का.आ. 1457(अ ) .-केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय की अधिसूचना सं. का.आ. 572 ( अ ) तारीख 7 जुलाई, 1998 द्वारा , राजस्थान राज्य में राष्ट्रीय राजमार्ग सं. 8 के 273/500 कि.मी. से 363/885 कि.मी. तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें पश्चात् प्राधिकरण कहा गया है ) को सौंप दिया है ;
और, प्राधिकरण ने उक्त राष्ट्रीय राजमार्ग के उक्त खंड के विकास के लिए जी.वी. के. जयपुर, किशनगढ़ एक्सप्रेसवे प्राइवेट लिमिटेड, एफ-48/49, मालवीय औद्योगिक क्षेत्र, जयपुर, राजस्थान, ( जिसे इसमें पश्चात् समनुदत्ती कहा गया है ) के साथ करार कर लिया है ;
और केन्द्रीय सरकार ने उक्त राष्ट्रीय राजमार्ग के उक्त खंड के विकास के लिए प्राधिकरण और समनुदत्ती के बीच किए गए पूर्वोक्त करार के निबंधनों के अनुसार उक्त राष्ट्रीय राजमार्ग से फीस उद्ग्रहीत और संग्रहीत करने के लिए फीस अधिसूचना जारी करने के लिए प्राधिकरण के साथ करार कर लिया है;
अतः , अब केन्द्रीय सरकार, राष्ट्रीय राजमार्ग ( किसी व्यक्ति द्वारा राष्ट्रीय राजमार्ग खंड राष्ट्रीय राजमार्ग पर स्थायी पुल/ अस्थायी पुल के उपयोग के लिए फीस वसूल करना ) नियम , 1997 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 45 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त राष्ट्रीय राजमार्ग के उक्त खंड के निर्माण , अनुरक्षण , प्रबंध और प्रचालन में हुए खर्च निवेशित पूंजी पर ब्याज, उचित लाभ, यातायात की मात्रा और प्राधिकरण और समनुदत्ती के बीच हुए ऐसे करार की अवधि को ध्यान में रखते हुए अधिसूचित करती है कि राजस्थान राज्य में राष्ट्रीय राजमार्ग सं. 8 के 273/500 कि.मी. से प्रारंभ होकर 363/885 कि.मी. तक के उक्त खंड के उपयोग के लिए यांत्रिक यानों पर नीचे अनुसूची में विनिर्दिष्ट दर पर फीस उद्ग्रहीत और संग्रहीत की जाएगी और उक्त समनुदत्ती को वाणिज्यिक प्रचालन की तारीख से ही पर्यवसान की तारीख तक उक्त फीस के लिए प्राधिकृत करती है ।
परिभाषाएं, अधिसूचना में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -
(i ) " वास्तविक फीस " से समुचित पथकर बूथों के बीच दूरी जो प्राधिकरण द्वारा अनुमोदित की जाए और इस अधिसूचना की अनुसूची में दी गई आधार फीस दोनों पर आधरित सड़क उपयोक्ताओं पर वास्तविक रूप से प्रभारित फीस अभिप्रेत है ;
(ii ) " वाणिज्यिक प्रचालन की तारीख " से वह तारीख अभिप्रेत है जिसको राजस्थान राज्य में राष्ट्रीय राजमार्ग सं. 8 के 273/500 कि. मी. से 363/885 कि. मी. तक के खंड का वाणिज्यिक प्रचालन प्रारंभ होता है जो वह तारीख होगी जिसको स्वतंत्र परामर्शी यथास्थिति प्राधिकरण और समनुदत्ती के बीच हुए करार के उपबंधों के अनुसार उक्त राष्ट्रीय राजमार्ग के उक्त खंड के छः लेन बनाने के समापन पर समापन प्रमाण पत्र या अनंतिम प्रमाण पत्र जारी करता है;

