नईदिल्ली, 22 जनवरी , 2004
का.आ. 115(अ).-केन्द्रीय सरकार ने , कोयला धारक क्षेत्र ( अर्जन और विकास ) अधिनियम, 1957 ( 1957 का 20 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 4 की उपधारा ( 1 ) के अधीन , भारत सरकार के कोयला मंत्रालय की अधिसूचना सं. का.आ. 175 तारीख 1.1 जनवरी, 2002 द्वारा जो भारत के राजपत्र भाग II , खंड 3 , उपखंड ( ii ) , तारीख 26 जनवरी , 2002 में प्रकाशित की गई थी, इससे उपाबद्ध अनुसूची में और इससे संलग्न अनुसूची में भी विनिर्दिष्ट भूमि में जिसकी माप 1318.642 हैक्टर (लगभग ) या 3258.36 एकड़ ( लगभग ) है, कोयले का पूर्वेक्षण करने के अपने आशय की सूचना दी थी ।
और उक्त भूमिके संबंध में, उक्त अधिनियम की धारा 7 की उपधारा ( 1 ) के अधीन , उक्त अधिनियम की धारा 4 की उपधारा ( 1 ) के अधीन अधिसूचना की तारीख से दो वर्ष की अवधि के भीतर कोई सूचना नहीं दी गई है;
अतः अब केन्द्रीय सरकार उक्त अधिनियम की धारा 7 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तारीख 26 जनवरी , 2004 से आरम्भहोने वाले एक वर्ष की और अवधि को विनिर्दिष्ट करती है , जिसके भीतर केन्द्रीय सरकार उक्त भूमियों का अर्जन करने के अपने आशय की सूचना दे सकेगी ।

[PART II-SEC. 3 ( ii )] सीमा वर्णन
क-ख रेखा ग्राम देवरी की सीमा पर बिन्दु " क " से आरंभ होती है और देवरी से गुजरते हुए बिन्दु " ख " पर मिलती है ।
ख -ग रेखा ग्राम केल्होरी से होते हुए बिन्दु " ग " पर मिलती है ।
ग -घ रेखा ग्राम केल्होरी, चचाई आबाद की पूर्वी सीमा के साथ होते हुए बिन्दु " घ " पर मिलती है ।
घ-क रेखा ग्राम चचाई आबाद, से गुज़र कर ग्राम केल्होरी देवरी की दक्षिण सीमा के साथ होते हुए जाती है और आरंभिक बिन्दु " क " पर मिलती है ।

NOTIFICATION
New Delhi, the 22nd January, 2004
S.O. 115 (E) . Whereas by the notification of the Government of India in the Ministry of Coal published in the Gazette of India, Part II , Section 3 , Sub- section ( ii) dated the 26th January , 2002 number S.O. 175 dated the 11th January , 2002, under Sub -section (1 ) of Section 4 ofthe Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act ) , the Central Government gave notice of its intention to prospect for coal in lands measuring 1318.642 hectares (approximately ) or 3258.36 acres (approximately) in the locality specified in the schedule appended thereto as also in the schedule hereto annexed.
And whereas in respect of the said lands , no notice under sub -section ( 1 ) of Section 7 of the said Act has been given within a period of two years from the date of notification under sub -section ( 1 ) of Section 4 the said act; Now, therefore , in exercise of the powers conferred by the sub -section ( 1 ) of Section 7 of the said Act, the Central Government hereby specifies a further period of one year commencing from 26th January, 2004, as the period within which the Central Government may give notice of its intention to acquire the said lands.
