का.आ. 1424( अ ) - जबकि विदेशी मुद्रा प्रबंध अधिनियम , 1999 ( 1999 का 42 ) के प्रावधानों को दिनांक 1 जून, 2000 से प्रभावी बनाने के लिए दिनांक 1 मई, 2000 को भारत के राजपत्र में प्रकाशित सा.का. नि. 371 ( अ ) द्वारा प्रवृत्त किया गया था;
और जबकि केन्द्रीय सरकार ने निरस्त अधिनियम की धारा 51 के अधीन उल्लंघन के लिए कार्रवाई करने के लिए, विदेशी मुद्रा विनियमन अधिनियम, 1973 ( निरस्त अधिनियम ) की धारा 50 के अन्तर्गत प्रदत्त शक्तियों का प्रयोग करते हुए राजपत्र में प्रकाशित एक आदेश द्वारा केन्द्रीय सरकार के कतिपय अधिकारियों को नियुक्त किया और निरस्त अधिनियम के प्रावधानों के अधीन कार्रवाईयां भी शुरू कीं;
और जबकि, केन्द्र सरकार ने दिनांक 28 नवम्बर, 2003 के का.आ. 1394 ( अ ) के द्वारा सरकारी राजपत्र में प्रकाशित एक आदेश द्वारा , उक्त पैराग्राफ 2 के अधीन की गई कार्रवाई को सतत प्रभाव देने के लिए कतिपय अधिकारियों को प्रवर्तन अधिकारी के रूप में नियुक्त किया । अब, इसलिए, विदेशी मुद्रा विनियमन अधिनियम, 1973 ( निरस्त अधिनियम ) की धारा 5 के साथ और विदेशी मुद्रा प्रबंध अधिनियम, 1999 (1999 का 42 ) की धारा 49 की उप- धारा (3 ) और (4 ) के साथ पठित निरस्त अधिनियम की धारा 50 के अन्तर्गत प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार नीचे सारणी में दिए गए उल्लिखित व्यक्तियों को निरस्त अधिनियम के किसी भी प्रावधान [ धारा 13, धारा 18 के खण्ड ( क) , धारा 19 की उप- धारा ( 1 ) के उप - खण्ड ( क ) को छोड़कर ] के उल्लंघन अथवा उसके अन्तर्गत बनाए गए किसी नियम अथवा निर्देश अथवा आदेश के उल्लंघन के मामलों, ऐसे मामले जिन्हें प्रवर्तन निदेशालय द्वारा सौंपा गया हो, का न्यायनिर्णयन करने के लिए न्यायनिर्णयन अधिकारियों के रूप में कार्य करने के लिए नीचे सारणी में उल्लिखित व्यक्तियों को प्राधिकृत करती है, अर्थात्:-

NOTIFICATION
New Delhi , the 16th December, 2003
S.O. 1424 (E ). Whereas the provisions of the Foreign Exchange Management Act, 1999 (42 of 1999 ) were brought into force vide G.S.R. 371 ( E ) published in the Gazette of India on 1st May, 2000 giving effect to the provisions of the said Act from 1st June , 2000 ;
And, whereas the Central Government by an Order published in the Gazette in exercise of the powers conferred under Section 50 of Foreign Exchange Regulation Act , 1973 (repealed Act ) appointed certain officers of the Central Governinent to take action for contravention under Section 51 of the repealed Act and also initiated certain actions under the provisions of the repealed Act ;
And, whereas , the Central Government by an order published in the Official Gazette vide S.O. 1394 ( E ) dated 28th November, 2003 appointed certain officers as Officers of Enforcement to give continued effect for the action taken under paragraph 2 above .
Now, therefore , in exercise of the powers conferred under Section 50 of the Foreign Exchange Regulation Act, 1973 ( repealed Act ) read with Section 5 of the repealed Act and sub - sections (3 ) and (4) of Section 49 of the Foreign Exchange Management Act , 1999 (42 of 1999 ) , the Central Government authorises the persons mentioned in the Table below to function as adjudicating officers to adjudicate the cases of contravention of any of the provisions of the repealed Act [other than Section 13 , clause ( a) of Section 18 , sub-clause (a) of sub - section ( 1 ) of Section 19] or any rule or direction or order made thereunder , such cases as may be assigned by the Directorate of Enforcement , namely :-