[PART II-SEC . 3 (ii)] (iii) " पर्यवसान की तारीख " से वह तारीख अभिप्रेत है जिसको उक्त करार के उपबंधों के अनुसरण में प्राधिकरण और समनुदत्ती के बीच हुआ उक्त करार समाप्त होता है या किसी पर्यवसान सूचना द्वारा समाप्त कर दिया जाता है;
( iv ) " स्थानीय निजी यातायात " से अभिप्रत है और जिसके अंतर्गत ऐसा निजी यान भी है, जो किसी ऐसे व्यक्ति द्वारा जी.वी. के. जयपुर किशनगढ़ एक्सप्रेसवे प्राइवेट लिमिटेड, के पास रजिस्ट्रीकृत किया गया है, जो सामान्यतः किसी ऐसे स्थान पर निवास करता है या कार्य करता है, जिस पर उस खंड के किसी भाग के उपयोग द्वारा ही सामान्यतः पहुंचा जा सकता है और ऐसे व्यक्ति से उक्त खंड के किसी भाग पर उसके कार्य के स्थान से या निवास को या वहां से सामान्य यात्रा के दौरान एक से अधिक प्लाजा को पार किए बिना ऐसे यानों का उपयोग किया जाना अपेक्षित है , अभिप्रेत है;
(v ) " स्थानीय वाणिज्यिक यातायात " से कोई ऐसा वाणिज्यिक यान अभिप्रेत है जिसके अंतर्गत माल और यात्रियों के वहन करने में लगी बस, ट्रक, हल्के मोटर यान या टैक्सी हैं, जो जी.वी. के.-जयपुर किशनगढ़ एक्सप्रेसवे प्राइवेट लिमिटेड, के पास रजिस्ट्रीकृत हैं और जो एक से अधिक प्लाजा को पार किए बिना उक्त खंड पर नियमित रूप से चलाई जा रही हैं;
(vi ) इस अधिसूचना में प्रयुक्त शब्दों और पदों के , जो परिभाषित नहीं हैं किन्तु राजस्थान राज्य में राष्ट्रीय राजमार्ग सं. 8 के 273/500 कि.मी. से 363/885 कि. मी. तक के खंड की बाबत प्राधिकरण और समनुदत्ती के बीच हुए करार में परिभाषित हैं, वही अर्थ होंगे जो उक्त करार में कमशः उनके हैं ।
अनुसूची
राजस्थान राज्य में राष्ट्रीय राजमार्ग सं. 8 के 273/500 कि.मी. से 363/885 कि. मी. तक के उपयोक्ताओं से वसूल की जाने वाली आधार फीस की दरें ।
फीस 1 जुलाई , 1997 को लागू 286/450 कि.मी. से 286/950 कि.मी. तक के बीच जयपुर के अंत में एक और 360/200 कि.मी. से 360/700 कि.मी. के बीच किशनगढ़ के अंत में दूसरा, दो प्लाजाओं पर संग्रहीत की जाएगी ।

मशीनरी जिसके अंतर्गत वॉयलर टर्बिन, जेनेटर आदि ले जाने वाले बड़े आकार केयान भी हैं ।
टिप्पण:
पूर्वोक्तफीस हर वर्ष 1 जुलाई से प्रतिवर्ष पुनरीक्षित की जाएगी । पुनरीक्षित फीस निम्नानुसार संगणित (" संगणित फीस " ) की जाएगी:-

*डब्ल्यूपीआई- ए = 31 मार्च, 1997 को थोक कीमत सूचक है ।
*डब्ल्यूपीआई- बी = फीस पुनरीक्षण तारीख की पूर्ववर्ती 31 मार्च को थोक कीमत सूचक है । प्रभारित की जाने वाली वास्तविक फीस निकटतम पांच रुपए की पूर्णांकित होगी ।
2. निम्नलिखित यानों की बाबत कोई फीस संदेय या संग्रहीत नहीं की जाएगी , अर्थात्: -
(क) रक्षा यान;

