सा.का.नि. 971 (अ ) .- केन्द्रीय मोटरयान अधिनियम , 1989 का और संशोधन करने के लिए निम्नलिखित प्रारूप नियम, जिसे केन्द्रीय सरकार, मोटरयान अधिनियम , 1988 (1988 का 59) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाना चाहती है, उक्त अधिनियम की धारा 212की उपधारा ( 1 ) की अपेक्षानुसार ऐसे व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है; और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर , उस् तारीख से , जिसको भारत के राजपत्र में यथाप्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध करा दीजाती हैं; तीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
किन्ही आक्षेपों या सुझावों पर , जो उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से ऊपर विनिर्दिष्ट अवधि की समाप्ति के भीतर प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ;
इन नियमों के संबंध में आपेक्ष या सुझाव ऊपर विनिर्दिष्ट अवधि के भीतर संयुक्त सचिव (परिवहन) , सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, नई दिल्ली को भेजे जा सकेंगे ।

प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटरयान (......... संशोधन) नियम , 2003 है । (2) में राजपत्र में उनके अन्तिम प्रकाशन की तारीख को प्रवृत होगें ।
2. केन्द्रीय मोटरयान नियम, 1989 के नियम 115 में उपनियम ( 13 ) के पश्चात् निम्नलिखित परंतुक अंतः स्थापित किए जाएंगे , अर्थात्: -
"परन्तु यह कि उपनियम ( 11 ) के उपबन्ध, शोलापुर और लखनऊ में रजिस्ट्रकृत होने वाले चार पहिया यानों की बाबत , 1 मार्च, 2004 को प्रवृत होंगे;
परन्तु यह और कि इस अधिसूचना के प्रभावी होने से यथास्थिति, शोलापुर से महाराष्ट्र राज्य के अन्य भागों में या लखनऊ से उत्तर प्रदेश राज्य के अन्य भागों में चलने वाले या उक्त शहरों की क्षेत्रीय अधिकारिता के भीतर अंतर- राज्यीय अनुज्ञप्तियों या राष्ट्रीय अनुज्ञप्तियों या अखिल भारतीय पर्यटक अनुज्ञप्तियों पर चलने वाले चार पहियों वाले परिवहन यानों की बाबत 1 मार्च , 2004 से 1 अप्रैल, 2005 तक प्रवृत नहीं होगें । "

आलोक रावत, संयुक्त सचिव टिप्पण:- मूल नियम सं. सा.का.नि. 590 ( अ ) , तारीख 2 जून , 1989 द्वारा अधिसूचित किए गए थे और सं. सा.का.नि. 927 ( अ ) , तारीख 5 दिसम्बर, 2003 द्वारा अंतिम संशोधन किया गया ।

NOTIFICATION
New Delhi , the 29th December , 2003
G.S.R. 971( E ) .- The following draft rules further to amend the Central Motor Vehicles Rules , 1989 , which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act , 1988 (59 of1988 ) , is hereby published as required by sub - section ( 1 ) of section 212 of the said Act for information of all persons likely to be affected thereby ; and notice is hereby given that the said draft rules will be taken into consideration after expiry of the period of thirty days from the date on which the copies of this notification , as published in the Gazette of India , are made available to the public;

Any objections or suggestions which may be received from any person with respect to the said draft rules within the expiry of the period specified will be considered by the Central Government;
The objections or suggestions to these rules may be sent to the Joint Secretary ( Transport) , Ministry of Road Transport and Highways , Transport Bhawan, New Delhi , within the period , specified above.
DRAFT RULES
1. (1 ) These rules may be called the Central Motor Vehicles ( -- Amendment ) Rules, 2003
(2) They shall come into force from the date of their final publication in the Official Gazette .
2. In the Central Motor Vehicles Rules , in rule 115 , after sub-rule (13 ) , the following provisos shall be inserted , namely: -
"Provided that the provisions of sub - rule ( 11 ) shall , in respect of four- wheeled vehicles , to be registered in Sholapur and Lucknow , come into force on the 1st day of March , 2004.
Provided further that the abovesaid provision shall not come into force with effect of this notification in respect of four- wheeled transport vehicles plying from Sholapur to other parts of the State of Maharashtra or Lucknow to the other parts of the State of Uttar Pradesh , as the case may be, or plying on the Inter- State Permits or National Permits or on the All- India Tourist Permits within the territorial jurisdiction of the said cities from 1stMarch , 2004 till 1st April , 2005 " .
