सा.का.नि. 59( अ).- जबकि केन्द्रीय सरकार का विचार यह है कि विस्फोटक नामतः नाइट्रोग्लाइसीरिन अथवा अन्य कोई पदार्थ चाहे वह उक्त विस्फोटक ( श्रेणी 3 डिवीजन 1 के विस्फोटक ) का अकेला रसायन यौगिक अथवा मिश्रण हो , बहुत खतरनाक प्रकृति का है;
और जबकि नाइट्रोग्लाइसीरिन आधारित विस्फोटकों ( श्रेणी 3 डिवीजन । के विस्फोटकों ) का कब्जा निषेध करना जन सुरक्षा के लिए समीचीन है;
अतः अब विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 6 की उप - धारा ( 1 ) के खंड ( क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्वारा अप्रैल, 2004 के प्रथम दिन से देश भर में उक्त विस्फोटकों के कब्जे, बिक्री और प्रयोग का निषेध करती है ।

MINISTRY OF COMMERCE AND INDUSTRY (Department of Industrial Policy and Promotion) NOTIFICATION
New Delhi , the 21st January, 2004
G.S.R. 59(E) .-Whereas the Central Government is of the opinion that the explosive , namely, nitro - glycerine or such other substance whether a single chemical compound or a mixture of the said explosive ( explosive of Class 3 Division 1) is of a dangerous character ;
Andwhereas , it is expedient for the security concerns and the public safety to prohibit the possession of nitro- glycerine -based explosives ( explosive of Class 3 Division 1) ;
Now, therefore, in exercise of the powers conferred by clause (a) of Sub- section ( 1) of Section 6 of the Explosives Act, 1884 (4 of 1884) , the Central Government hereby prohibits the possession, sale and use of the said explosives throughout the country with effect from the 1stday ofApril , 2004.
