का.आ. 91 ( अ ).- केंद्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 (1988 का 68) की धारा 11 के तहत जारी की गई भारत सरकार , तत्कालीन जल भूतल परिवहन मंत्रालय (सड़क पक्ष) की तारीख 4 फरवरी , 1999 की अधिसूचना सं० का. आ. 78 (अ) द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग सं . 8 का 381.60 कि.मी. से 502.27 कि.मी. खंड (गुजरात/ महाराष्ट्र सीमा से मुंबई खंड) भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा था ।
अतः , अब , केंद्रीय सरकार , राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग प्रखंड और स्थायी पुल के उपयोग के लिए फीस लोक वित्तपोषित परियोजनाएं) नियम , 1997 के नियम 3 , 5 और 11 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह अधिसूचित करती है कि महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग सं. 8 ( गुजरात/ महाराष्ट्र सीमा से मुंबई खंड) पर 381.60 कि.मी. से 439.00 कि.मी. तक राष्ट्रीय राजमार्ग के उक्त खंड के प्रयोग के लिए उक्त अनुसूची के कॉलम (2) में विनिर्दिष्ट वाहनों पर उक्त अनुसूची के कॉलम (3) और (4) में विनिर्दिष्ट संबंधित दरों पर केंद्र सरकार की ओर से भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभागीय तौर पर अथवा प्रतियोगी निविदा के आधार पर निजी ठेकेदारों के माध्यम से फीस उद्ग्रहीत और संग्रहीत की जाएगी । यह फीस इस अधिसचूना के सरकारी राजपत्र में प्रकाशन की तारीख से अथवा उक्त खंड को यातायात के लिए खोले जाने की तारीख से, जो भी बाद में हो , स्थायी रूप से संग्रहीत की जाएगी ।

महाराष्ट्र में राष्ट्रीय राजमार्ग सं . 8 के 381.60 कि.मी. से 439.00 कि.मी. ( कजली मनोर खंड) के चार लेन वाले खंड के प्रयोक्ताओं से वसूल की जाने वाली फीस की दर ।

टिप्पण: -
1. जब उसी यान को एक दिन में एक से अधिक बार पथकर द्वार को पार करना है तो प्रयोक्ता को यह विकल्प होगा कि वह पहली बार ही द्वार पार करते समय अनुसूची में दी गई दरों पर अनेक बार यात्रा के लिए फीस का संदाय कर दे या यदि यान को संपूर्ण मास में लगातार या प्रायः बार बार उक्त खंड का प्रयोग करना पड़ता है तो यान का स्वामी पूर्वोक्त अनुसूची में यथा विनिर्दिष्ट उसको लागू एकल दरों के तीस गुणा के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
2. निम्नलिखित प्रकार के यानों से पूर्वोक्त अनुसूची में उपर्युक्त विनिर्दिष्ट फीस नहीं ली जाएगी अर्थात्: -
यान -
(1 )
(क) जो अति महत्वपूर्ण व्यक्ति प्रतीक वाले अथवा निम्नलिखित से संबंधित हैं : -
(i ) भारत के राष्ट्रपति ,
(ii) भारत के उप राष्ट्रपति,
राज्य के राज्यपाल अथवा संघ राज्य क्षेत्र के उपराज्यपाल
(iii)
(iv) भारत के शासकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति ,
(V) सी डी/ सी सी नंबर प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक ,
(vi) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद या राज्य विधान सभा के अध्यक्ष या केंद्रीय अथवा राज्य मंत्री अथवा लोक सभा या राज्य सभा या राज्य विधायिका में प्रतिपक्ष के नेता जिनका दर्जा कैबिनेट मंत्री का हो यदि वे वाहन में हों , अथवा
(vii) संपूर्ण देश में संसद के सदस्य अथवा अपने अपने राज्यों में राज्य की विधान सभा के सदस्य या राज्य की विधान परिषद के सदस्य यदि वह यथास्थिति संसद अथवा राज्य की संबंधित विधायिका द्वारा जारी पहचान पत्र प्रस्तुत करते हैं , भारत का राजपत्र : असाधारण

