का.आ. 1466 (अ).- केंद्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय की अधिसूचना सं0 का. आ. 78 (अ) तारीख 4 फरवरी , 1999 द्वारा कर्नाटक में राष्ट्रीय राजमार्ग सं. 4 के 0.0 से 592.0 कि.मी. तक के बंगलौर से कर्नाटक/ महाराष्ट्र सीमा खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात प्राधिकरण कहा गया है) को सौंप दिया है ;
और प्राधिकरण ने 29.5 कि.मी. 'से 62.0 कि.मी. तक नीलमंगला- तुमकुर खंड जो राष्ट्रीय राजमार्ग के उक्त खंड का भाग है , के विकास के लिए जेएएस टॉल रोड , कंपनी लिमिटेड , एफ-8 , एमआईडीसी' औद्योगिक क्षेत्र , हिंगना , नागपुर-440016 (जिसे इसमें इसके पश्चात समनुदत्ती कहा गया है) के साथ करार कर लिया है ;
और केंद्रीय सरकार ने 29.5 कि.मी. से 62.0 कि.मी. तक नीलमंगला- तुमकुर खंड जो उक्त राष्ट्रीय राजमार्ग के उक्त खंड का भाग है , के विकास के लिए तथा प्राधिकरण और उक्त समनुदत्ती के बीच किए गए पूर्वोक्त करार के अनुसार उक्त राष्ट्रीय राजमार्ग से फीस उद्ग्रहीत और संग्रहीत करने के लिए फीस अधिसूचना जारी करने के लिए प्राधिकरण के साथ करार कर लिया है ;
अतः, अब, केंद्रीय सरकार , राष्ट्रीय राजमार्ग ( किसी व्यक्ति द्वारा राष्ट्रीय राजमार्ग खंड/ राष्ट्रीय राजमार्ग पर स्थायी पुल/अस्थायी पुल के उपयोग के लिए फीस वसूल करना) नियम , 1997 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त राष्ट्रीय राजमार्ग के उक्त खंड के निर्माण , अनुरक्षण , प्रबंध और प्रचालन में हुए खर्च , निवेशित पूँजी पर ब्याज , उचित लाभ , यातायात की मात्रा और प्राधिकरण और समनुदत्ती के बीच हुए ऐसे करार की अवधि को (1)

[PART II-SEC . 3 (ii)] ध्यान में रखते हुए अधिसूचित करती है कि कर्नाटक राज्य में राष्ट्रीय राजमार्ग सं . 4 के 29.50 से प्रारंभ होकर 62.0 कि.मी. तक राष्ट्रीय राजमार्ग खंड के उपयोग के लिए यांत्रिक यानों पर नीचे अनुसूची में विनिर्दिष्ट दर पर फीस संग्रहीत की जाएगी और उक्त समनुदत्ती को वाणिज्यिक प्रचालन की तारीख से पर्यवसान की तारीख तक उक्त फीस के लिए प्राधिकृत करती है ।
परिभाषाएंः- अधिसूचना में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो ,
(i) " वास्तविक फीस " से समुचित पथकर बूथों के बीच की दूरी जो प्राधिकरण द्वारा अनुमोदित की जाए और इस अधिसूचना की अनुसूची में दी गई आधार फीस दोनों पर आधारित सड़क उपयोक्ताओं पर वास्तविक रूप से प्रभारित फीस अभिप्रेत है ।
(ii ) "वाणिज्यिक प्रचालन की तारीख " से वह तारीख अभिप्रेत है जिसको कर्नाटक में राष्ट्रीय राजमार्ग सं. 4 के उक्त खंड का वाणिज्यिक प्रचालन प्रारंभ होता है जो वह तारीख होगी जिसको स्वतंत्र परामर्शी यथास्थिति प्राधिकरण और समनुदत्ती के बीच हुए करार के उपबंधों के अनुसार उक्त राष्ट्रीय राजमार्ग के उक्त खंड के पूरा होने पर समापन प्रमाणपत्र या अनंतिम प्रमाणपत्र जारी करता है ।
(iii) " पर्यवसान की तारीख " से वह तारीख अभिप्रेत है जिसको उक्त करार के उपबंधों के अनुसरण में प्राधिकरण और समनुदत्ती के बीच किया गया करार समाप्त होता है अथवा समापन नोटिस द्वारा समाप्त होता है ।

नोटः-

(ii) वसूल की जाने वाली वास्तविक फीस 1 रु0 के निकटतम पूर्णांक में होगी ।
2. निम्नलिखित प्रकार के यानों से कोई फीस नहीं ली जाएगी अर्थात्: -
(क) रक्षा यान ,

