का.आ. 44( अ).-केन्द्रीय सरकार, भारतीय दूर - संचार विनियामक प्राधिकरण अधिनियम , 1997 ( 1997 का 24 ) की धारा 2 की उप - धारा ( 1 ) के खण्ड ( ट) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए प्रसारण सेवाओं और केबल सेवाओं को दूर- संचार सेवा के रूप में अधिसूचित करती है ।

NOTIFICATION
New Delhi , the 9th January, 2004
S.O. 44(E) . In exercise of the powers conferrred by the proviso to clause (k) of Sub - section ( 1 ) of Section 2 of the Telecom. Regulatory Authority of India Act , 1997 (24 of 1997) , the Central Government hereby notifies the broadcasting services and cable services to be telecommunication service .

का.आ. 45( अ ).-केन्द्रीय सरकार, भारतीय दूर - संचार विनियामक प्राधिकरण अधिनियम , 1997 ( 1997 का 24 ) ( जिसे इसमें इसके पश्चात् अधिनियम कहा गया है ) की धारा 11 की उप - धारा ( 1 ) के खंड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अतिरिक्त कृत्यों को अधिनियम की धारा 3 की उप - धारा ( 1 ) के अधीन स्थापित भारतीय दूर - संचार विनियामक प्राधिकरण को सौंपती है, अर्थात्: - (1 ) अधिनियम की धारा 11 की उप - धारा ( 1 ) के खंड ( क) में अंतर्विष्ट उपबंधों पर प्रतिकूल प्रभाव डाले बिना निम्नलिखित के संबंध में सिफारिश करने के लिए-
(क) ऐसे निबंधन और शर्तें जिन पर " संबोध्य प्रणालियों " का उपभोक्ताओं के लिए उपबंध किया जाएगा ।
स्पष्टीकरण.- इस खंड के प्रयोजनों के लिए, " संबोध्य प्रणाली " से अभिप्रेत है एक इलेक्ट्रानिक युक्ति या एक से अधिक इलेक्ट्रानिक युक्तियां जो उस एकीकृत प्रणाली में लगाई गई हैं जिसके माध्यम से केबल टेलीविजन नेटवर्क के संकेत गूढ़लेखित या गैर - गूढ़लेखित रूप में भेजे जा सकते हैं, जिनका ऐसे अभिदाता की रूचि और अनुरोध पर केबल आपरेटर द्वारा , अभिदाता के परिसरों में अभिदाता को दिए गए प्राधिकार की सीमाओं के भीतर युक्ति या युक्तियों द्वारा कूटवाचन किया जा सकता है;

[PART II SEC. 3 (ii) ] (ख) संदाय चैनलों और साथ ही अन्य चैनलों में विज्ञापन के लिए अधिकतम समय का विनियमन करने के लिए पैरामीटर । (2) अधिनियम की धारा 11 की उप - धारा ( 2 ) के उपबंधों पर प्रतिकूल प्रभाव डाले बिना संदाय चैनलों की दरों के पुनरीक्षण के लिए और उनकी आवधिकता के लिए, जिनके अंतर्गत अंतरिम उपाय भी हैं, मानक सन्नियम विनिर्दिष्ट करने के लिए भी।

ORDER
New Delhi, the 9th January, 2004
S.O. 45 (E) . In exercise of the powers conferred by clause (d) of Sub - section ( 1 ) of Section 11 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) (hereinafter referred to as the Act), the Central Government hereby entrusts the following additional functions to the Telecom Regulatory Authority of India , established under Sub - section (1) of Section 3 of the Act, in respect of broadcasting services and cable services, namely :--
(1) Without prejudice to the provisions contained in clause ( a) of Sub - section (1 ) of Section 11 of the Act, to make recommendation regarding-
(a) the terms and conditions on which the " Addressable systems " shall be provided to customers .
Explanation .- For the purposes of this clause " addressable system" , with its grammatical variation, means an electronic device or more than one electronic devices put in an integrated system through which signals of cable television network can be sent in encrypted or unencrypted form, which can be decoded by the device or devices at the premises of the subscriber within the limits of authorisation made, on the choice and request of such subscriber, by the cable operator for that purpose to the subscriber;
(b) theparameters for regulating maximum time for advertisements in pay channels as well as other channels.
(2) Without prejudice to the provisions of Sub - section (2) of Section 11 of the Act, also to specify standard norms for, and periodicity of, revision of rates of pay channels , including interim measures .