(ख) पुलिस यान;
(ग) अग्नि शमन यान;
(घ) एंबुलेंस;
(ङ) अंत्येष्टि बैन;
(च) डाक व तार विभाग के यान;
( छ ) ड्यूटी पर केन्द्रीय सरकार और राज्य सरकार के यान;
(ज) " अति महत्वपूर्ण व्यक्ति" प्रतीक वाले यान;
(झ) निम्नलिखित से संबंधित यान;
(i) भारत का राष्ट्रपति;
(ii) भारत का उपराष्ट्रपति;
(iii) केन्द्रीय और राज्य मंत्री;
(iv ) लोक सभा/राज्य सभा/ राज्य विधान मंडलों में विपक्ष के नेता जिनकी प्रास्थिति कैबिनेट मंत्री की हो;
(v ) राज्यपाल/ उपराज्यपाल/कार्यकारी पार्षद/केन्द्रीय और राज्य विधान मंडलों के अध्यक्ष या सभापति;
(vi ) संसद सदस्य और विधान सभा परिषद् के सदस्य, उनके निर्वाचन क्षेत्रों के भीतर;
(vii ) भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
(viii) " सी डी" ( राजनयिक कार ) प्रतीक वाली कारों का उपयोग कर रहे भारत में रह रहे विदेशी राजनयिक । 3. फीस की दरें, फीस के संदाय से छूट प्राप्त प्रवर्ग के यान और उस समनुदत्ती का नाम, पता और टेलीफोन सं. जिसकी शिकायत, यदि कोई है, की जानी चाहिए, पथकर बूथों से 500 मीटर आगे और पथकर बूथों पर भी सहजदृश्य रूप से तथा सुस्पष्टतया संप्रदर्शित की जाएगी, संप्रदर्शन बोर्डों की ऊंचाई और अक्षरों का आकार ऐसा हो कि चालकों के लिए उन्हें पढ़ना आसान हो ।
4. समनुदत्ती स्थानीय निजी यातायात और स्थानीय वाणिज्यिक यातायात से निम्नलिखित मितिकाटा दरों से अधिक कोई फीस वसूल नहीं करेगा, अर्थात्: -
(क) स्थानीय निजी यातायात विनिर्दिष्ट प्रवर्ग के यान के लिए लागू फीस का पच्चीस प्रतिशत ।
(ख ) स्थानीय वाणिज्यिक यातायात विनिर्दिष्ट प्रवर्ग के यान के लिए लागू फीस का पचास प्रतिशत ।
5. समनुदत्ती दो स्थानीय समाचार पत्रों ( जिसमें से एक जनभाषा में होगा ) में इस अधिसूचना के सार को प्रकाशित करेगा, जिसमें इस अधिसूचना के उपबंध के अनुसार वाणिज्यिक प्रचालन की तारीख का भी उल्लेख होगा । ऐसा सार इस अधिसूचना के अनुसार पुनरीक्षित फीस को प्रभावी करने के दस दिन पूर्व प्रत्येक वर्ष भी दुहराई जाएगी ।
6. उपयोक्ताओं से प्रभारित की जाने वाली वास्तविक फीस समनुदत्ती द्वारा संगणित की जाएगी और प्रत्येक वर्ष 31 मार्च के पश्चात् यथा संभव शीघ्र किन्तु बढ़ाई गई दर को प्रभावी करने के कम से कम पैंतालीस दिन पूर्व विधिमान्यकरण के लिए प्राधिकरण को भेजी जाएगी । प्राधिकरण फीस पुनरीक्षण प्रस्ताव की प्राप्ति पर यथा संभव शीघ्र किन्तु फीस पुनरीक्षण प्रस्ताव की प्राप्ति के पंद्रह दिन के अपश्चात् कोई टिप्पणी या अनुरोध का स्पष्टीकरण उपलब्ध कराएगा । यदि प्राधिकरण इस अवधि के दौरान टिप्पणी नहीं करता है या स्पष्टीकरण नहीं चाहता है तो समनुदत्ती द्वारा यथा प्रस्तावित पुनरीक्षित फीस प्राधिकरण द्वारा पुष्ट की गई समझी जाएगी ।

NOTIFICATION
NewDelhi , the 20th December, 2003
S.O. 1457 (E ) .- WHEREAS , by the notification of the Government of India in the erstwhile Ministry of Surface Transport , number S.O.572 (E) , dated July 7th, 1998, issued under Section 11 of the National Highways Authority of India Act , 1988 (68 of 1988 ) , the Central Government has entrusted the section from km. 273/500 to km. 363/885 of the National Highway number 8 in the State of Rajasthan to the National Highways Authority of India (herein after referred to as the " Authority") ;
AND , WHEREAS , the Authority has entered into an agreement with GVK- Jaipur Kishangarh Expressway Private Limited, F 48/49 , Malviya Industrial Area, Jaipur , Rajasthan, (herein after referred to as the " Concessionaire " ) for the development of the said section of the said National Highway;
AND , WHEREAS, the Central Government has entered into an agreement with the Authority for the development of the said section of the said National Highway and to issue a Fee Notification to levy and collect the fees from the said National Highway in terms of the aforesaid agreement entered into between the Authority and the said Concessionaire ;
NOW, THEREFORE , in exercise of powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , read with rule 3 of the National Highways (Collection of Fees by any person for the use of section of National Highways / permanent bridge / temporary bridge on National Highway) Rules, 1997, the Central Government , having regard to the expenditure involved in building , maintenance , management and operation of the said section of the said National Highway, interest on the capital invested , reasonable return, the volume of traffic and the period of such agreement entered into between the Authority and the Concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section starting from km. 273/500 to km. 363/885 of the National Highway number 8 in the State of Rajasthan at the rate specified in the Schedule below, and authorises the said Concessionaire to collect and retain the said fees on and from the date of commercial operation till the termination date .
Definitions , - In the notification, unless the context otherwise requires ,--
(i) " actual fees " means the fees actually charged on the road users based on both the distance between the appropriate toll booths as may be approved by the Authority and the base fee given in the Schedule to this notification;
(ii) "date of commercial operation " means the date on which the commercial operation of the section from km. 273.500 to km. 363.885 of the National Highway number 8 in the State of Rajasthan begins which shall be the date on which the Independent Consultant issues the Completion Certification or the Provisional Certificate , as the 5

