का.आ. 1436 (अ). - केन्द्रीयं सरकार ने कोयला धारक क्षेत्र (अर्जन और विकास) अधिनियम 1957 (1957 का 20) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 4 की उपधारा ( 1 ) के अधीन जारी भारत सरकार के तत्कालीन कोयला और खान मंत्रालय, कोयला. विभाग की अधिसूचना सं. का. आ. 3450 तारीख 10 दिसंबर, 2001 द्वारा जो भारत के राजपत्र, भाग 2 , खंड 3 , उपखंड ( ii ) , तारीख 22 दिसंबर, 2001 में प्रकाशित की गई थी , उससे उपाबद्ध अनुसूची में और इस अधिसूचना से संलग्न अनुसूची में भी , विनिर्दिष्ट परिक्षेत्र की भूमि में जिसका माप 353.00 हेक्टर ( लगभग ) या 872.26 एकड़ ( लगभग ) है, कोयले का पूर्वेक्षण करने के अपने आशय की सूचना दी थी;
और, उक्त भूमि की बाबत उक्त अधिनियम की धारा 7 की उपधारा (1 ) के अधीन कोई सूचना नही दी गई है ।
अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 7 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तारीख 22 दिसंबर, 2003 से प्रारंभ होने वाली एक वर्ष की और अवधि, को ऐसी अवधि के रूप में विनिर्दिष्ट करती है, जिसके भीतर केन्द्रीय सरकार उक्त भूमि में या ऐसी भूमि में या उन पर के किन्हीं अधिकारों का अर्जन करने के अपने आशय की सूचना दे सकेगी ।

रेखा बिन्दु ' क' से आरंभ होकर, ग्राम कान्हवा और कलमना, कान्हवा और धामनगांव की सम्मिलित ग्राम सीमा के साथ - साथ गुजरती है और बिन्दु ' ख ' पर मिलती है । खगः रेखा ग्राम धामनगांव से होकर जाती है और ग्राम खुरसापार और सिरपुर की सम्मिलित ग्राम सीमा के साथ - साथ गुजरती है और बिन्दु ' ग ' पर मिलती है ।
ग-घ-ड.: रेखा ग्राम सिरपुर से होकर जाती है और ग्राम कटारा और सिरपुर की सम्मिलित ग्राम सीमा के साथ- साथ गुजरती है और ग्राम कटारा से होकर आगे बढती है और बिन्दु ' ड. ' पर मिलती है ।
ड. चः रेखा ग्राम कटारा से होकर जाती है और रेलवे लाईन की दक्षिणी सीमा के साथ- साथ- साथ गुजरती है और बिन्दु च पर मिलती है ।

MINISTRY OF COAL
NOTIFICATION
New Delhi , the 18th December, 2003
S.O. 1436(E). Whereas by the notification of Government of India in the then Ministry of Coal and Mines , Department of Coal , Number S.O. 3450 dated the 10th December , 2001 , issued under sub - section ( 1 ) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published in Part II , section 3 , sub- section ( ii ) of the Gazette of India dated the 22nd December , 2001 , the Central Government gave notice of its intention to prospect for coal in lands measuring 353.00 hectares (approximately ) or 872.26 acres (approximately) in the locality specified in the Schedule appended thereto and also in the Schedule annexed to this notification;
And whereas in respect of the said lands , no notice under sub - section ( 1 ) of section 7 of the said Act has been given .
Now, therefore, in exercise of the power , conferred by sub - section ( 1 ) of section 7 of the said Act , the Central Government hereby specifies a further period of one year commencing from the 22nd December, 2003 as the period within which the Central Government may give notice of its intention to acquire the said lands or any rights in or over such lands .
