सा.का.नि. १ ( अ) .- राष्ट्रीय राजमार्ग अधिकरण ( वित्तीय प्रशासनिक शक्तियां ) नियम, 2003 का निम्नलिखित प्रारूप, जिसे केन्द्रीय सरकार राष्ट्रीय राजमार्ग नियंत्रण ( भूमि और यातायात ) अधिनियम, 2002 ( 2003 का 13 ) की धारा 50 की उप- धारा ( 2 ) के खंड (ङ) के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाना चाहती है, उक्त उप - धारा की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभवना है , प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप पर, उस तारीख से, जिसको भारत के राजपत्र में यथा प्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अवधि की समाप्ति पर या उसके पश्चात् विचार किया जाएगा;
2. ऐसे किसी आक्षेप या सुझाव पर, जो उक्त प्रारूप की बाबत किसी व्यक्ति से ऊपर विनिर्दिष्ट समय के भीतर प्राप्त किया जा सकेगा, केन्द्रीय सरकार द्वारा विचार किया जाएगा;
3. आक्षेप या सुझाव श्री यू.एस. तिवारी, उप सचिव सड़क परिवहन और राजमार्ग मंत्रालय , परिवहन भवन, 1 , संसद मार्ग , नई दिल्ली को भेजे जा सकेंगे ।
प्रारूप.
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय राजमार्ग अधिकरण ( वित्तीय और प्रशासनिक शक्तियां ) नियम, 2003 है ।
( 2 ) ये उस तारीख को प्रवृत्त होंगे जिसको अधिनियम प्रवृत्त होता है ।
2. परिभाषाएं. इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो-
(क) " अधिनियम " से राष्ट्रीय राजमार्ग नियंत्रण ( भूमि और यातायात ) अधिनियम, 2002 ( 2003 का 13 ) अभिप्रेत है;
(ख ) " अधिकरण " से अधिनियम की धारा 5 की उप - धारा ( 1 ) के अधीन स्थापित राष्ट्रीय राजमार्ग अधिकरण अभिप्रेत है;
(ग ) " पीठासीन अधिकारी " से अधिनियम की धारा 6 की उप - धाारा ( 1 ) के अधीन अधिकरण के पीठासीन अधिकारी के रूप में नियुक्त व्यक्ति अभिप्रेत है;
( घ ) ऐसे अन्य सभी शब्दों और पदों के, जो इन नियमों में प्रयुक्त हैं और परिभाषित नहीं हैं किन्तु अधिनियम में परिभाषित हैं , वही अर्थ होंगे जो क्रमशः उनके अधिनियम में है ।
3. पीठासीन अधिकारी की शक्तियां- पीठासीन अधिकारी को वही शक्तियां होंगी जो साधारण वित्तीय नियम, 1963 , वित्तीय शक्तियों के प्रत्यायोजन नियम , 1978 , मूल नियम , अनुपूरक नियम , केन्द्रीय सिविल सेवा ( छुट्टी ) , नियम, 1972, केन्द्रीय सिविल सेवा ( कार्य ग्रहण काल)

[PART II-SEC. 3 (i) ] नियम , 1979, केन्द्रीय सिविल सेवा (पेंशन ) नियम, 1972, केन्द्रीय सिविल सेवा ( आचरण) नियम, 1964, केन्द्रीय सिविल सेवा ( वर्गीकरण, नियंत्रण और अपील ) नियम , 1965 और साधारण भविष्य निधि ( केन्द्रीय सेवा ) नियम, 1960 की बाबत विभागाध्यक्ष को प्रदत्त हैं :
परन्तु इन नियमों के अधीन पीठासीन अधिकारी द्वारा शक्तियों का प्रयोग ऐसे अनुदेशों के अधीन रहते हुए किया जाएगा जो केन्द्रीय सरकार द्वारा समय- समय पर जारी किए जाएं ।

NOTIFICATION
New Delhi, the 5th January, 2004
G.S.R. 9 (E). The following draft of the National Highways Tribunal ( Financial and Administrative Powers) Rules, 2003 , which the Central Government proposes to make in exercise of the powers conferred by Sub -section (1 ) read with clause (e) of Sub- section (2) of Section 50 ofthe Control of National Highways ( Land and Traffic) Act, 2002 ( 13 of 2003) is hereby published as required by the said Sub - section ( 1 ) for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiry of the period ofthirty days from the date on which the copies of this notification as published in the Gazette of India are made available to the public.
2. Any objection or suggestion which may be received from any person with respect to the said draft within the time specified above shall be considered by the Central Government .
3. The objections or suggestions may be sentto Shri U.S. Tiwari , Deputy Secretary, Ministry of Road Transport andHighways , Transport Bhavan, 1 , Parliament Street, New Delhi - 110001 .
DRAFT
1. Short title and commencement .-( 1) These rules may be called the National Highways Tribunal ( Financial and Administrative Powers) Rules , 2003 .
(2) They shall come into force on the date on which the Act comes into force.
2. Definitions. In these rules , unless the context otherwise requires ,-
( a) " Act " means the Control of National Highways (Land and Traffic) Act, 2002 (13 of 2003 ) ;
(b) " Tribunal " means the National Highways Tribunal established under Sub - section ( 1 ) of Section 5 of the Act;
(c) "Presiding Officer" means a person appointed as Presiding Officer of the Tribunal under Sub -section (1 ) of Section 6 of theAct;
(d) All other words and expressions used and not defined in these rules but defined in the Act shall have the meanings respectively assigned to them in the Act.
3. Powers of the Presiding Officer.- The Presiding Officer shall have the same powers as are conferred on a Head ofDepartment in respect of the General Financial Rules , 1963 , the Delegation of the Financial Powers Rules, 1978, the Fundamental Rules, the Supplementary Rules , the Central Civil Services (Leave ) Rules , 1972, the Central Civil Services (Joining Tinte) Rules , 1979, the Central Services (Pension) Rules , 1972, the Central Civil Services ( Conduct) Rules, 1964, the Central Civil Services ( Classification , Control and Appeal ) Rules, 1965 and the General Provident Fund (Central Services) Rules , 1960 :
Provided that the exercise ofpowers by the Presiding Officer under these rules shall be subject to such instructions as may be issued from time to time by the Central Govemment .
