का.आ. 35 ( अ) .- केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा उक की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. राजपत्र, असाधारण, भाग 2 , खण्ड 3 , उपखण्ड ( ii ) तमिलनाडु राज्य में 22/850 कि.मी. से 39/900 23(अ ), तारीख 9 जनवरी , 2003 जो भारत के तारीख 9 जनवरी , 2003 में प्रकाशित की गई थी, कि.मी. के खंड द्वारा ( कृष्णागिरी- रानीपेट खण्ड) पर राष्ट्रीय राजमार्ग संख्या 46 को चार लेन का बनाने के लोक प्रयोजन के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि के अर्जन की घोषणा की थी ;
और उक्त राजपत्र अधिसूचना तारीख 7 मार्च, 2003 को "हिन्दु" और "दिनाथान्थी " में प्रकाशित की गई थी ;
और सक्षम प्राधिकारी ने राष्ट्रीय राजमार्ग संख्या-48 को चार लेन का बनाने के लिए जनता से प्राप्त आक्षेपों पर विचार किया है और चर्चा की है ;
और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 3 घ की उपधारा ( 1 ) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी हैं ;

अतः अब केन्द्री सरकार, उक्त रिपोर्ट के प्राप्त हो जाने पर और उक्त अधिनियम की धारा 3 घ की उपधारा ( 1 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना चाहिए ;
और केन्द्रीय सरकार, उक्त अधिनियम की धारा 3 घ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशित होने पर उक्त अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमो से मुक्त आत्यांतिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

NOTIFICATION
New Delhi , the 8th January, 2004
S.O. 35 (E ) . Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways , number S.O. 23 (E ) , dated the 9th January , 2003, issued under sub -section ( 1 ) of section 3A of the National Highways Act , 1956 (48 of 1956) (hereinafter referred to as the said Act) , published in Part II, Section 3 , Sub- section (ii ) Gazette of India, Extraordinary , dated the 9th January, 2003 , the Central Government declared its intention to acquire the land specified in the Schedule appended to that notification for the public purpose of four- laning of National Highway No.46 on the stretch from Km.22 /850 to Km.39/900 (Krishnagiri - Ranipet Section ) in the State of Tamil Nadu;

AND WHEREAS the said gazette notification has been published in the Hindu and the Dinathanthi dated 7th March, 2003 .
AND WHEREAS the objections received from the public to the four - laning of National Highway No.46 have been considered and discussed by the competent authority.
AND WHEREAS in pursuance of subsection of ( 1 ) of section 3D of the said Act , the competent authority has submitted its report to the Central Government ;
NOW , THEREFORE , upon receipt of the said report and in exercise of the powers conferred by sub - section (1 ) of section 3D of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed to this notification should be acquired for the aforesaid purpose;
AND FURTHER, in pursuance of sub- section (2 ) of section 3D of the said Act, the Central Government hereby declares that , on the publication of this notification in the Official Gazette , the land specified in the said Schedule shall vest absolutely in the Central Government free from all encumbrances .