(ख) सक्षम प्राधिकारी द्वारा पुरस्कार के प्रमाणन के संबंध में जारी परिचय पत्र प्रस्तुत करने पर वीरता पुरस्कार अर्थात् परमवीर चक्र , अशोक चक्र , महावीर चक्र , कीर्ति चक्र , वीर चक्र और शौर्य चक्र विजेता ।
(2) रक्षा यान , पुलिस यान , अग्नि शमन यान, एम्बुलेंस , अन्त्येष्टि यान , डाक और तार विभाग के यान , केंद्रीय और राज्य सरकार के कार्यस्थ यान ।
3. फीस की दर , फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और उस प्राधिकारी का नाम , पता टेलीफोन संख्या,, जिसे शिकायत , यदि कोई हो , संबोधित की जानी चाहिए , पथकर चौकी से 500 मी० आंगे , पथकर चौकी से 100 मी0 आगे और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित किया जाएगा । संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोडौं को पढ़ना सहज हो ।
4. यह फीस , कजली- मनोर खंड के 421.00 कि.मी. पर ही संगृहीत की जाएगी ।

NOTIFICATION
New Delhi , the 15th January , 2004
S.O. 91 ( E) .- WHEREAS , by the notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , number S.O. 78 (E) , dated 4th Feburary, 1999 issued under section 11 of the National Highways Authority of India Act , 1988, (68 of 1988), the Central Government entrusted the section of the National Highway number 8 from km. 381.60 to km. 502.27 (Gujarat/ Maharashatra border to Mumbai section) in the State ofMaharashatra to the National Highways Authority of India;
NOW, THEREFORE, in exercise of the powers conferred by section 7 of the National Highways Act , 1956 (48 of 1956) , read with rules 3, 5 and 11 of the National Highways (Fees for the use of National Highway Section and permanent Bridge - Public Funded Projects) Rules , 1997 , the Central Government hereby notifies that there shall be levied and collected, fees on mechanical vehicles specified in column (2) of the Schedule annexed hereto by the the National Highways Authority of India departmentally or through private contractors on the basis of competitive bidding on behalf of the Central Government for the use of the said stretch of the national highway from km . 381.60 to km . 439.00 on the National Highway number 8 (Gujarat/ Maharashatra border to Mumbai section) in the State of Maharashatra at the respective rates specified in columns (3 ) and (4) of the said Schedule . The fees shall be collected in perpetuity from the date of the publication of this notification in the official Gazette or opening of the said stretch to traffic which ever is the latest .

Notes: -
1. When the same vehicle has to cross the toll booth more than once in a day, the user shall have the option to pay the fee for the multiple trips at the rates as given in Schedule above while crossing the gate in first trip itself or if the vehicle has to use the said stretch continuously and frequently for the entire month, the vehicle owner can have a monthly pass on payment of charges equal to thirty times single rates applicable to it as specified in the aforesaid Schedule .
2. The following types of vehicles shall be exempted from the fee specified above in the Schedule, namely: -
(i) vehicles-
(A) having " VIP" symbols ; or officially belonging to -
(a) President of India;
(b) Vice- President of India;
(c) Governor of a state or Lt. Governor of a Union Territory;
(d) A Foreign Dignitary on State visit to India;
(e) A Foreign diplomat stationed in India using cars with " CD" / " CC" number plates;
(f) Chairman of Rajya Sabha or Speaker of Lok Sabha or Chairman of a State Legislative Council or Speaker of a State Legislative Assembly or a Minister for the Union or State , or Leaders of Opposition in Lok Sabha or Rajya Sabha or State Legislatures, having the status of Cabinet Minister, if he is sitting in the vehicle ; or
(g) a Member of Parliament, in the entire country or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective state, if he produces his identity card issued by the Parliament or concerned Legislature of a State, as the case may be;
(B) belonging to winner of Gallantry awards such as Param Vir Chakra, Ashok Chakra, Maha Vir Chakra, Kirti Chakra , Vir Chakra and Shaurya Chakra, if such awardee produces his photo identity card duly authenticated by the Competent Authority for such Award भारत का राजपत्र असाधारण

(ii) Defence vehicles, Police vehicles, Fire- fighting vehicles, Ambulances , Funeral vans, Posts and Telegraphs Department vehicles and Central Government and State Government vehicles on duty.
3. The rates of fee, the categories of vehicles exempted from payment of fee and the name, address and telephone number of the authority to whom complaints, if any , should be addressed, shall be conspicuously and prominently displayed 500m ahead of the toll booths , 100m ahead of the toll booths and at the toll booths also, the height of the display boards and size of letters being such that it is easy for drivers to read the display boards .
4. The fees shall be collected only at km . 421.00 of the Kajali- Manor Section.