(ग) अग्निशमन यान ,
(घ) एम्बुलेंस,
(ड़) अन्त्येष्टियानं,
(च) डाक और तार विभाग के यान ,
(छ) केंद्रीय और राज्य सरकार के कार्यस्थ यान ,
(ज) अति महत्वपूर्ण व्यक्ति प्रतीक वाले अथवा निम्नलिखित से संबंधित यान ,
(i ) भारत के राष्ट्रपति ,
(ii ) भारत के उप राष्ट्रपति ,
(iii) केंद्रीय और राज्य मंत्री,
(iv) लोक सभा/राज्य सभा/राज्य विधान मंडलों में प्रतिपक्ष के नेता , जिनका स्तर कैबिनेट मंत्री का है ,
(v) राज्यपाल/उपराज्यपाल/ कार्यकारी पार्षद/केंद्रीय और राज्य विधायिकाओं' के स्पीकर/अध्यक्ष ,
(vi) अपने अपने चुनाव क्षेत्र में संसद सदस्य या विधान सभा या विधान परिषद के सदस्य,
(vii) भारत के शासकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति , सी डी प्रतीक वाली कारों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक , और
(viii ) सक्षम प्राधिकारी द्वारा पुरस्कार के प्रमाणन के संबंध में जारी परिचय पत्र प्रस्तुत करने पर वीरता पुरस्कार अर्थात् परमवीर चक्र , अशोक चक्र , महावीर चक्र , कीर्ति चक्र, वीर चक्र और शौर्य चक्र विजेता ।
3. फीस की दर , फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और समनुदत्ती जिसे शिकायत यदि कोई हो, संबोधित की जानी चाहिए , का नाम , पता , टेलीफोन नंबर , पथकर चौकी से 500 मी0 आगे , पथकर चौकी से 100 मी0 आगे और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित किया जाएगा । संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्डों को पढ़ना सहज हो । THE GAZETTE OF INDIA: EXTRAORDINARY
[PART II-SEC . 3 (ii)] 4. समनुदत्ती, एक अधिकारी को फीस संग्रहण के प्रभारी अधिकारी के रूप में नामित करेगा और समनुदत्ती और उक्त अधिकारी यह सुनिश्चित करने के लिए जिम्मेदार होंगे कि फीस का संग्रहण सहमत दर से ऊंची दर पर न हो तथा फीस संग्रहण , सड़क प्रयोक्ताओं और उनसे संबंधित अन्य सभी मामलों में किसी कठिनाई के बगैर निर्बाध रूप से हो ।
5. दोनों पथकर बूथों से गुजरने वाले वाहनों को 29.5 कि.मी. और 62.0 कि.मी. के बीच संपूर्ण परियोजना खंड के लिए निर्दिष्ट भुगतान करना होगा तथा केवल एक पथकर बूथ से गुजरने वाले वाहनों को उक्त फीस के 50% का भुगतान करना होगा ।
6. समनुदत्ती , वाणिज्यिक प्रचालन की तारीख से न्यूनतम 10 दिन पहले इस अधिसूचना का सार कम से कम दो स्थानीय समाचार पत्रों (इनमें से एक स्थनीय भाषा में होगा) प्रकाशित करेगा , जिसमें इस अधिसूचना के प्रावधान के अनुसार वाणिज्यिक प्रचालन की तारीख का भी उल्लेख होगा । ऐसा सार , इस अधिसूचना के अनुसार संशोधित दर के प्रभावी होने से 10 दिन पहले प्रति वर्ष प्रकाशित किया जाएगा । 7 . प्रयोक्ताओं से संग्रहीत की जाने वाली वास्तविक फीस की गणना समनुदत्ती द्वारा की जाएगी और प्रतिवर्ष 31 मार्च के बाद किंतु दर वृद्धि लागू होने से न्यूनतम 45 दिन पहले , शीघ्रातिशीघ्र विधिमान्यता के लिए प्राधिकरण को भेजी जाएगी । प्राधिकरण , फीस संशोधन प्रस्ताव प्राप्त होने के बाद शीघ्रातिशीघ्र किंतु फीस संशोधन प्रस्ताव प्राप्त होने के 45 दिनों के अंदर टिप्पणी अथवा स्पष्टीकरण के लिए अनुरोध भेजेगा । यदि प्राधिकरण संशोधित फीस की इस अवधि में कोई टिप्पणी नहीं देता अथवा स्पष्टीकरण नहीं मांगता जैसा कि समनुदत्ती द्वारा प्रस्ताव किया गया था , प्राधिकरण द्वारा उसकी पुष्टि की हुई मानी जाएगी ।
8. फीस का संग्रहण दो पथकर बूथों पर किया जाएगा जिनमें से एक 30.0 कि.मी. पर नीलमंगला में होगा और दूसरा 61.00 कि.मी. पर तुमकुर में होगा ।

S.O. 1466(E ) --- WHEREAS, by the notifications of the Government of India in the erstwhile Ministry of Surface Transport , number S.O 78 (E) dated 4th February 1999 issued under section !! of the National Highways Authority of India Act, 1988 ( 68 of 1988 ) , the Central Government has entrusted the Bangalore to Karnataka/ Maharashtra border section from km.0.0 to kra.592.0 of the National Highway number 4 in the State of Karnataka to the National Highways Authority of India (hereinafter referred to as the " Authority") ;

