का.आ. 1467 ( अ).- बंबई डॉक श्रम बोर्ड पिछले कई वर्षों से वित्तीय तंगी का सामना कर रहा था और वह अपने कर्मचारियों और रजिस्ट्रीकृत कर्मकारों को मज़दूरी का संदाय करने में असमर्थ था;
केन्द्रीय सरकार की, कतिपय पहलुओं पर विचार करने के पश्चात् यह राय बनी थी कि गंभीर वित्तीय आपात स्थिति विद्यमान थी, जिसके कारण बोर्ड अपने कृत्यों का अनुपालन करने में असमर्थ था;
उक्त बोर्ड का, केन्द्रीय सरकार द्वारा , डाक कर्मकार ( नियोजन का विनियमन ) अधिनियम, 1948 ( 1948 का 9 ) की धारा 6ख की उपधारा ( 1 ) के खंड ( क ) के अधीन, भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय की अधिसूचना सं. का.आ. 204 ( अ ) तारीख 25 फरवरी, 1994 द्वारा एक वर्ष की अवधि के लिए अधिक्रमण किया गया था और वे सभी शक्तियाँ और कृत्य जिनका उक्त बोर्ड द्वारा प्रयोग या पालन किया जा सकता था, ऐसे अधिक्रमण की अवधि के दौरान अध्यक्ष, मुम्बई पत्तन न्यास , मुंम्बई में निहित थीं ।
केन्द्रीय सरकार ने अधिक्रमण की अवधि को भारत सरकार के तत्त्कालीन जल भूतल परिवहन मंत्रालय की अधिसूचना सं. का.आ. 113 ( अ) तारीख 2 सितम्बर, 1995 , का.आ. 892 ( अ ) तारीख 23 दिसम्बर, 1996 , का.आ. 925 ( अ ) तारीख 30 दिसम्बर, 1997 , का.आ. 1114( अ) तारीख 24 दिसम्बर, 1998 , का.आ. 1252 (अ ) तारीख 20 दिसम्बर, 1999 और पोत परिवहन मंत्रालय की अधिसूचना सं. का.आ. 1161 ( अ ) तारीख 26 दिसम्बर, 2000 तथा का.आ. 4 (अ ) तारीख 31 दिसम्बर, 2001 व का.आ. 1392 ( अ ) तारीख 31 दिसम्बर, 2002 द्वारा बढाया गया था ।
है। अधिक्रमण का विस्तार 31 दिसम्बर, 2003 को समाप्त होता है, और केन्द्रीय सरकार, अधिक्रमण की अवधि को बढाना आवश्यक समझती 3826GI/2003

अतः अब केन्द्रीय सरकार उक्त अधिनियम की धारा 6 ख की उपधारा ( 3 ) के खंड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बोर्ड के अधिक्रमण की अवधि को 31 दिसम्बर , 2004 तक या मुम्बई डॉक श्रम बोर्ड के मुम्बई पत्तन न्यास में विलयन के प्रवृत्त होने की तारीख तक, इनमें से जो पूर्वतर हो, बढ़ाती है ।
2. उन सभी शक्तियों और कृत्यों का, जिनका उक्त बोर्ड द्वारा प्रयोग या पालन किया जा सकता था, ऐसे अधिक्रमण की अवधि के दौरान अध्यक्ष, मुम्बई पत्तन न्यास, मुम्बई द्वारा प्रयोग या पालन किया जाएगा ।

NOTIFICATION
New Delhi , the 26th December , 2003
S.O. 1467 (E ) .- Whereas the Bombay Dock Labour Board, Bombay was facing financial stringency for the last several years and was unable to pay wages to its employees and registered workers ;
And whereas after considering the various aspects , the Central Government formed an opinion that a grave financial emergency existed due to which the Board was unable to perform its functions ;
And whereas the said Board was superseded by the Central Government under clause (a) of Sub - section ( 1 ) of Section 6B of the Dock Workers ( Regulation of Employment ) Act, 1948 (9 of 1948 ) , vide Notification of the Government of India in the erstwhile Ministry of Surface Transport, number S.O. 204 (E) , dated the 25th February, 1994, for a period of one year and all the powers and functions which might be exercised or performed by the said Board were vested in the Chairman , Bombay Port Trust, Bombay during the period of such supersession;
And whereas the Central Government extended the periods of supersession vide notifications of the Government of India in the erstwhile Ministry of Surface Transport S.O. 113 (E) , dated the 2nd September, 1995 , S.O. 892 (E) , dated the 2.3rd December, 1996 , S.O. 925 (E) , dated the 30th December, 1997; S.O. 1114 (E) , dated the 24th December, 1998 ; S.O. 1252 (E) , dated the 20th December , 1999 ; and Ministry of Shipping S.O. 1161 (E ) , dated the 26th December, 2000; S.O. 4 (E) , dated 31-12-2001 & S.O. 1392( E) dated 31-12-2002 .
Andwhereas the extension of supersession expires on the 31st December , 2003;
And whereas the Central Government considers it necessary to extend the period of supersession ;
Now, therefore , in exercise of the powers conferred.by clause (a) of Sub- section (3 ) of the Section 6B of the said Act, the Central Government hereby extends the period of supersession of the Board till the 31st December, 2004 or the date ofcoming into force of the merger of Bombay Dock Labour Board with Mumbai Port Trust , whichever is earlier .
All the powers and functions , which may be exercised or performed by the said Board shall be exercised or performed by the Chairman , Mumbai Port Trust , Mumbai during the period of such supersession .
