सं. 20012/10/2003-बीसीसी. जबकि भारत सरकार ने विद्यमान आरक्षण नीति के अंतर्गत न आने वाले आर्थिक रूप से पिछड़े वर्गों के लिए राज्य के अधीन सिविल पदों और सेवाओं में आरक्षण प्रदान करना समीचीन समझा है ।
2. और जबकि भारत सरकार भी इस विषय पर राज्य सरकारों/संघ राज्य क्षेत्रों और अन्य के विचार प्राप्त करने आवश्यक समझती है । 3. और जबकि आर्थिक रूप से पिछड़े वर्गों की पहचान के लिए आधार का अवधारण करने और उससे संबंधित आरक्षण केयों एवं मात्रा का सुझाव देने के लिए विस्तृत जांच करनी आवश्यक होगी ।
4. अतः , अब , भारत सरकार ने एक वर्ष के लिए एक आयोग गठित करने का संकल्प लिया है , जो राज्य सरकारों/ संघ राज्य क्षत्रों और अन्य से परामर्श करेगा तथा तौर - तरीके बनाएगा जिससे कि विद्यमान आरक्षण नीति के अंतर्गत न आने वाले आर्थिक रूप से पिछड़े वर्गों के लिए प्रस्तावित आरक्षण को लागू किया जा सके ।
5. आयोग के विचारार्थ विषय ये हैं :
(क) इस विषय पर राज्य सरकारों/ संघ राज्य क्षेत्रों और अन्य के विचार प्राप्त करना;
(ख) संबंधित आरक्षण के उपाय और मात्रा की सिफारिश करना;
( ग ) आर्थिक रूप से पिछड़े वर्गों की पहचान के लिए मानदंडों का सुझाव देना; और
( घ) राष्ट्रपति को अपने विचार- विमर्शों एवं सिफारिशों की रिपोर्ट प्रस्तुत करना ।
6. ( 1 ) यह आयोग , एक अध्यक्ष , चार सदस्य और एक सचिव से मिलकर बनाया जाएगा ।
( 2 ) अध्यक्ष और प्रत्येक अन्य सदस्य ऐसे होंगे, जो योग्य , निष्ठावान और प्रतिष्ठित हों ।
7. आयोग केन्द्रीय सरकार, राज्य सरकारों, संघ राज्य क्षेत्रों, अन्य प्राधिकरणों, संगठनों और व्यक्तियों से ऐसी जानकारी प्राप्त करेगा जो वह इस विषय पर आवश्यक या संगत समझे ।
8. आयोग अपनी स्वयं की कार्यप्रणाली अपना सकता है और जब कभी आवश्यक हो, भारत के किसी भी भाग में जा सकता है । १. आयोग का मुख्यालय नई दिल्ली में होगा ।
10. आयोग अपनी रिपोर्ट राष्ट्रपति को इस संकल्प की अधिसूचना की तारीख से एक वर्ष के अंदर प्रस्तुत करेगा ।

(Backward Classes Division)
RESOLUTION
New Delhi , the 6th January , 2004
No. 20012/10/ 2003 - BCC .-Whereas the Government of India has considered it expedient to provide reservation in civil posts and services under the State for economically backward classes (EBCs) not covered by the existing, Reservation Policy;
2. And whereas the Government of India also consider it proper to elicit the views of State Governments/Union territories and others on the subject ;
3. And whereas a detailed examination would be required to determine the basis for identification ofeconomically backward classes and suggest the measures and quantum of reservation thereto;
4. Now, therefore , the Government of India has resolved to constitute for a period of one year a Commission to consult the State Governments /Union territories and others and work out the modalitics so as to give effect to the proposed reservation for EBCs not covered by the existing Reservation Policy .
5. The terms & reference of the Commission are as follows :
( a) to clicit the views of the State Governments/Union territories and others on the subject;
(b ) to recommend the measures and quantum of reservation;
(c) to suggest criteria for identification of economically backward classes ; and
(d) to presentto the President a Report of their deliberations and recommendations .
6. (1 ) The Commission shall consist of a Chairperson, four Members and a Secretary ,
( 2) The Chairperson and every other Member shall be a person of ability , integrity and standing.
7. The Commission shall obtain such information as it may deem necessary or relevant to the subject matter from the Central Government , State Governments , Union territories , other authorities , organizations and individuals .
8. The Commission may adopt its own procedure of working and may visit any part of India as and when considered necessary .
9. The Headquarters of the Commission shall be in New Delhi .
10. The Commission will submit its Report to the President within a period of one year from the date of notification of this Resolution .
