सं.409-5/2003 -एफएन . भारतीय दूरसंचार विनियामक प्राधिकरण, विभिन्न सेवा प्रदाताओं के बीच अंतःसंयोजन की शर्तें नियत करने, उनके बीच प्रभावकारी अंतः संयोजन सुनिश्चित करने तथा दूरसंचार सेवाएं प्रदान करने से प्राप्त अपने- अपने राजस्व की भागीदारी के लिए सेवा प्रदाताओंके बीच व्यवस्थानियंत्रित करने के लिए, भारतीय दूरसंचार विनियामक प्राधिकरण ( संशोधन ) अधिनियम, 2000 द्वारा यथासंशोधित भारतीय दूरसंचार विनियामक प्राधिकरण अधिनियम, 1997 की धारा 11 ( 1 ) की उपधारा ( ख ) के खंड ( ii ) , ( iii ) तथा ( iv ) के साथ पठित धारा 36 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित विनियम बनाता है :-

खंड- I
शीर्षक,विस्तार और प्रारम्भ
1. संक्षिप्त नाम, विस्तार और प्रारंभ
( i ) इस विनियम का नाम " दूरसंचार अंतः संयोजन उपयोग प्रभार ( दूसरा संशोधन ) विनियम 2003 " होगा ।
( ii ) यह विनियम सरकारी राजपत्र में इसकी अधिसूचना की तारीख से प्रवृत्त हुआ समझा जाएगा।
खंड- II
2.1 दूरसंचार अंतः संयोजन उपयोग प्रभार विनियम 2003 के खंड- IV के भाग 4 में , उपभाग ( ii ) को मिटाकर उसके स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगाः
" ( ii ) आई.यू.सी. के वास्तविक रूप में लागू होने की तारीख 1 जनवरी, 2004 होगी।"

करता है । इस विनियम में अनुलग्नक, क पर एक व्याख्यात्मक ज्ञापन दिया गया है जो इस विनियम से जुड़े मामलों पर स्पष्टता और पारदर्शिता प्रदान

व्याख्यात्मक ज्ञापन
1. दिनांक 29-10-2003 को जारी अंतः संयोजन उपयोग प्रभार विनियम में, शुरू में यह परिकल्पना की गई थी कि संशोधित आई.यू.सी. व्यवस्था1-12-2003 से कार्यान्वित हो जाएगी । इस विनियम के अनुसार, उस तारीख तक विद्यमान समस्त अंतः संयोजन समझौतों/व्यवस्थाओं को आई.यू.सी. व्यवस्था के संशोधित फ्रेमवर्क के अनुसार संशोधित विनियम के वास्तविक रूप से लागू होने की तारीख याने 1 दिसंबर, 2003से संशोधित माना जाएगा ताकि ये इस संशोधित आई.यू.सी. व्यवस्था की विद्यमान संरचना के अनुरूप हों और इन्हें इस विनियमके लागू होने के 15 दिनों के भीतर पंजीकरण के लिए और रिपोर्टिंग आवश्यकतानुसार परिवर्तनों के लिए टी.आर.ए. आई. को प्रस्तुत किया जाए ।
2. प्राधिकरण को सेवा प्रदाताओं से इस व्यवस्था पर स्पष्टीकरणों के लिए कई आवेदन प्राप्त हुए थे और दूरसंचार अंतः संयोजन उपयोग प्रभार विनियम 2003 ( 2003 का क्रमांक 4 ) दिनांक 29 अक्तूबर, 2003 के लागू होने की तारीख को, दूरसंचार अंतः संयोजन उपयोग प्रभार (प्रथम संशोधन) विनियम 2003 ( 2003 का क्रमांक 5 ) दिनांक 25 नवम्बर, 2003 द्वारा लागू होने की तारीख को 1 दिसम्बर, 2003 को स्थगित करते हुए 15 दिसम्बर, 2003 कर दिया गया था ।
3. इस मामले पर सेवा प्रदाताओं के साथ प्राधिकरण की विस्तृत बैठकें हुईं, और कई मुद्दों पर स्पष्टीकरण दिए गए । प्राधिकरण को अब आईयूसी ( IUC ) व्यवस्था के कार्यान्वयन को स्थगित करने के लिए विभिन्न सेवा प्रदावाओं से अनुरोध प्राप्त हुए हैं । एकीकृत अभिगम लाइसेंस याने यूनीफाइड एक्सेस लाइसेंस व्यवस्था के फ्रेमवर्क के भीतर, खास तौर पर नम्बरिंग पहलू को देखते हुए, जिसके लिए सरकार काअनुमोदन आवश्यक होगा, आईयूसी व्यवस्था को पूरी तरह लागू करने के लिए एक से तीन सप्ताह तक स्थगित कर देने के अनुरोध किए गए हैं । एकीकृत अभिगम सेवा लाइसेंस स्थानांतरण अर्थात् यूनीफाइड एक्सेस सर्विस लाइसेंस स्थानांतरण की अनुवर्ती कार्रवाई के तहत नम्बरिंग मुद्दों के बारे में प्राधिकरण , दूरसंचार विभाग को सिफारिशें देने के लिए विचार कर रहा है ।
4. उपर्युक्त को देखते हुए, 29 अक्तूबर, 2003 को जारी दूरसंचार अंतः संयोजन उपयोग प्रभार विनियम, 2003 (2003 का क्रमांक 4 ) के लागू होने की तारीख 1 जनवरी , 2004 होगी और सेवा प्रदाताओं को इस विनियम से सुसंगत संशोधित अंतःसंयोजन करार 15 जनवरी , 2004 तक प्राधिकरण को भेजने होंगे ।