case may be, upon completion of six- laning of the said section of the said National Highway in accordance with the provisions of the agreement entered into between the Authority and the Concessionaire ;
(iii) "termination date" means the date on which the said agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by a termination notice ;
(iv) "Local Personal Traffic " means and includes a personal vehicle which is registered with GVK-Jaipur Kishangarh Expressway Private Limited by any person who normally resides or works at a place that can normally be approached only by using a part of the section and such person is, therefore , required to use such vehicles for commuting on a part of the said section, without crossing more than one of the Plazas , in the course of normal travel to and from his place of work or residence .
(v) "Local Commercial Traffic " means any commercial vehicle including buses , trucks , light motor vehicles or taxis engaged in carrying goods and passengers registered with GVK-Jaipur Kishangarh Expressway Private Limited as plying routinely on the said section without crossing more than one of the Plazas ;
(vi) Words and expressions used in this notification but not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of section from km. 273/500 to km. 363/885 of the National Highway number 8 in the State of Rajasthan shall have the same meaning as assigned to them respectively in the said agreement .
SCHEDULE
Rates of base fees to be recovered from the users of the National Highway number 8 from km. 273/500 to km. 363/885 in the State of Rajasthan.
The fee shall be collected at two plazas, one at Jaipur end between km. 286/450 to km. 286/950 and another at Kishangarh end between Km 360/200 to km 360/700, applicable as on 1st July, 1997.

The aforesaid fee will be revised annually with effect from 1st July every year. The revised fee shall be computed (" Computed Fee ") as follows : -

* WPI - A = is the Wholesale Price Index on March 31 , 1997 .
* WPI - B is the Wholesale Price Index on March 31 preceding the fee- revision date .
The actual fees to be charged shall be rounded off to the nearest five rupees .
2. No fee shall be payable or collected in respect of the following vehicles, namely : - (a) Defence vehicles ;
(b) Police vehicles;
(c) Fire fighting vehicles ;
Ambulances;
(d)
Funeral vans;
(e)
(f) Post and Telegraph Department's vehicles ;
(g) Central and State Government vehicles on duty ;
(h) Vehicles with "VIP" symbols ;
(i) Vehicles belonging to ;
(i) President of India,
(ii) Vice President of India ,
(iii) Central and State Ministers ,
(iv) Leaders of Opposition of Lok Sabha / Rajya Sabha / State Legislatures , having the status of Cabinet Ministers ,
(v) Governors / Lt Governors / Executive Councilors / Speakers / Chairmen of Central and State Legislatures ,
1 (vi) Members of Parliament and Members of State Legislative Assemblies / Councils , within their respective constituencies ,
(vii) Foreign dignitaries on State visit to India, and
(viii) Foreign Diplomats stationed in India using cars with " CD " symbols .
3. The rates of fees , the Categories of vehicles exempted from payment of fee and the name , address and telephone number of the Concessionaire to whom complaints , if any, should be addressed, shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that it is easy for drivers to read the display boards .

4. The Concessionaire shall not collect any fees from Local Personal Traffic and Local Commercial Traffic in excess of the following discounted rates , namely: -
(a) Local Personal Traffic: Twenty five percent of the applicable fees for the specific category of vehicle.
(b) Local Commercial Traffic : Fifty percent of the applicable fees for the specific category of vehicle.
5. The Concessionaire shall publish substance of this notification in two local newspapers (one of which shall be in vernacular language ) , which shall also state the date of commercial operation as per the provision of this notification, at least ten days prior to the date of commercial operation. Such substance shall also be repeated every year , ten days prior to giving effect to revised fees as per this notification.
6. The actual fees to be charged to users shall be computed by the Concessionaire and sent to Authority for validation as soon as possible after 31 March every year , but at least forty five days before the rate increase is to be effective . Authority shall provide any comments or request clarifications as soon as possible upon receipt of the fee revision proposal but not later than fifteen days of receipt of the fee revision proposal . If the Authority does not offer comments or seek clarification during this period the revised fee, as proposed by the Concessionaire , shall be deemed to have been confirmed by the Authority .
