का.आ. 108( अ ) जबकि आंध्र प्रदेश राज्य के करीमनगर जिले में मैसर्स सिंगरेनी कोलियरीज कंपनी लिमिटेड की कोयला खदान, विशेष रूप से रामागुण्डम क्षेत्र में गोदावरी खान संख्या ४ ए में 17 अक्तूबर, 2003 को दुर्घटना हुई है, जिसमें कुछ व्यक्तियों की मृत्यु हुई है ।
और जबकि केन्द्रीय सरकार की राय है कि दुर्घटना होने के कारणों और परिस्थितियों की औपचारिक जांच करवाई जानी चाहिए और इसके साथ- साथ दुर्घटना होने के कारणों के लिए जिम्मेदारी निर्धारित करना भी आवश्यक है ।
अतः , अब, खान अधिनियम , 1952 ( 1952 का 35 ) की धारा 24 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार ऐसी जांच करने और तीन माह की अवधि के भीतर एक रिपोर्ट प्रस्तुत करने के लिए आंध्र प्रदेश उच्च न्यायालय के न्यायाधीश न्यायमूर्ति श्री बिलाल नाजकी को नियुक्त करती है । केन्द्रीय सरकार जांच करवाने में असेसर के रूप में निम्नलिखित व्यक्तियों को भी नियुक्त करती है, अर्थात्:-
1. श्री ए.के. रुद्रा, पूर्व खान सुरक्षा महानिदेशक , सी-2/26 , केन्द्रीय विहार, वी आई पी रोड, कोलकाता -52 । 2. श्री कमलेश सहाय , सदस्य , सुरक्षा बोर्ड ( बीएमएस ) , भुरकुण्डा अस्पताल कालोनी , पी.ओ. भुरकुण्डा बाजार, जिला- हजारीबाग , झारखण्ड ।

S.O. 108 (E) . Whereas an accident has occurred in the colliery ofM/s . Singareni Collieries Company Limited,, more particularly in the Godavarikhani No. 8A Mine of Ramagundam Region in District Karimnagar of Andhra Pradesh State, on 17th October, 2003 causing loss of lives .
And where the Central Government is of the opinion that a formal inquiry into the causes and circumstances attending the accidents ought to be held and in addition it isalso necessary to fix responsibility for the causes lead- ing to the accidents .
Now, therefore, in exercise of the powers conferred by sub -section ( 1) of Section 24 of the Mines Act, 1952 (35 of1952), the Central Government hereby appoints Shri Jus- tice Bilal Nazki , Judge, High Court of Andhra Pradesh to hold such inquiry and present a report within a period of three months . The Central Government also appoints the following persons as assessors in holding of the inquiry , namely:---
1. Sh. A.K. Rudra , Ex - Director General of Mines Safety , C-2 /26 , Kendriya Vihar , V.I.P. Road, Kolkatta-52.
2. Sh. Kamlesh Sahay, Member , Safety Board (BMS) , Bhurkunda Hospital Colony, P.O. Bhurkunda Bazar, Distt . Hazaribagh , Jharkhand.