No. 409-5/2003-FN.-- In exercise of the powers conferred upon it under Section 36 read with clauses ( ii ) , (iii ) and (iv) of Sub - section (b) of Section 11 ( 1 ) of the Telecom Regulatory Authority of India Act, 1997 as amended by TRAI (Amendment) Act, 2000 , to fix the terms and conditions of interconnectivity between Service Providers , to ensure effective interconnection between different service providers and to regulate arrangement amongst service providers of sharing their revenue derived from providing telecommunication services , the Telecom Regulatory Authority of India hereby makes the following Regulation :-

Section-I
Title, Extent and Commencement
1. Short title, extent and commencement :
(i ) This Regulation shall be called " The Telecommunication Interconnection Usage Charges (Second Amendment) Regulation, 2003 ".
(ii ) The Regulation shall be deemed to have come into force from the date of its notification in the Official Gazette.

Section-II
2.1 In clause 4 under Section IV of The Telecommunication Interconnection Usage Charges Regulation, 2003 , Sub-clause ( ii) shall be deleted and substituted by the following :
(ii) The date of effect for actual implementation of IUC shall be 1st January, 2004. "

3. ExplanatoryMemorandum
This Regulation contains at Annex A, an explanatory memorandum to provide clarity and transparency to matters covered under this Regulation.

EXPLANATORY MEMORANDUM
1. The Telecommunication Interconnection Usage Charges Regulation issued on 29th October, 2003 had initially envisaged the implementation of the revised IUC regime by 1-12-2003 . As per this Regulation, all existing interconnect agreements/arrangements as on date were to stand amended on the date of actual implementation of this Regulation, i.e. Ist December, 2003 , so as to conform to the framework of the revised IUC regime and these have tobe submitted to TRAI for registration within 15 days of implementation of this Regulation, and for subsequent changes as per reporting requirement .
2. The Authority received several communications from service providers seeking clarifications on the regime andthe date of implementation for the Telecommunication Interconnection Usage Charges Regulation, 2003 (4 of2003) dated29th October, 2003 was postponed from 1st December , 2003 to 15th December, 2003 vide ' The Telecommunication Interconnection Usage Charges (First Amendment) Regulation, 2003 (5 of 2003 )' dated 25th November, 2003 .
3. The Authority has had detailed meetings with the service providers on this matter , and has also clarified a number of issues. The Authority has now received requests from various service providers for postponement of the implementation of the IUC regime. These requests seek postponement from one to up to three weeks to fully implement the IUC regime with a framework of the Unified Access License regime specifically with regard to the numbering aspect, for which the approval of Government is necessary. The Authority is considering recommending to DOT regarding numbering issues as a follow up of Unified Access Service License Migration .
4. In view of the above , the date of implementation for the Telecommunication Interconnection Usage Charge Regulation, 2003 (4 of 2003 ) dated 29th October, 2003 will now be 1st January, 2004 and the service providers have to filewith the Authority the amended interconnect agreement, in conformity with this Regulation latest by 15th January, 2004.
