का.आ. 1428 ( अ ) - केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) (जिसे इसमे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 क की उपधारा ( 1 ) के अधिन जारी की गई भारत सरकार के सडक परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 471 (अ) तारीख 25 अप्रैल 2003 , द्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग संख्या- 8 अ के 280.080 कि.मी. (राजकोट जिला सीमा) से 308.000 कि.मी. ( समाखियाली ) (बामनबोर- समाखियाली सेक्शन) तथा राष्ट्रीय राजमार्ग संख्या- 15 के 281.300 कि.मी. ( समाखियाली) से 207.350 कि.मी. (पाटन जिला सीमा) ( समाखियाली - राधनपुर सेक्शन) मे भूखण्ड पर (चार लेन) का निर्माण , अनुरक्षण , प्रबन्ध और प्रचालन के लोक प्रयोजन उस अधिसूचना से संलग्न अनुसूचि में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी ;
और सक्षम प्राधिकारी ने , उक्त अधिनियम की धारा 3 द्य की उपधारा ( 1 ) के अनुसरण , में केन्द्रीय सरकार को अपनी रिपोर्ट प्रस्तुत कर दी है ;
अतः अब , केन्द्रीय सरकार , सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त हो जाने पर और उक्त अधिनियम की धारा 3 द्य की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , यह द्योषणा करती है कि इससे संलग्न अनुसुचि में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जानी है ;
और , केन्द्रीय सरकार , उक्त अधिनियम की धारा 3 द्य की उपधारा (2) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , द्योषणा करती है कि इससे संलग्न अनुसुचि में विनिर्दिष्ट भूमि, राजपत्र में इस अधिसूचना के प्रकाशन पर सभी विल्लंगमो से मुक्त आत्यन्तिक रुप से केन्द्रीय सरकार में निहित होगी ।.

NOTIFICATION
New Delhi , the 17th December , 2003
S.O. 1428 (E) .- Whereas , by the notification of the Government of India in the Ministry Transport and Highways , number S.O. 471 (E) dated the 25th April 2003 , issued under sub - section ( 1 ) of section 3A of the National Highways Act , 1956 (48 of 1956) , (hereinafter referred to as the said Act ) , the Central Government declared its intention to acquire the lands specified in the Schedule appended to that notification 3

for the public purpose for building , maintenance , management and operation of Bamanbore Samakhiali Section in respect of land stretch from km 280.080 (District Border Rajkot ) to km 308 ( Samakhiali ) on the National Highway No 8A and Samakhiali- Radhanpur Section in respect of land stretch from km 281/300 ( Samakhiali ) to km 207/350 (District Border Patan ) (four laning ) on the National Highway No- 15 in the State of Gujarat .
And whereas , in pursuance of sub - section (I ) of section 3D of the said Act, the competent authority has submitted its report to the Central Government ;
Now, therefore, upon receipt of the said report of the competent authority , and in exercise of the powers conferred by sub - section ( 1 ) of section 3D of the said Act, the Central Government hereby declare that the lands specified in the Schedule annexed hereto are to be acquired for the aforesaid purpose ;
And, further in exercise of the powers conferred by sub- section (2) of section 3D of the said Act, the Central Government hereby declares that on the publication of this notification in the official Gazette the lands specified in the Schedule annexed hereto shall best absolutely in the Central Government free from all encumbrances .
