सा.का.नि. 953( अ )- केन्द्रीय सरकार, चीनी विकास निधि अधिनियम, 1982 ( 1982 का 4 ) की धारा १ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, चीनी विकास निधि नियम, 1983 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. (1 ). इन नियमों का संक्षिप्त नाम चीनी विकास निधि ( पांचवां संशोधन ) नियम, 2003 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. चीनी विकास निधि नियम, 1983 के नियम 16 के उपनियम (9 ) में, खंड ( iii ) के पश्चात् निम्नलिखित खंड ( ii- अ) अंतःस्थापित किया जाएगा , अर्थात्:-
" ( ii अ ) ( क) चीनी उपक्रम उपरोक्त खंड ( i ) में निर्दिष्ट करार के निष्पादन के पश्चात् और उपनियम ( 7 ) के अधीन ऋण संवितरण के पूर्व, केंद्रीय सरकार के समाधान पर ऋण की प्रतिभूति देगा ।
(ख ) प्रतिभूति खंड (iv) में यथाउपबंधित प्रतिदाय की पूर्ण अवधिके लिए ऋण की रकम और उस पर ब्याज सम्मिलित होगा और निम्नलिखित किसी रीतियों से दिया जाएगा, अर्थात्:-
( 1 ) किसी अनुसूचित बैंक से बैंक गांरटी, या
(2) समरूप प्रभार के आधार पर चीनी उपक्रम की सभी स्थावर और जंगम संपत्तियों पर कोई बंधक, जिसके न हो सकने पर, अनन्य दूसरे प्रभार के आधार पर । "

(Department of Food and Public Distribution) NOTIFICATION
NewDelhi , the 17th December , 2003
G.S.R. 953(E) . In exercise of the powers conferred by Section 9 of the Sugar Development Fund Act, 1982 (4 of 1982) , the Central Government hereby makes the following rules further to amend the Sugar Development Fund Rules, 1983 , namely :-
1. (1) These rules may be called the Sugar Development Fund (Fifth Amendment) Rules , 2003 .
(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Sugar Development Fund Rules , 1983, in rule 16, in sub-rule (9) , after clause ( ii ) , the following clause ( ii-A) shall be inserted, namely:--

Note: The principal rules were published in the Gazette " (ii -A) ( a ) The sugar undertaking shall, after the execution of the agreement referred to in clause ( i ) above , and before the disbursement of the loan under sub- rule (7 ) , furnish security for the loan to the satisfaction of the Central Government .
(b) The security shall cover the amount of loan and interest thereon for the full period of repayment as provided in clause ( iv) , and shall be furnished in any ofthe following manners , namely:-
( 1) Bank Guarantee from a Scheduled Bank, or
ofIndia vide No. GSR 752 (E) dated 28-9-83 and subsequently amended vide GSR 817 (E ) dated 20-12-84, GSR 838(E) dated 14-11-85, GSR551 (E) dated6-5-88, GSR235 (E) dated 24-4-91 , GSR441 (E) dated 28-4-92 , GSR435 (E) dated 6-5-94, GSR27 (E) ' dated 12-1-96 , GSR 656(E) dated 21-11-1997, GSR 91 (E) dated 12-02-2001 , GSR 886 (E ) dated 6-12-2001 , GSR443 (E) dated 21-6-2002, GSR 584 (E) dated 19-8-2002 , GSR 67 (E) dated 29-1-2003 , GSR241 (E) dated 25-3-2003 , GSR 787 (E) dated 06-10-2003 and GSR 985 (E) dated 19-11-2003.
(2) A mortgage or all immovable and movable properties of the sugar undertaking on pari passu
