का.आ. 105 ( अ ) .- बहु- राज्य सहकारी समिति अधिनियम , 2002 ( 2002 का 39 ) की धारा 4 के उप- खण्ड ( 2 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा निदेश देती है कि उक्त अधिनियम की धारा 43 और 45 (6 ) के तहत केन्द्रीय पंजीकार द्वारा प्रयोग मेंलाई जाने वाली शक्तियों का प्रयोग सभी राज्यों/ संघ शासित क्षेत्रों द्वारा उनके संगत क्षेत्राधिकार में स्थित बहु - राज्य सहकारी समितियों के मामले में भी निम्नलिखित शर्तों के अधीन किया जा सकता है-
1. बहु- राज्य सहकारी समिति अधिनियम , 2002 की धारा 3 ( द ) के तहत पारिभाषित किए गए अनुसार किसी राष्ट्रीय सहकारी समितिके मामले में ऐसी शक्तियां इन प्राधिकरणों द्वारा प्रयोग में नहीं लाई जा सकती है,
2. ये प्राधिकरण इस अधिनियम की धारा 4 के उप- खण्ड ( 1 ) के तहत नियुक्त केन्द्रीय पंजीकार द्वारा समय- समय पर दिए गए निर्देशों का अनुपालन करेंगे, '
3. शक्तियों का प्रत्यायोजन उन समितियों तक ही सीमित है जिनके निदेशक मण्डल/प्रबंधन समिति/ अभिशासी परिषद् आदि बहु- राज्य सहकारी समिति अधिनियम, 1984 के अनुसार चयनित किए गए थे और तीन वर्षों के कार्यकाल की समाप्ति के बावजूद अभी भी काम कर रहे हैं ।

NOTIFICATION
NewDelhi , the 20th January, 2004
S.O. 105(E) . In exercise of the powers conferred vide Sub- section (2) of Section 4 ofthe Multi State Co-operative Societies Act , 2002 (39 of 2002) , the Central Government hereby directs that the powers exercisable by the Central Registrar under Sections 43 and 45 (6 ) of the Act shall also be exercisable by Registrar of Co-operative Societies of all the States/UTs in respect ofthe multi- State Co-operative Societies located in their respective jurisdiction, subject to the following :
1. Such powers in relation to a National Co-operative Society as defined under Section 3 (r) of the MSCS Act, 2002 shall not be exercisable by these officers ;
2. These officers shall comply with the directions as may be given by the Central Registrar, appointed under Sub- section ( 1) of Section 4 of this Act, from time to time ;
3. The delegation of the powers are limited to the societies whose Board ofDirectors/Managing Committee/Governing Council etc. were elected as per the MSCS Act, 1984, and are still continuing despite expiry of their three years ' term.