AND , WHEREAS, the Authority has entered into an agreement with JAS Toll Road Company Limited, F- 8 , MIDC Industrial Area, Hingna, Nagpur -440016 ( hereinafter referred to as the "Concessionaire ") , for the development of the Neelmangla - Tumkur stretch from km 29.5 to km 62.0 which forms part of the said section of the National Highway;
AND, WHEREAS , the Central Government has entered into an agreement with the Authority for the development of the said Neelmangla - Tumkur stretch from km 29.5 to km 62.0 which forms part of the section of the said National Highway and to issue a Fee Notification to levy and collect the Fees from the said National Highways in terms of the aforesaid agreement entered into between the Authority and the said Concessionaire ;
NOW, THEREFORE , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways (Collection of Fees by any person for the use of section of National Highways/ permanent bridge/ temporary bridge on National Highway) Rules, 1997, the Central Government, having regard to the expenditure involved in building, maintenance , management and operation of the said stretch of the said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of such agreement entered into between the Authority and the said Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the stretch of national highway starting from km.29.50 to km.62.0 of the National Highway number 4 in the State of Karnataka at the rate specified in the Schedule below, and authorises the said Concessionaire to collect and retain the said fees on and from the date of commercial operation till the termination date.
Definitions - In the notification, unless the context otherwise requires : -
(i) "actual fee" means the fee actually charged on the road users based on both the distance between the appropriate toll booths as may be approved by the Authority and the base fee given in the Schedule to this notification;
(ii) "date ofcommercial operation " means the date on which commercial operation of the said section of the National Highway number 4 in the State of Karnataka begins which shall be the date on which the Independent Consultant issues the Completion Certificate or the Provisional Certificate, as the case may be, upon completion of the said section of the said National Highway in accordance with the provisions of the agreement entered into between the Authority and the Concessionaire;
(!!!) "termination Date" means the date on which the said agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions ofthe said agreement or is terminated by a termination notice.

Notes
1. (i) The aforesaid fee will be revised with effect from 1ª July every year . The revised fee shall be computed (" Computed Fee ") as follows :

( ii) The actual fees to be charged shall be rounded off to the nearest one rupees .
2. No fee shall be payable or collected in respect of the following vehicles , namely: - (a) Defence vehicles;
(b) Police vehicles;
(c) Fire fighting vehicles ;
Ambulances;
(d)
(e) Funeral vans;
(f) Posts and Telegraph Department vehicles;
(g) Central and State Government vehicles on duty;
(h) Vehicles with "VIP" symbols belonging to the;
(i) President of India,
(ii) Vice- President of India,
(iii) Central and State Ministers ,
( iv) Leaders of Opposition in Lok Sabha / Rajya Sabha / State Legislature , having the status of Cabinet Ministers ,
( v) Governors/ Lt. Governors / Executive Councillors/ Speakers / Chairman of Central and State Legislatures ,
(vi) Members of Parliament and Members of State Legislative Assemblies/ Councils, within their respective constituencies, 7

(vii) Foreign dignitaries on State visit to India, Foreign Diplomats stationed in India using cars with " CD " symbols and
(viii) Winner of Gallantry awards such as Param Vir Chakra, Ashok Chakra, Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his photo identity card duly authenticated by the Competent Authority for such Award
3. The rates of fee, the categories of vehicles exempted from payment of fee and the name, address and telephone number of the Concessionaire to whom complaints , if any, should be addressed, shall be conspicuously and prominently displayed 500m ahead of the toll booths , 100m ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that it is easy for drivers to read the display boards .
4. The Concessionaire shall nominate an officer as in- charge of fee collection , and the Concessionaire and also said officer shall be responsible to ensure that fees are collected at not more than the agreed rates and the fee collection is smooth without causing undue hardship to the road users , and for all other matters connected therewith.
5. Vehicles passing through both the toll booths are required to pay the specified fee for the entire project stretch between km 29.5 and km 62.0, and vehicles passing through only one of the toll booths are required to pay 50 % of the said fee .
6. The concessionaire shall publish substance of this notification in two local newspapers (cne of which shall be in vernacular language) , which shall also state the date of commercial operation as per the provision of this notification, at least ten days prior to the date of commercial operation . Such substance shall also be repeated every year , ten days prior to giving effect to revised rate as per this notification.
7. The actual fees to be charged to users shall be computed by the Concessionaire and sent to the Authority for validation as soon as possible after 31 March every year , but at least forty five days before the rate increase is to be effective . Authority shall provide any comments or request clarifications as soon as possible upon receipt of the fee revision proposal but not later than fifteen days of receipts of the fee revision proposal. If the Authority does not offer comments or seek clarification during this period the revised fee, as proposed by the Concessionaire , shall be deemed to have been confirmed by the Authority.
8. The fee shall be collected at two toll booths one at Neelmangla at km 30.0 and the other at Tumkur at km 61.00 .
