जाने पर और उक्त अधिनियम की धारा उघ की उप धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जानी चाहिए ;

[PART II -SEC. 3 (ii)) और उक्त अधिसूचना की धारा उघ की उपधारा (2) के अधीन इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि, राजपत्र में इस अधिसूचना के प्रकाशन पर, सभी विल्लंगमों से मुक्त आत्यन्तिक रूप से केन्द्रीय सरकार में निहित होगी ।

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS
NOTIFICATION
New Delhi , the 10th December , 2003
S.O. 1408 (E)-Whereas by the notification of the Govemment of India in the Ministry of Road Transport and Highways , number S.O. 999 ( E) , dated the 29th August, 2003 (said notification ) , issued under sub - section ( 1 ) of section 3A of the National Highways Act , 1956 (48 of 1956) ( hereinafter referred to as the said Act) , and published in the Gazette of India , Extraordinary , Part II , Section 3 , Sub- section (ii) , dated the 29th August 2003, the Central Government declared its intention to acquire the land specified in the Schedule appended to the said notification for the public purpose of building ( widening) of National Highways No.7 in the land stretch from Km . 550 and falling Km . 11/11 ( between Yelahanka and Channasandra stations of Hyderabad - Bangalore Section) in the State of Karnataka;
And whereas the substance of the said notification has been published in newspapers on 14th September 2003 Deccan Herald and Kannadaprabha .
And Whereas no objections have been received by the competent authority from any person on the use of the land , for the purpose mentioned in the said notification;
And whereas in pursuance of sub-section ( 1 ) of section 3D of the said Act, the competent authority has submitted its report to the Central Government;
Now, therefore , upon receipt of the said report and in exercise of the powers conferred by sub- section ( 1 ) of section 3D of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed hereto should be acquired for the aforesaid purpose;
And further, on the publication of this notification in the Official Gazette , the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances under sub- section ( 2) of section 3D of the said Act .
